Should be charged against sewer. The Town Manager advised that you have to have a layout of West Street to make the final design for [Vest Street. The Chairman thought this should be charged to the appropriation of two or three years ago for Gilbert and West Street. The Rules must be approved by the Massachusetts Aeronautics Commission, and then posted by the Town Clerk as a By -Law is posted after approval by the Attorney General. When the lease with Carleton Whitney Aero Service, Inc. expires, in 1978, it would be advisable to incorporate these Rules into any future lease written. Notice received from the Southeastern Regional Planning and Eonomic Development Commission advising of the town's share of the operational costs for this year ' based on population figures of 9,939 at 151 per person which would be $1,490.85. The Clerk read five decisions of the Board of Appeals: Amendments to decisions for Carol Ann Realty, Fireside Realty and Ronald J. Forrester, and two decisions granting permission to Sarro's Market and Mansfield Feed and Farm Supply. Application received from Theodore Copparini for permission to erect a Free Standing sign 8' 2" x 3' 7" at Hugo's Service Station at 157 Pratt Street. This is a replacement sign. Upon a motion by Selectman Conroy, seconded by Selectman Main it was voted to grant a renewal Class I Garage license for Savini Pontiac Sales, 195 South Main Street. Doctor Gasson, William Jackson and Father Higgins before the Board regarding the problems on Church Street requesting that the street be made on way from North Main Street to Chilson Avenue because of the traffic connected with the Father O'Brien Catechetical Center School. People park on both sides of the street, and even in the middle of the road waiting for someone. Fire trucks or an ambulance could not possibly get through. Howard Fowler also spoke regard- ing the traffic problem there. Police should enforce the parking rules, but if the one way street area is not approved by the State, the police cannot enforce the rules. The Town Manager spoke about a traffic pattern for this section of North Main Street he had prepared and submitted to the M.A.P. Assoc., but they did not approve, and were working further on a plan. After further dis- cussion, upon a motion by Selectman Conroy, seconded by Selectman Clemmey it was voted to make Church Street one way from Church Street to Chilson Avenue on a temporary basis until approval is received from the State. Unanimous. Clarence Leonard and other members of the Fire Department before the Board in regard to the "no relative" rule on the Fire Department. The Rule was adopted two years ago. He read a prepared statement approved by the Fire Department at its monthly meeting held January 4, 1971 for submission to the Board. - 3 - The statement dealt with information concerning the recent problem which came up over the appointment of Robert Bellavance as a call member of the Fire De- partment, and the rule which makes him ineligible. The letter stated in part of the call men, and regular men, and the tradition of the Fire Department which goes from generation to generation, and hoped the Board would review the rule and consider the needs of the Fire Department for good manpower. The Chairman advised that the rule was made for all departments and was done at the time for good and sufficient reason in mind. Unfortunate in regard to the call men for reasons you have stated. Selectman Zecher gave a resume of the Committee's thinking_ that drew up the policy, tried to come up with a policy that treated all departments fairly, and was not put in to hurt the Fire Depart- ment. Thought any member of the Committee would make an exception in this case. After further discussion, upon a motion by Selectman Clemmey, seconded by Selectman Conroy it was voted that the nepotism part of the personnel policy be stricken for all employees of the town. 4 -1 vote - Chairman Saunders opposed. Discussion regarding the $3,500,000. Industrial Revenue Bond issue for Hoerner Waldorf Properties Company. Chairman Fraites of the Industrial Development Financing Authority explained about the bond issue. When application is approved; the town would become the owner of the property even though the town has no financial money in it. The Bond Holders would be the ones having the financial responsibility. A bank would be set up as the Trustees to handle funds. The Authority went over all of the agreements with Attorney Grady, and everything seems to be in order. Last Saturday, the Authority appoved the application. Selectman Zecher advised that there seemed to be a misunderstanding in town about the operation of this Act, which was signed into law, and the town had an article in the 1968 Town Meeting to have the Authority set up. In December of 1968 the Board appointed five members to this Authority, and the Department of Industry and Commerce were notified and approval