Chadwick Maurer, Jr. Board Secrgtd' , 11,0X INSETTS Discussion began on litigation of William Sarro. The situation is that the Town Manager talked to the two people in the Dept. and both say that he did help them move the truck body. The problem is that it was the same time as the injury in January, according to one. The other says it happened in September of 1981. Town Manager will have to get Bill Sarro in the office and is still working on it. He told the retirement board to hold up on his case. The next item discussed was Earl Weeman who claimed an on the job injury. Bristol County Retirement Board has voted against his claim. They did a medical history on his condition in his back. He cannot continue to work as a police officer. Earl has appealed his claim and this could take two years. Town is still paying him. Bristol County would give him disability retirement of 50 %, non -job related, but he wants 72% from Dept. They will have to go through Civil Service on this. It was decided to turn him down on vacation pay from last year. Paul Kenney suggested splitting retirement percentage or notify him of his dismissal because of his job performance. It was decided to talk to Earl on percentage of disability and we will give him a cash settlement on vacation part of it. Town Manager will continue on this also. The last item discussed was the police chief's examination. Various Board members heard tha t the Town Manager was trying to slow up civil service process so that no orw would apply and Jesse Earls would be chief. Town Manager said that this was not true. He asked about the problems in the Department. Jesse showed more promise when he first started. He had the opportunity and did not make it so we have to go on from here. Someone found out who the names were on the list and told them not to come to Mansfield. Civil Service list had 3 names on it. Two people did not come in and sign the list. Will contact them soon. The one person who came in was very good. Has 13 years on Newton P.D. but will cost a lot more to pay a qualified person in the Dept. There is $26,000 in the budget. One per- son will haveto go from the Department plus Earl Weeman. Jesse's contract expires on the 28th. Town Treasurer had letter on the police dept. If no one accepts the job there is another exam in February. Another question was who would become the officer in charge until the next exam. The next exam would have to be an open exam. Board would like to know if they could eliminate Police & Fire Chiefs from Civil Service. It was also asked if they could get someone from out of town to be acting chief. Will have to check with Civil Service. The person who came in will be going to FBI academy for 3 months. There being no further business, meeting was adjourned at 11:25 P.M. May /Levine VOTED: 4 -0. Chadwick Maurer, Jr. and Board Secretary. Paul Folkman was also present. Town Manager noted that they are trying to narrow down the parcel to just the Bogdanchik property on what pieces of property they will need for a well site. Will be able to buy it from just Mr. Bogdanchik. Regarding a roadway for second well, might need permission from other owners. Estimated value of land is $46,000. Mr. Bogdanchik is looking for the town to con- struct road for a subdivision that would service four lots in the back. He wants the town to build a roadway for three lots. It would be a 500' road, which costs about $100 /ft. He would like this to be given to him. Town Manager gave him assessed numbers of $46,000. He has asked Ralph Maloon to look at roadway cost in that area. Would have to have plans prepared. Mr. Bogdanchik came out with a $2 million figure. Town Manager got figures on comparable properties. An estimate he got was $125,000 total. Mr. Bogdanchik would get $75,000 for the lots for a $200,000 deal. A formula he is using is to determine a fair value for the land and road and deduct a portion of it. He noted that they have $80,000 for Ash property plus grant money. He noted that there is 25, plus 15 acres including Berenson property. He wants it done before testing. It's estimated at 1 MGD for two wells. Board agreed $200,000 sounds good. Chadwick Maurer, Jr. Paul Kenney, Board Secretary MOTION: To go into executive regard to collective Parsons /Dunn VOTED: session to discuss strategy with bargaining and /or negotiations. 4 -0. Town Manager there were two items to be discussed. The first is an arbitration case with Earl Weeman and the second is to consider a proposal with the Fire Department to open their contract. With regard to Earl Weeman, he had a job related injury on May 7, 1981. He went to the retirement board who found that his injury was not job related. He also went to three doctors, two said it was a job related injury and one said it was not. He gets full pay for a job related injury. He also filed for his vacation pay which was denied and he appealed it. Paul Kenney recommended that the Board not go forward with the arbitration and that they pay his vacation pay. The arbitration is scheduled for January 6, 1983. Mr. IPeeman is currently being paid full salary and if he retires he will get 72% of salary. Mr. Kenney recommended dropping arbitration because they have not incurred any additional expenses yet and they will have legal fees for it, when he will probably get the four weeks vacation pay anyway. When Mr. Weeman leaves, he will get four weeks vacation from last year plus four from this year. MOTION: To drop arbitration with Earl Weeman. Wills /Dunn VOTED: 3 -0. With regard to Fire Department negotiations, the Department would like to change pattern of shifts to work two 24 hour shifts in one week. They would go torwork on Monday at 8 AM and work until Tuesday at 8 AM. This would be continual work shift as opposed to the way they work it now. Fire Chief Leonard also noted that it would cut down sick leave. He did an analysis and 25% of all firemen work shifts greater than 10 or 14 hours. He figured it would save the town about $4500 per year, and fatigue would not be any greater on a 24 hour shift. There was a question on whether the Board should open the contract now as other unions might want the same privilege. Town Manager noted that they did not have to make a decision tonight. Their present contract expires June 30, 1983. Mr. Kenney had some reservations on the change but noted that they could try it and institute it from January 7 onward and if it does not work they will change it back to the old way. They could do it on a 6 month trial basis. It was asked if overtime would change. They will still have overtime situations, but it should not be as much. Board agreed that they should negotiate it, but with a clause that they could stop it if it doesn't work. Consensus of Board was to proceed with negotiations. MOTION: To come out of executive session and into open session. Parsons /Wills VOTED: 4 -0. MINUTES APPROVED: a/ Clerk Date signed
