Meeting called at 10:40 A.M. - Special Meeting
Members present: Selectmen Titus, Secher, Levine, Colella, Town Manager, and
Town Counsel.
The Board of Selectmen reviewed the execution of a warrant to the Sherrif or
Deputy Sherrif of Bristol County for gaining access to the Witoh Pond well site
over an access way which had been obstructed. Town Counsel explained the legal
implications of this warrant.
The order of taking for the Witch Pond Well site had been recorded on June 27,
1973, so it was necessary to wait a 30 day period before this warrant could be
issued. The owners of the access way, the W.R.Riley Company, disputed the Town's
claim that the Town had legal access to the site by means of an easement formerly
taken by the Massachusetts Department of Public Works for access to land looked'
parcel adjacent to Route I -95.
After discussion, Selectmen Levine moved, Selectment Colella seconded, that the Board
of Selectmen issue the warrant and so notify the Sherrif, and it was so voted.
Meeting adjourned at 11:10 A.M.
