This shed has not boon put out to bid yet. A motion was made by Selectman Colella, seconded by Selectman Secher to approve the minutes of the previous meeting as submitted, and it was so voted. A motion was made by Selectman Caponigro, seconded by Selectman Secher to sign the Federal Revenue Sharing Warrant in the amount of $100,000. - $50,000. for Police and $50,000. for Fire Department wages, and it was so voted. A motion was made by Selectman Caponigro, seconded by Selectman'Secher to a prove payment of $745.43 to SRPEDD, the balance due on Assessment for period 1173 to 6/31/74, and it was so voted. The Board set a hearing date of August $, 1973 at 8:00 P.M. on the application of the Brockton Taunton Gas Company for permission to place and maintain a manhole under the surface of Pratt Street on the northerly side approximately 552 feet east of Hope Street. Letter received from Mary D. Flynn, member of the Great Woods Study Committeead- ✓ vising that the Committee has engaged the firm of William E. Coyle, Jr. to appraise the Great Woods, as directed by the annual Town Meeting this year. The appraisal fee of $7,250.. was the lower of two bids, and will encompass 35 parcels, as follows: 20 lots at $250. each and 15 additional parcels at $150. each. Notice received of a public hearing by the Planning Board on August 8, 1973 at 8:00 P.M. regarding the application of Weldor Realty Corp. to subdivide a parcel of lend on West Street. Bill Cahoon, Water Superintendent before the Board regarding the West Mansfield pumping stations and the bani on the use of water. Cleaning of one well has been done and it was found that the i'mpeller,,§haf t. sleeves , etc. were all worn. There is no record of being repaired, only cleaned in 1957. After inspection of the pump there was no sense in repairing the one there. The builder went out of business nine years ago, and to get parts from another company would be as costly as buying a new pump. Whitman &. Howard feel that there should be a new pump, the pumps are not yielding as much water as they should be, and Mr. Cahoon recommended that new pumps be bought for both wells since they are the same age. With regard to the water ban, he reported that there is just as much water being pumped as before the ban was put into effect. The only time that the amount pumped was less was during factory vacations. Mr. Cahoon advised that if ore can enforce the water ban on the big users, we could go ahead and pull one pump, but under the same circumstances as now, would be scared wondering if we could hold the Reservoir by restricting business use. - 2 - Selectman Colella advised that he would like to see Bill order whatever he needs. Should lift the water ban from the residents immediately. The Chairman advised the pump should be torn down or wait until September. Mr. Cahoon advised that the pump should have been replaced two years ago, it is giving the some amount of water now as before it was cleaned. Selectman Secher advised that Bill is the Board's representative doing an excellent job. A joint effort by the residents and industry, could notify the big users regarding the waiting period for the pumps, people do not realize how bad the situation could be. After further discussion, a motion was made by Selectman Caponigro to direct the Town Manager to order two new pumps and whatever equipment is necessary to keep the pumps in good running order, and to leave the installation up to Superintendent 'Cahoon, and to enforce whatever water ban is necessary, which was seconded by Selectman Secher, and so voted. Selectman Colella moved to amend the motion to temporarily lift the water ban to residential users, but there was no second to his motion. The Board was advised that Mr. Russell wanted to come back to the Board regarding the barking dogs. Mr. Rosado was there last night. There was a question of what the legal procedure is regarding kennels. Mr. Russell advised there is a definite improvement during the night, and daytimes they make an effort to stop the dogs from barking. His son works on a night shift, and his wife works nights, and. they can not get their sleep during the day. It is not a continuous barking, but you can not carry on a conversation in his back yard when they are barking. The dogs do not belong there, not the right place for them. The Town Manager had requested the Town Counsel to look into the late regarding dog kennels and was advised that Chapter 140, section 137 C pertained to kennels, which states in part that the Dog Officer, Chief of Police or Licensing Authority may at any time inspect or cause to be inspected any kennel and if, in their or his judgment the sane is not being maintained in a sanitary or humane manner, or if records are not properly kept as required by law, shall. by order revoke or suspend, and in case of suspension may reinstate, such license. Upon the petition of twenty -five citizens filed with the Board of Selectmen, setting forth that they are aggrieved, or annoyed to an unreasonable extent, by one or more dogs at a kennel maintained because of excessive barking or other conditions connected with such kennel constituting a public nuisance, the Selectmen may within seven days after the filing of such petition give notice to all parties in interest of a public hearing to be held within fourteen days after the date of such notice. With- in seven days after such public hearing the Selectmen shall make an order