BOARD OF SELECTMEN
MINUTES OF MEETING
April 21, 1982
PRESENT: Selectmen McNair, Mahana, Levine, May, Town Manager W. Chadwick
Maurer, Jr. Selectman Colella arrived at 8 P.M.
7:30 P.M. Meeting called to order. Electric Light Director Hall and
Mrs. Lemieux were present to discuss the DPU Annual Report for the Town.
Mr. Hall noted that they were 1% over their alloted profit. Base rates
will not be raised again this year, but we will have more capital costs.
He also handed out a rate survey taken of each system in the area.
Mansfield is in a favorable position. The DPU report has to be signed
and delivered by April 30, 1982.
MOTION: To accept the report to be submitted to the DPU. Mahana/
Levine VOTED: 3 -0.
Mr. Hall also had an application for permit to extend power line to
Sturdy Medical Center down Rt. 140 (state property). This will give
the Town permission to extend the existing line from 140/106 along
Rt. 140 approx. 1,000'. Six poles will be replaced. Chairman McNair
signed the application.
7:45 PM. Fairfield Park /Park Court - Planning Director Folkman gave
the Board copies of two letters submitted by neighbors. He had prepared
a cover memo to discuss five points outlined in these letters. He noted
that they were here to have the Town Meeting vote enacted so that the
private developer can begin demolition of the Fairfield buildings. The
first item brought up was the density situation. He noted that originally
there were 143 units in the project, this has been lowered to 99 units,
which includes 42 Elderly and 57 Private. Housing Authority and Private
Developer are satisfied with this plan. Item 2 was on Parking. Mr.
Folkman noted that the parking was designed by Everett Associates & DiNisco
and that the design they have now is the best one. Parking requirements
for elderly units is .5 and for private portion, 1.5. This should be
adequate for elderly units. They did not develop any parking to the
north of Park Street. All parking will be between Park and East Streets.
8:00 P.M. Public Hearing - New England Telephone
Hearing is for pole extension on Essex Street. Two abutters have been
notified. No comments from public.
* MOTION: Poles to be extended on Essex Street per attached
letter from New England Telephone. May / Mahana
VOTED: 3 -0 Hearing closed at 8:03 P.M.
Fairfield Park /Park Court
It was asked where cars would park for function. Mrs. Colella noted that
some would park on Park Street. Housing Authority would properly enforce
parking regulations. Mr. Folkman noted that they have not worked it out
fully yet on parking. Item 3, drainage was discussed. Drainage ditch
will be enlarged to accomodate a 25 year storm. They followed CDM's
recommendation to install leaching basins that have overflow system.

There were suggestions to pipe drainage to Back Bay Brook, put up a chain
link fence if it is enlarged for safety purposes. Mr. Folkman mentioned
that a fence was never considered. He does not think the ditch would
impact any of the homes- along -it. If it did anything, it might help the
situation. Selectman Mahana asked if a lot of water would impact any of
the leaching fields in the area and come back to the homes. Mr. Folkman
did not know. He mentioned that the basins would have to be cleaned
periodically and that this would be part of the license agreement, which
is the next item. Mr. Folkman noted that he talked to Town Counsel and
prepared a draft of an easement to Housing Authority and to Bonwood Corp.
That would separate the parking areas. The license agreement will be a
legal agreement for various items i.e. snow plowing, lights, liability,
maintenance, etc. Everything will be included in the license agreement.
He will come back with two weeks with this. Mrs. Colella mentioned that
the State has no objections to the Housing Authority maintaining parking
area. Last item discussed was Traffic Circulation, number of cars and
number of people in the area. There is a one way traffic flow design.
Some concerns are rush hour traffic, school. traffic. Mr. Folkman noted
that parking design can be modified if one way does not work out. He
and Police Chief Earls -have reviewed the design and no parking spaces
would be lost if the design was changed. Pahking will run along property
line and 5' parking setback is proposed. There will be a chain link
fence with landscaping. The neighbors will be able to discuss landscaping
when the developer comes in for approval.of the site plan. The deed has
been approved by Town Counsel for Board's vote to enact town meeting vote.
MOTION: To accept deed and sign it. Levine /May VOTED: 4 -0.
Board commended Paul Folkman and Joanne Colella for their work and response
to neighbors problems. Red Button thanked Paul for his help but noted that
he is afraid that the elderly will be pushed out. Mrs. Colella noted that
additional parking north of Park Street would have to be approved by the
State and it would be funded by the State. He asked how zoning by -laws
could be changed to prevent such density problems in the future. Mr.
Folkman replied that a petition to the Planning Board by 10 people with
an article on the changes in the by laws would be necessary. Wendy Kay
is concerned about adding on extra drainage on North Main Street and if
that extra load would impact the drainage ditch. It should not have a
great effect on the ditch. She was also concerned about the lack of a
buffer zone. Home Owners Association and Housing Authority will be responsible
for plowing, etc. Mr. Bachman noted that the railroad right -of -way is lower
than the other part of the ditch and that his property is 30" lower than the
railroad bed. He feels they will be creating a problem for the Town, safety
hazard and health problem.
Mr. Folkman and Mr. Seifert, Downtown Advisory Committee spoke about the
( DAC's reception next Monday evening to present letters of commendation to
downtown businessmen and discuss block grant issues for downtown businesses.
Selectman Mahana noted that GATRA should endorse the parking portion of the
program.

