After a short discussion, it was agreed by the Board that the committee should stay in existance with direction from the Board of Health. * MOTION: The Hazardous Waste Task Force is to continue in their present capacity with the Board of Health for an indefinite period. Mahana /May VOTED: 4 -0. 7:45 P.M. Camp Dresser & McKee - Progress Report Jim Glendye reported that the contractor has continued on the site layout. They have also submitted their fourth payment request. He presented the Board with pictures of March's progress on the site. Selectman Mahana asked how much water would be used at the plant and if they could use another source besides Norton's water. The plant will use approx. 10,000 GPD on initial operation up to 12,500 GPD when in full operation. It was also asked if a well could be put on the site for the plant. Bill Mackey will get information on the cost of wells and give to Town Manager. He noted that the water is also used for fire protection for the plant. Mr. Glendye also handed out copies of the construction schedule for the plant. There was some discussion on the equipment guarantees and when they would be effective. Contractor gives a one year guarantee on equip- ment. CDM will also be getting figures on the cost for them to operate the plant. CDM discussed the letter from Passavant requesting advance payments of 5% for the equipment being built. Paul Marchessault noted that he called EPA in Boston to check on this, and no one can recall payments being made in advance before. He noted that there have been requests before, but non have been approved, as the company knows when they are bidding on the project what is written in the specs and what they bid on. * MOTION: To deny the progress payments requested from Passavant Corp. May /Levine VOTED: 4 -0. Bill Mackey noted that the bid opening on Cont 1982 at 2:00 P.M. They are expecting good bid if the bids could be split up for parts of the line. Old Colony Diner Arcade License Public Hearing Atty. John Michelmore was present with Robert Graziewicz, prop. of Old Colony Diner for his application for 25 video games at Old Colony Diner. Letter from Police Chief was read explaining that a detail officer should be present on the premises, hours of operation, that license is subject to change in by- laws.and that officers of corporation should be supplied. Letter was also read from Francis Baldini who is opposed to the arcade license. Mr. Graziewicz is planning to use the new section of the diner for the games. It will be sound insulated and will have an access ramp for handicapped. His hours are 9 AM to 11 P.M. Monday - Friday,,,/ 11 AM to 11 PM Saturday, and 11 AM to 10 P.M. on Sunday. Adult supervision will be present at all times with no smoking, drinking or eating on the premises. He noted that the diner will be his primary business and is willing to surrender liquor license if arcade license is granted. It was asked why he was making the change and Mr. Graziewicz noted that he felt it would be a better use of the addition. He would like to see revenue stay in the Town and people in town would have an arcade instead of going out of town to play the games. There was a question on the permit for the building and if another permit would have to be obtained as the use of the building is being changed. It was asked if there would be access from the diner to the addition. His reply was that there would not be a door. Selectman Mahana noted that two entrances are required to the building. It was asked what type of traffic problems would be there. Mr. Graziewicz noted that a bike rack will be between the new addition and Sterling Mfg. Selectman Mahana noted that a liquor license was granted for a service bar with good intent. He feels that it is unfair to subject young adults to liquor. Mr. Grazewicz noted that he does not want both licenses. He wants the arcade license. Selectman Colella noted that he will have to give up the liquor license before issuing the arcade license. There are no guarantees that the place will be quiet. Mr. Grazewicz noted that these will be token machines and that he is trying to work within the Board's ideas and regulations. Charles Gilman from Mystic Automatic Amusement Sales noted that lots of older people play the games. If it is properly supervised it would work. Arlene McIntosh and Tom Laresella asked what the Board's main problem was with the arcade. Selectman Mahana replied that some areas are not properly zoned for the business and a properly zoned area is an industrial zone. Mr. Michelmore noted that the diner will stay as the primary business. It was asked where the money would come from to complete the addition and get the video games. Mystic Sales will lend money to Mr. Grazewicz to finish off the building. This will be a loan to the company, they are not officers of the corporation. MOTION: To table it. Colella /No Second MOTION: To deny the license as it is not in the public interest. Mahana /Levine VOTED: 3 -1 Colella opposed. Selectman Levine mentioned to Mr. Grazewicz that he should come in with more detailed plans. She did not see anything concrete that would set his arcade apart from others. BOARD OF SELECTMEN MINUTES OF MEETING April 14, 1982 Page 3 Community Development Block Grant Program Planning Director Folkman was present to discuss the Block Grant Program and noted that Mansfield will be going for a multi - purpose grant of $1.4 million for two years. The deadline to submit the grant application is May 3, 1982 and it will need Board's approval. Mrs. Margot Jellinek would like to see a new salt storage shed in the program. Drainage for streets, sidewalks, etc. are included in the program. Selectman Levine would like to have Villa /N. Main Street drainage included along with handicapped access. Selectman Mahana noted that COMPARK has improvements for three parking lots to be included in the program. Water Supervisor