received of the appointments. The Town is the owner of the property for the next 20 years, and the town's bonded indebtedness would in no way be impaired, just a transaction, the town gets title for the term of the lease. Hoerner and Waldorf, under the guarantee agreement has to pay a stipulated sum over a period of 20 years, then title goes back to Hoerner and Waldorf. No liability to the town. Mansfield is the first town to form an Authority and carry it through. The Town Counsel commended Chairman Fraites and the members of the Authority. If the State approves, the necessary documents will be completed, and the town will receive a deed from Hoerner Waldorf which will be recorded. Taxes will be paid to the town by the company as though they were the owners. Will be assessed as any other firm in town. After further discussion, upon a motion by Selectman Clemmey, seconded by Selectman Conroy it was voted to adopt the Resolution approving and authorizinc the issuance of $3,500,000 Industrial Revenue Bonds - Hoerner Waldorf Properties Company lessee by the Mansfield Industrial Development Financing Authority. Copy of Resolution attached, hereto. January 18, 1971 was set as the date for signing the bonds if approved by the State. The'Town Manager advised the Board regarding the billing machine for the Light Department which was in the fire. Appears to be in working condition, but the state of the unit can not be determined for any length of time. Advise order- ing a new machine at a cost of $6,237. now since unit can not be delivered for about five months. After discussion, upon a motion by Selectman Zecher, seconded by Selectman Conroy it was voted to advertise for bids for the new billing machine for the Light Department. sM The Town Manager discussed rental of the Town Offices with Mr. Vose. and was requesting final approval from the Board. Mr. Vose will furnish the heat and water,I,and the town will furnish the lights. The yearly rate would be $8,250. a year or $687.50 per month for a one year lease, with option to renew at the same price for one year. Lease to be drawn up. Selectman Clemmey advised that the rest rooms should be fixed, and better lighting should be put in, and because of various meetings the heat should be on. Upon a motion by Selectman Conroy, seconded by Selectman Zecher it was voted to accept the lease arrange- ment with Mr. Vose for the rental of the Town Offices at a cost of $8,250,per year. The Town Manager advised that Mr. Westcott had been told of the Selectmen's rec- ommendations, and that he had received a letter from the insurance adjuster advising that the adjuster is ready to negotiate. Should be ready the first of the week for discussion with the insurance company. The Board agreed, after questioning, that the meetings scheduled with the architects would be closed meetings. Letter to be written to the Auxiliary Police for the fine job they did the night of the Town Hall fire. Selectman Zecher spoke about Mr. Seltzam moving his equipment from the rear of the Town Hall. Also advised that the 10 ton limit signs on the Mill Street bridge had been removed. ( Walter Day of Otis Street complained regarding the trash pickup on his street noting the collection day was changed from Thursday to Friday. After discussion of the trash problem, upon a motion by Selectman Main, seconded by Selectman Zecher it was voted to go out for bids immediately for an outside contractor to pick up the trash, the awarding of the contract to be subject to Town Meeting approval. Town Manager to ^check with Ted Robinson, Superintendent of the High- way regarding specifications. Charles Coffee, President of the Mansfield Civic Association read a copy of a letter sent to John F.X. Davoren, Secretary of the Commonwealth advising him that "on the night of December 20, 1970 the Town Hall burned down and to date January 3, 1971 no attempt has been made to salvage the Town Records. Records are still in the burned out town hall without police protection-•. Offers from the Manufactures Bank and the Superintendent of Schools to use their vaults have been made to the town. The Mansfield civic Association petitions you to look into this matter." The Board was very disturbed by the letter, and Chair- man Saunders stated that it was an insult to town employees, and everyone who has worked so hard trying to get things back in order. The vaults have been left at the Town Hall under orders until they can be moved to a suitable place. Heaters have been installed in the vaults, and are as safe as they were before the fire. Mrs. Jellinek speaking out of order, skated that the town records are in the burned out Town Hall, someone from the Secretary of the States office ,coming out to speak to the Association. There was further discussion. Upon a motion by Selectman Conroy, seconded by Selectman Main it was voted to go into executive session. The regular meeting adjourned at 10:30 P.M.
