Selectman Clemmey brought up the sewer assessments on the ABC streets and the
Hillside Terrace area advising that neither one of these assessments were done
correctly, and it has come to light to a few of the people that they are in
a position not to have to pay them. Therefore in faiiness to them all Select-
man Clemmey moved that all assessments in both of these areas be fully abated;
namely, Aspen, Beech, Chestnut and Smiley Avenue, and Hillside Terrace, Robin -
hill Road, Brook and Cottage Streets, subject to approval by the Town Counsel.
The motion was seconded by Selectman Conroy.
Selectman Lecher was opposed to the motion. He cited the fact that there are
Rules and Regulations that the abuttors should pay 50% of the cost. Not fair
to people in other parts of town where there is no sewer, and they have to
pay for the cost of the sewer installation and get no benefit from it. People
should pay what everyone else has paid. Some have paid, and some think it
is a reasonable assessment. Selectman Main stated that the Board has had
people in and talked to them, thought abatement should be made as to each in-
dividual case, and thought it was wrong to abate the whole assessments for
each area. There was a discussion regarding the proper procedure to follow
regarding assessing for sewer betterments, and the Chairman advised that the
Town Counsel had drafted new regulations regarding sewer assessments for the
Board to check over. The Board agreed to wait for a decision from the Town
Counsel regarding the Motion made by Selectman Clemmey.
Arthur Terenzi, Chilson Avenue, before the Board regarding the Back Bay Brook.
He complained regarding the water coming down from the Chocolate Factory, 'and
the bad odor in his back yard. The Chairman advised that there was a serious
problem too regarding the sewer plant, and last week the Town Manager, repre-
sentatives from Camp, Dresser and McKee and Selectman Clemmey met with the
Chocolate Company officials, and it was the first meeting that we had with
our sanitary engineers with us, and they had their engineers and were told
they must correct what the town finds intolerable. Think that action regard-
ing the problem is on the way. Mr. Terenzi was advised to put his complaint
in writing since the town is negotiating with the Chocolate Company now and
any new evidence will help the town's case.
The Town Counsel checked the General Laws and State Statutes and questioned
whether or not the Board has the authority of decision to declare the intent
of the assessments unlawful, and abate all of the assessments. This would be
up to the Court to decide whether or not the assessments were legal or not.
It could be the Boardfs judment to abate unfair assessments on.the basis that
it was unlawful, or unfair. After further discussion Selectman Clemmey with-
drew his motion. The Board agreed to set up a meeting night and go over each
and every abatement request, suggested time 9 :00 P.M. next Wednesday in execu-
tive session.

Departments, and he would like to see a report from the Highway Department,

are in for a very pleasant surprise, The Town Manager is doing a fine job,