Whitman & Howard Contracts
Present from Whitman & Howard were Arthur Stockus, Ed Kent, Jay Bridges to
discuss various projects in Town. Watershed Management & Well Testing was
the first item discussed. Well testing has been done in West and East
Mansfield and additional testing will be done soon. Mr. Kent handed out
copies of preliminary report on groundwater resources study of the Town.
Mr. Kent had seven maps to present to the Board. They included location
of present well sites, water tables, type of soil, saturated thickness,
and water quality hazards. After Mr. Kent's presentation, he recommended
that the Town proceed with by -laws for aquifer protection plan. Selectman
Mahana asked about a county water district and if other local towns were
involved in the same process as Mansfield. He suggested taking it under
consideration. We should meet with other towns that share the same aquifers.
Jay Bridges next showed the Board where they have been testing for potential
well sites. It was asked what the procedure was for testing wells. They
have to go through the Town to get permission to test an area. It usually
takes five to ten days to determine if a site is good. Selectman Mahana
noted that there should be an agreement on the purchase price of any site
for water. It was mentioned that there is one site across from other wells
near Wading River and we should follow Norman's recommendation on this one.
This may be an alternative to the Ash property. Mr. Stockus spoke about the
Farmers Home project and passed out a summary of contracts for FHA. Willow,
Fruit and Short Street projects have overrun due to line item changes in
the contract. Location of water mains was a problem also. He noted that
they received a request from a contractor to change two culverts on Willow
Street. One is to be lowered to divert stream in Cabot Pond. There will
be no cost to the Town to do this work. This will have to go back to the
Conservation Commission for approval
MOTION: To approve revised lowering of culvert 1 - 2' as proposed by
Allen Willis subject to no cost and his letter, and, also to
move second culvert 8 - 10 ". Mahana /May VOTED: 4 -0.
Selectman May asked about Oakland Street project. There is not enough
money in the budget to do the whole project, but Whitman & Howard will
scale down the work. They will be applying for grants to improve the
system.

Town Manager's Report
Leo Fletcher met with Joan Cutillo on computer needs for her department.
He will be getting back to the Town Manager. Regarding inventory of
surplus equipment, Red Button will supply this to the Town Manager.
Town Manager noted that a meeting was held with Hercules Powder repre-
sentatives. They want to see more hard data to prove that they have to
clean it up. At present we are waiting for results of test. Hercules
will be sending additional information to us on the wells.
Mass Cablevision is interested in leasing one room at Spaulding School
downstairs. Town Manager wanted to know if he should proceed with
lease agreement. Selectman Mahana felt that he should go forward on it
and possibly move some Town departments down there. Selectman May noted
that he spoke to Mo Prasad on the school. He would like to be notified
when Town Manager sets up meeting. They are also looking for a place to
put the microwave dish and prefer Maple Park. It might be put on the
water tower.
Board Reports
Selectman Mahana asked to take Town Manager's evaluation under consideration
at this time.
Selectman May would like to start reviewing Town Counsel applications soon.
Selectman Levine will bring them back in this week.
Selectman Levine asked for an update on Town Accountant McAlice. Flowers
will be sent to family. She had a request for the Police Department.
Would like information on disturbances at DJ's Pub for one year and what
kind of disturbances they were. She would like an up to date listing of
all liquor licenses handed out and how many are .left in each category.
Selectman Levine then read a statement she had prepared on Town Manager's
evaluation. She felt there was a lack of positive points in the review
process and did not see constructiveness based on street talk. She would
like to know what the Board plans on doing to resolve this problem.
Selectman Mahana noted that the evaluation report is a copy of another
report and only measures whether the person meets standards, is above or
below. Chairman McNair noted that he was willing to postpone evaluation
but that the Town Manager wished to go on with it. He also noted that
he attended Mazda's open house, Leon Lombardi would like to come in to
see the Board soon. A new person, Pat Gannon has started work in the
Accounting office. She will be taking Nina Collingwood's place.