noted that water mains and services should be done in the program. Library Trustees would like to be considered in the program. Council On Aging would also like to be included in the grant. Mr. Folkman noted that this will be a two part program. He explained the process of how applications are submitted and mentioned that there is no guarantee that the Town will get $700,000 for two years. Selectman May asked about the three persons that would be needed for the grant and if the Town would have to take them over when the grant expired. Mr. Folkman noted that when the grant expires the three person staff can be let go. He will get information for him on the Down- town Manager. Selectman Mahana asked if a group applied for this grant, could they apply for another program. Mrs. Colella noted that public parking would not be included as part of the block grant. P. Folkman /J. Colella - Fairfield Park Paul Folkman and Joanne Colella were present to discuss the transfer of deed for Fairfield Optical property to the Housing Authority. Housing Authority is requesting Board of Selectmen to implement Article 2 of the Special Town Meeting that was held in 1981 which authorized the Selectmen to transfer the Fairfield property to the Housing Authority. Housing Authority will then transfer it to the private developer. It was asked if all concerns had been addressed in the hearings. Mr. Folkman mentioned that not everyone was satisfied with it but that all items were taken under consideration. One major problem is with the drainage off site. Red Button noted that drainage was not the only problem. Parking, density on the site, number of units at the site and lack of green space are problems along with the drainage situation. Snow removal will also be a problem which is the responsibility of the Housing Authority and Bonwood. James Bachman brought up the density problem and elderly living there with no green space, etc. Mrs. Colella noted that a feasibility study was conducted which indicated that elderly persons preferred to be located in a downtown area. As for drainage, Bonwood will be responsible for theirs and Housing Authority will be responsible for elderly project. They have a two year time frame and hope to break ground in August. Grace Genatossio noted that CDM did not design the drainage system, it was given to them to look over and make recommendations on it. Mr. Lester McGoldrick felt that overall, a good job was done but he is not satisfied with the drainage and wanted to know what happens when it hits the East Street ditch. BOARD OF SELECTMEN MINUTES OF MEETING April 14, 1982 Page 4 He did not know if the ditch was going to be left open, pipe put in and buried, etc. and wanted to know who would pay for maintenance on the ditch. Town would have maintenance responsibility and it will be left open. He felt that this would be a safety hazard and wants it covered. Town Manager noted that the vote by the Board tonight is only to give permission to draw Up the deed to transfer the property. * MOTION: That the Tom authorize Tom Manager and Town Counsel to draw up the deed to convey Fairfield Property to the Housing Authority per vote of Article 2 at Special Town Meeting, 1981. May /Colella VOTED: 4 -0. Selectmen requested that these problems be addressed again to try to resolve some of the neighbors' problems. BOARD OF SELECTMEN MINUTES OF MEETING April 14, 1982 Page 6 The Light Commissioners at their 1/12/82 meeting discussed power to Study Medical Center. It was the concensus of the Board to pay for 2 of the cost of installation of the power line to CC &F and the Medical Center provided CC &F built the sleeve under Rt. 140 to provide power to the westerly side of 140. CC &F says that this is not practical at this time and have agreed to pay 100% of the cost of service on the west side if the Town pays 50% of Cost of service along Copeland Drive. This is consistent with the concensus of the Board on 1/12/82. A formal vote confirming this is required. * MOTION: To pay 50% of cost for the power to CC &F and Medical Center and obtain permit from the State to place lights. May /Mahana VOTED: 4 -0. When he makes a formal request, Whitman & Howard will review it and make a recommendation. Traffic counters will be put out next week on West and Tremont Streets. Town Manager was notified by MDPW of change in design and we will have to get easements from Western Union and Borden. Paul Dalton of CC &F is having plans drawn up and will contact two companies to obtain easements. Construction cannot proceed until we get easements. Selectman May asked if there could be -a 5 day setting period instead of 30 day requirement for concrete footings. Regarding 106 /N. Main, Paul Folkman is contacting engineering firms for proposals for phases of downtown traffic plan. Selectman Levine left the meeting at 11:30 P.M. Board Reports Selectman Colella had no report. Selectman May asked if water main charge on School St. was because of QRS. Town Manager mentioned that some may have been but was not positive. Regarding DPW Director /Town Engineer, he noted that someone had offered to perform engineer's services to the Town atno charge and wanted to know why we did not pursue it. Town Manager mentioned that the person did not have a civil engineering degree and was unaware of free of charge offer to the Town. * Selectman Mahana had a list of street lights to be put on. Approved. Mahana /May VOTED: 3 -0. Pole 7, Otis St., Pole 31, Gilbert St., 28 School St., 15 Gale Lane, 339 Pratt St., 307 Hope St., 11 Williams St. * Selectman McNair also had three more lights to be put on. Approved. Mahana /May VOTED: 3 -0. 