BOARD OF SELECTMEN
MINUTES OF MEETING
May 13, 1982
PRESENT: Chairman McNair., Selectmen Mahana and Levine, Town Manager,
W. Chadwick Maurer, Jr. Selectmen Colella and May not present.
The Board met with Elias Cooney, Arthur Stockus and Rachel Smith of
Whitman & Howard regarding the progress on water projects.
1. Rachel Smith reviewed her management letter of the water system as
it had been requested by the Board. A formal report was submitted to
the Board dated May 10, 1982. Her general comment was that the water
system had been operating in accordance with the operation and maintenance
manual and that the major item that had not -been ateomplished was the
valve and hydrant maintenance record program. She suggested that the
Town purchase a computer for this and will get back to the Town about
how the program would be written.
2. Arthur Stockus discussed the well exploration program and the
Bogdanchik property in West Mansfield. He recommended that a prolonged
test be conducted. It was the concensus of the Board that the test not
be conducted and discussion should be held with Mr. Bogdanchik. After
these discussions the Board will decide if they want to proceed with a
test.
3. Arthus Stockus discussed the Farmers Home project regarding contract
80 -7. It is now estimated that there could be a shortfall in the Farmers
Home program of $45,000. The Town Manager explained that these funds
could come from the Town Meeting vote of 1981, Article 15. There is also
the problem of having additional funds through the water rehabilitation
program. He then explained the low bid for the contract 80 -7 which pro-
posed to run a water main from 140 to Oakland Street. The low bid was
Medieros Bros. of Dartmouth for $305,061.
MOTION: To award the contract for 80 -7 to Medieros- for $305,061.
Mahana /Levine VOTED: 3 -0.
Arthur Stockus explained the progress on the QRS contract and that they
have now gone past the date for the completion of the project and the
work is not done. He suggested that Town Counsel write a letter for the
Town saying that the Town assess liquidated damages in accordance with
the contract. They are assessing on the basis of $200. per calendar day.
In addition, Arthur Stockus referred to a letter from QRS stating that
the project was completed and he advised Town Counsel to write a letter
saying that it was not completed.

Arthur Stockus discussed the Prescott Wells. It was noted that the
electric motors had been installed but there was a question on the
wiring on the controls. They did not meet the specifications and Whitman
& Howard requested a letter from the manufacturer stating that the wire
would meet the specifications for wire to water efficiency.
They discussed the Mill Street Well and Arthur Stockus explained that the
test well program included additional wells adjacent to the Mill Street
well site and it was their feeling that by installing several smaller
wells, the efficiency of the well could be increased by 50 %. It was the
concensus of the Board to do a prolonged test on this site.
Discussion was held on the water quality study completed two years ago to
raise the Ph. Discussion was held on metaphos and the problem with meta -
phos is that it masks the problem of a low Ph. The Town Manager explained
that his concern was that Whitman & Howard bill was $5,000 and the actual
cost was $10,000. The Board discussed the extension of the water main
from Elm Street to Oak Street. SelectmamiMahana noted his concern with
the performance of Whitman & Howard and that the Board should look for
proposals from other engineering firms before the project is designed.
There being no further business, the meeting was adjourned.
Corrections: Selectman May asked about Prescott Well. Town Manager is
waiting for efficiency ratings on the wire to water efficiency.
Last Paragraph: Estimated $5,000 and Whitman & Howard is satisfied with
$5,000 payment. Water line extension will start at Oak Street run along
Elm Street to Williams Street.

BOARD OF SELECTMEN
MINUTES OF MEETING
May 19, 1982
PRESENT: Chairman McNair, Selectmen Mahana, Levine, Islay, Town Manager,
W. Chadwick Maurer, Jr. Selectman Colella arrived at 7:44 P.M.
7:30 P.M. Meeting called to order. Board of Health came before the
Selectmen to discuss a pay raise for the Health Agent. They feel that
their board should be able to spend money in their budget any way they
like. There was a question as to whether the Selectmen had any authority
over the Board of Health. The Selectmen felt that it was unreasonable
to raise the Health Agent's salary until July 1 then give him a cut in
pay. The Board of Health also wanted this raise retroactive from February.
Town Manager noted that the Board of Health has the responsibility to
adhere to the Selectmen's personnel policy. Selectman Mahana suggested
that they refer the matter to Tom Counsel. Selectman May felt that the
Board of Health was not acting in the best interest of the Town. Being
pressed for time, the Board of Health left the meeting with no decision
being made.
8:15 P.M. Senator David Locke came before the Board to let them know
that they are getting ready to debate the budget in the legislature.
He noted that Mansfield will be getting the same as last year plus $45,875.
He also spoke about the mandatory water district and mentioned that there
will be a meeting in Norton on June 2, 1982 to discuss this. Town Manager
will represent the Board. Senator Locke noted that the bill for the
control of the school budget has been redrafted. The property tax bill
is in ways and means. The senate will not be meeting until next Monday
and H.5877 is back to its original form, regarding state ethics commission
conflict of interest. He noted that the bill would become law immediately
if there is an emergency preamble. Selectman Mahana spoke about an article
in the paper about a bill excluding electric companies to draw interest on
money in deposit for emergencies.

