Mahana /May VOTED: 4 -0. 8:00 P.M. Bradford Johnson Mr. Johnson brought the Board up to date on the Victory Realty vs. Town case which started back in 1978 re: town taking unknown parcels by eminent domain. This came to trial in 1981 and the town won a summary judgment. He also mentioned that the taking was not valid for the Town as the order of taking was filed a day late. There is also another suit where the defendent is asking for an assessment of damages as they cannot enjoy the use of the land. This will be on trial in the fall session. This case does effect the Town's takings as now the town does not have any claim to the land they took by eminent domain. He suggested the Town Planner look up takings and make amendments to the conservation commisssion's accounts. One taking was 6/25/74 of 100 acres. Another parcel was 30 -40 acres near Hodges Brook. He suggested that if the Town does this in the future, they should have a good set of guidelines to follow. Selectman Mahana was interested in the guidelines as this could relate to other parcels in question. 8:15 Ed Ammidown - Jaycee's Mr. Ammidown came before the Board to request permission to use some of the Town trucks for Jaycee's clean up day on April 17, 1982. Town Manager advised that three would be available for their use. Mr. Ammidown noted that they do have Army trucks available for that day, but would still need DPW trucks. Town Manager noted that DPW will be grading railroad parking lots on that day also. He also mentioned that trash pickup will also be on that day. Mr. Ammidown did not feel that this would be a problem as they have worked with Oliveira before. A hold harmless agreement would have to be drawn up. Mr. Ammidown also asked if someone could be at the landfill on Sunday to finish up. Town Manager will check on this. MOTION: To approve the use of three DPW trucks for the Jaycee's on April 17, 1982. Colella /May VOTED: 4 -0. BOARD OF SELECTMEN MINUTES OF MEETING April 7, 1982 Page 3 Selectman Mahana asked Mr. Ammidown if it might be possible for one of the Jaycee's to pick up the papers at Bicentennial Court for the recycling center, if they have a truck available. Board members suggested speaking to Joanne Colella, too. Rod Stearns was present, but did not have any comments on the Airport insurance problem. Town Manager noted that he needed a vote of the Board to borrow $500,000 for the wastewater treatment plant bonds. Approved. Mahana /May VOTED: 4 -0. Town Manager informed Board that he was notified by Bruce Wood last week on Garden Street. He has withdrawn his deposit check from the Town Treasurer on Garden Street-because of no clear title to the piece of property. Town Counsel mentioned that he did not agree with Paul Lorincz's opinion. Selectman Mahana noted that he would like to get this piece of land off the books as it is of no value to the Town. Town has abandoned it as a street. Town Counsel noted that paper streets that are recorded are half ownership to the middle of the street. If it was not recorded, they still own it. Cost of a title search would be about $750. Selectman Mahana would like to know who has rightful ownership to the land and does not think the Town should suffer because of this. MOTION: To direct Town Counsel to search title and find true owners and get it off the books. Mahana /May VOTED: 4 -0. Selectman May asked if the Benson's do own it, what would happen with back taxes. Town Counsel did not know if the Town could tax it as it is a street. Selectman McNair expressed his concern about the parties involved and would like to see it resolved. Town Manager reported that a cruiser lost its transmission yesterday, and regarding snow plowing, they have a limited amount of salt and sand to do the roads. Selectman May would like to see 140/106 plowed first. Board Reports Selectman May asked about QRS water main construction on School Street. Town Manager reported that lab tests were approved by State and Oliviera Labs as they met requirements. He talked to Whitman & Howard about certifying the pipe. There is a bill that has been certified by FHA to be paid but he did not include it on the warrant. Water samples still do not meet with Whitman & Howard specifications. Selectman May asked about cars that were towed on Thomas Street. Town Manager reported that only one car was affected by it and town will pay for this car only. BOARD OF SELECTMEN MINUTES OF MEETING ( April 7, 1982 Page 5 Selectman May noted that Board should review Town Counsel applications and determine who they will interview. Selectman Mahana asked if John Flood had put in an application and if he has, he will not consider it as he just resigned as Town Counsel for Avon because he does not have enough time.for the position. Selectman May noted that he had a request from a resident of Franklin Street for a listing of speed limit signs on Franklin Street, as he got a t•i.cket and it is not posted for speed limits. * MOTION: To have Town Manager prepare a letter stating where speed limit signs are on Franklin Street.
