Attorney regarding Cabot, Cabot and Forbes land, Attorney White before
the Board regarding the land voted at Town Meeting to be sold to Cabot, Cabot
and Forbes. In checking, it has been discovered that there is small section
on this plan that abuts the land of Cabot, Cabot and Forbes, and is known
as an ancient way. The town has the right to this land. C,C, &F, wants to
acquire the right to this property. Because of the Town Meeting vote,
which does not include this ancient way in the description, a good title
could not be given to C.C. & F,Attorney White suggested that this property
be placed at public auction which the town may do under the tax title pro-
cedure with the expectation that C,C,& F. would buy this land at $5,000,
an acre. An ad should be put in the paper or posted 14 days prior to
holding the auction. Selectmen are authorized to do this following the
five steps as outlined by the Town Counsel, i.e.;
A description of the ancient way; approval of the Finance Committee
in writing; notice of sale is posted in a public place fourteen days prior
to the sale; said property was taken by the Town Treasurer for the Town for
failure to pay taxes, and the Board of Selectmen reserves the right to re-
ject any bids which it deems inadequate or not in the best interests of the
Town,
