Winthrop Street from a plot of land on Chauncy Street. The Town Counsel was
present and advised that possibly there might already be a so- called implied
easement, but thought the lawyer for the buyer should decide the proper pro-
cedure to be followed regarding proper legal forms. Selectman Kellam stated
that Mr. Chavaree should bring in a formal request, and that the Board should
not act on an oral request, and Mr. Chavaree agreed to do this.
George Kett and Joseph Hinchey, members of the School Building Committee, met
with the Board regarding the new High School. Chairman Woodlock spoke about
the Award made by the American Arbitration Association whereby the Town is
to pay Westcott Construction Corporation the sum of $2,922.15 and administra-
tive fees and remuneration for the Arbitrator in the amount of $250.00.
The arbitration proceedings were a result of a dispute between the electrical
subcontractor and Westcott Company due to a claim that specifications were not
clear. The Board felt this should not have gone to arbitration, and that the
Town Counsel should have been advised. The Board was advised that the School
Building Committee had been advised that there will be no bill submitted to
the Committee for that particular bill. The Towu Counsel stated that it was
6/18/69
an Order given to the Town to pay Westcott Construction, and he was expecting
the money from the Town. He had talked to Mr. Westcott's lawyer, and he had

the Board so that they would know what problems were to be discussed, at their
meetings,
Mr. Kett stated that the Committee would welcome the Board at their meetings and
it might do some good to have them talk to the architect and the contractor.
Also it was agreed that the Board will make a tour of the new building, the
time to be arranged. When questioned regarding the architect, Mr. Kett advised
that the architect had spent a great deal of time personally with the Committee,
and had brought capable people to help solve problems, and the Committee had
a great deal of service from him'. He thought the quality of this building
will be satisfactory to everyone because of his sticking to the job throughout
the job. He has done a good job and not been given credit for it, Mr. Kett
advised that the amount of the contingency fund originally was $53,000, and
there is still $35,000, in the fund, Mr. Hinchey also spoke regarding the
architect and agreed with Mr. Kett that we should end up with a fine school,
and a lot of effort had been put into it by the architect,
The Town Counsel brought up the subject of charging people for the costs of
advertising petitions and thought they should be charged when the petition is
submitted. A discussion took place regarding a fee to be charged, and .Selectman

his resignation because of the anonymous telephone calls, and people coming into
the dump and giving him a hard time. He said that he is doing a fine job,
knows equipment, and is repairing a bulldozer which he intended to use at the
dump to improve conditions, He also advised that he would make a good man when
the town has a land fill program, The Town Manager told the Board that he had
not accepted his resignation, and hoped that he could convince him to remain on
the job, and requested the Board's support in the matter. After a discussion,
upon a motion by Selectman Kellam, seconded by Selectman Saunders it was voted