either revoking or suspending such kennel license or otherwise regulating said kennel, or dismissing said petition - ----- Mr. Russell advised that it is a well -kept kennel., but it is no longer an agricultural, area, but a residential neighborhood. Selectman Caponigro advised that a formal complaint was lodged two weeks ago, and the complainants have waited two weeks. Mr. Russell advised that there is an im provement, but it was not satisfactory. When asked if he wanted the complaint pursued, tor. Russell advised that he did. John Gross advised that he understood that if the people had a complaint they should call the Dog Officer, then us. Wo have not been called, and have had a recording device on the phone 24 hours a day. Received no calls from anyone of our neighbors. A question was asked regarding having an attendent at a kennel, whether someone is there at the kennel. Mr. Russel has admitted that the problem has lessened, but is disturing to the abutters, dogs barking in 10 - 15 minute period. Selectman Colella advised that he was in the vicinity for a her hour and did not hear the dogs barking, - 3 - The Chairman advised that he had been out there that afternoon, and that the dogs did bark for 10 - 15 minute periods. Mr. Russell advised that he had not made a call to Mr. Gross, why should anyone have to call to tell them that the dogs are barking. Mr. Lettl when questioned advised that Mr. Russell had explained the situation well enough. The Chairman advised Mr. Russell that if he wished to pursue the matter further, he should get a petition signed by 25 people in regard to the kennel license. He should follow the procedure outlined in the State Law, Chapter 140 - Section 137 -C in regard to the petition. A motion was made by Selectman Secher, seconded by Selectman Levine to approve a two day beer license for the Beagle Club for July 28 and 29, 1973, with the usual restriction, and it was so voted. A motion was made by Selectman Secher, seconded by Selectman Levine to approve the list of election officials as submitted by the Town Clerk, and it was so voted. (Copy of election workers in minute book) Note from the Torn Clerk requesting the Board to select 18 new names to be added to the list of prospective jurors, and the Board picked the following list: Elizabeth Lambos Arthur Pharmakis W. J. Gordon, Jr. Stephen Grubick Rocco Molinari Rudolph C. Lombardi Theodore W. Robinson Catherine M. Jones John J. The Chairman advised the Board realizes the complaints on sweeping the streets, understand your problem with the sweeper. Wondering if there is some way we can resolve it. Selectman Colella moved to have the highway department one day a week have one man and two boys sweep the streets, but there was no second to his motion. The Town Manager discussed with the Board the truck for the,Light Department which was discussed at the Light Commissioners meeting. The Highway Department has such a truck and this is the truck we talked about using. The truck is needed for plowing next winter, and so would have to be borrowed from the Light Department during storms. If that is possible, it may be advisable to sell it to the Light Department and plan to buy a new catch basin truck in the next budget year. We will go out and advertise to see what the expense might be for a new cargo carrier. Based on the costs of the alternatives, a sound decision can be made. The Board members agreed that this trade may be a, reasonable one worth investigating. -4® The Town Manager advised that the low biddero fer -the, construction- contract -,f6r -the power substation was D. M. Poster Company in the amount of $134,450. Thih is 1016 higher than anticipated. will be signing the contract tomorrow morning, and will meet with the contractors tomorrow afternoon. Discussed the Penetryn contract which just came in for $18,000. for performing the various parts of this research project. Met with Tom Bonome and Bill Calhoon trying to determine what parts the -town „could do, will 'raise manholes by torn workers, one portion that is not covered by the contract. would like to start the contract to initiate it. Selectman Secher suggested that a letter should be sent in memory of John A. Briggs, a former Selectmen, to be on the Memorial Roster at the Statewide Town Meeting this fall. Also that a Resolution should be in the next annual Town Report. A motion was made by Selectman Levine to appoint Edward C. Donahue a member of the new Regional Sewerage Study Committee which was seconded by Selectman Secher. The Chairman advised postponement; a of this appointment if anyone else has a cndidate, delay it for one week. Selectman Caponigro suggested having P4r. Donahue come in to see the Board. After further discussion a motion was made by Selectman Caponigro to table this appointment for two creeks which was seconded by Selectman Colella, and it was so voted. Selectman Levine was opposed The Town Manager discussed the Town Meeting Articles and Projects for the last year which have been uncompleted. Selectman Colella askeded a question'whethot the money for Article 39, Projects in highway safety, could be diverted to drainage problems ( at or near culvert closings for stream cleaning. The Board members questioned that was the intent of the Torn Meeting Article. A motion was made by Selectman Secher, seconded by Selectman Levine to go into executive session, and it was so voted. The regrilar meeting adjourned at 10:30 P.M.