8:44 P.M. Paul Folkman came before the Board to discuss the final legal
agreement on Fairfield Park /Park Court. He noted that it is acceptable
to all the parties involved up to this point.and proceeded to read through
the agreement with the Board. Easements will be included in this also
and the agreement will be recorded in the registry of deeds along with
the easements. Selectman May asked that the Selectmen be on the permit
for the traffic situation, as the complaints on it will come to them.
Paul Folkman noted that the EOCD has already complained to the Housing
Authority on the traffic. He reported on the past track records of
Bonwood and Mr. Paglia and mentioned that he has not had any problems
with them. Selectman Levine asked about the landscaping and if there
was a time limit on this. She also asked about a covenant. If it is
sold, the responsibilities will go to the new owners. Mr. Folkman noted
that there will be one agreement and two easements referencing the same
agreement. After this discussion, it was agreed to add the following:
Board of Selectmen to approve traffic changes, reference on change of
ownership, specifically if project is sold, time limit on landscaping
and resurfacing. Agreement will be recorded at the registry of deeds.
Board will vote on it after these changes have been made.
Mr. Folkman noted that he is working on two grants. One is the State
aid bikeway grant which is ready for the Board's approval. The bikeway
design is around commuter rail service and it will go down Old Colony
Way right -of -way to Norton. He needs a cover letter supporting the
project and someone to represent the program.
* MOTION: That the Board of Selectmen support the application for
a bikeway grant as outlined by the Planning Director and
that he be the focal point and notify the Town of Norton
that we endorse the plan and send to SRPEDD. Mahana /May
VOTED: 4 -0.
He showed the Board a plan of Old Colony Way and where the sidewalk would
be. There was a question as to why it was on the west side instead of the
east side. Mr. Folkman noted that there will be public hearings on this
and that he will be meeting with local businessmen to get their ideas on it.

will check on Otis Street, but would like Board's okay to do Hope Street,
MOTION: To go ahead with Hope Street work. May /Mahana VOTED: 4 -0.
Board Reports
Selectman Colella had no report. Selectman Mahana noted there were two
accidents on Oak Street, not on the police log. Guy wire on the pole is
swinging in the air. Regarding Whitman & Howard as consultants, he has
reservations about them. He is concerned that they act as both consultants
and engineers for the Town. Should do one or thezother, but not both.
He also noted that the Town Manager is spending too much time with Whitman
& Howard preparing them for the Board meetings. He does not like it and
this applys for CDM too. Town pays them a lot of money for consulting
work.
MOTION: That before we let out contract, rget bids from other firms
for extension of water on Elm Street, $1.1 million project,
both consulting and engineering, percentage of engineering.

Selectman Levine wanted to know what benefit it would have to the Town.
Selectman Mahana noted that they have been consultants for the Town for
33 years and he is not happy with Whitman & Howard's performance.
Town Manager clarified that the Board was interested in Elm Street for the
design of that system from Williams to Oak Streets and to ask for the
same type of things from Whitman & Howard. He noted that most towns have
one consultant for the water system and engineering. Selectman hiahana
would like total recap for the last 10 years on Whitman & Howard.
Selectman hiahana spoke about the salt storage shed. Selectman Levine
spoke to the tiunicipal Bldg. Committee.about it. They would like to get
specs and cost requirements from the State along with any permits needed.
They feel it is an inconvenience to have it there.
Selectman hiahana asked about the fire on the bulldozer and if they have
a fire extinguisher on it. Regarding the Police Chief's exam, no.one from
Mansfield passed. He is looking forward to open state exam.
* MOTION: To send a letter to the Director of Civil Service testing.
She will tell Board the results of the Statewide exam.
Mahana /May Withdrawn.
Selectman hiahana would like to see the Planning Director become more
involved in water and sewer projects with our consultants. Regarding
building permits granted if they do not know if they will have a well
or town water connection to the home. Building inspector has to enforce
the laws.
Selectman Levine asked if QRS was done yet. Town Manager replied that they
are not and that two letters have been sent to them. She noted that the
ZBA does not appear to be upholding the qualifications for variances. Would
like to have them come in next week at 8 P.M. She asked about the water
levels above the screens on the water reports. Town Manager will find out
when the water peaked off during the year and also low point from last year.
Selectman May noted that they should still encourage people to conserve.
Selectman May noted that he will not be here next week and wished Sandy
Levine luck during the next 10 days. School committee wants to close East
Street during graduation exercises. Town Manager will check on this.
Selectman May noted that he was concerned about the motorcycle. Last summer
the motorcycle had been in an accident. The report the Board received was
that it fell over in the parking lot. He was told recently that this was
not the case. It was in an accident on School Street.and he would like a
report as to why he was not told the truth. Board should not be subject
to this type of thing. Ferring was cracked when it fell over. He will not
name the officer who told him it hit a tree on School Street. If it was
not in an accident, he will name the source publicly.