121 Stearns Ave., 644 S. Main St., and new light on Gilbert between West and Bungay Road. BOARD OF SELECTMEN MINUTES OF MEETING April 14, 1982 Page 7 Selectman Mahana would still like copy of blood test report on level of alcohol in two fatalities. He would also like to have the Town establish the ownership of the gravel on the Webb property near the WWTP. Town Manager will check on it. He felt that Town Manager's evaluation should be discussed soon. He would also like Town's obligation to Seabrook II and the tipping fee for Plainville, what it would cost the Town. Selectman McNair asked why Police were driving Town snowplows during the storm. Town Manager mentioned that they drove them to pick up sand as Highway Dept. was short of help at the time. He mentioned that he has seen vouchers without invoices on the warrants and noted that he would like to see receipts. * MOTION: That no payment be made until invoice is attached. Mahana/ May VOTED: 3 -0. Regarding interim DPW Supervisor, he would like to see a complete inven- tory taken at the highway dept. Selectman May noted that government surplus equipment should also be inventoried. It was decided to go forward with Town Manager's evaluation response. Town Manager noted that he was concerned with less than favorable review and has two primary areas to correct, communication with Board and personnel administration. He noted that performance was negative with no positive directions to go forward in. He overviewed what has been accomplished in Town over the past year and requested that individual comments and his responses to them not be public, but that he would speak to individual members and comments would be placed in his personnel folder. Selectman Mahana was upset with this so, the evaluation went forward with personal comments by Board members and Town Manager's re- sponses. Selectman Mahana started discussion with his comments. Basic complaints were: handling of Police Chief exam, not being informed of increases in cost of WWTP, handling of plowing for snow storms, private contractors, his request to see amount of water pumped vs. water billed, and Town Manager's response time to Board requests. Town Manager responded to Selectman Mahana's comments and noted that many of these problems had been corrected and /or corrective action was being taken to prevent similar problems in the future. He noted that he was misinformed on Chief's exam, increases were discussed with CDM on WWTP, problems during snow storms were corrected and a detailed study of water pumped and billed took a long period of time to complete to show a trend. Selectman Mahana brought up the 22% increase in the budget for water rates. Town Manager noted that the rate increase was not in the original budget. Selectman May had two instances where Town Manager was untruthful to him. He spoke about a letter on the plowing involving a hit and run with the plow. The other was an easement on Willow;Street granted by the Town for a sum of money. He finds this difficult to accept and has difficulty believing what the (, Town Manager tells him. Town Manager noted that as Planning Director, easements were negotiated by him and never went back to the Board. Selectman May noted that as part of the deal on the easement, he heard that the owner's driveway was to be paved. He hopes that this will not happen. BOARD OF SELECTMEN MINUTES OF MEETING April 14, 1982 Page 8 Town Manager also noted that regarding person's services to Town free of charge as Engineer, he was unaware that this person offered services for free. Selectman Mahana was upset that Town Manager showed salary chart to Department Heads without Board's approval. Town Manager mentioned that the table was the same one that was presented to the Board in November. He told them about the scale and advised that this was not the final chart and Board still had to approve it. Selectman Mahana felt this was poor judgment on his part. Selectman Colella was upset about the appointment of Town Clerk. This was not discussed with him and felt that it was cut and dry. He also brought up a problem Town Manager had with a department head and has not seen any improvement in.this area either. Regarding snow plowing, the grader is still broken and could not be used in the last storm. The wing plow is not on the grader yet. He also noted that we ran out of salt and sand and felt that Town Manager should have been on top of the situation. He noted that he did not know about the temporary acting highway supervisor until the other day and he still did not know who it was. He did not know about the Willow Street easement. Feels there is a lack of communication in the Town Hall. Town Manager noted that on his report to him, it did not have any written comments on it. He felt that this was unfair to him as he asked him to comment and he would not. Selectman McNair felt there was lack of communication. Feels Town Manager is running a one man show. He has to delegate more responsi- bility to department heads. He also brought up Jim Hall and Tom Bonome incidents which Town Manager had already talked to him about. Selectman McNair felt that Town Manager, if he cannot agree to correct these problems then other action would have to be taken. Town Manager noted that he would like to continue on and did not agree with the evaluation as overall it has not warranted the low evaluation. There have been major accomplishments in the Town within the past year. Selectman May did not know what to do yet for corrective action, Selectman Mahana noted that in the past and future Town Manager will be making decisions for the Town. The only appointment Town Manager recently made and informed the Board on was the Sealer of Weights & Measures. He feels that Town Manager should give the members of the Board the consideration of letting the Board know before he does something. There being no further business, meeting was closed and Board went into Executive Session to discuss grievances and possible litigation. * MOTION: To go into executive session and will not return into open session. May /Colella VOTED: 4 -0. Press and Board's secretary left meeting at 1:26 A.M.
