Selectmen Colella read the notice of hearing as posted. Selectmen Chairman Caponigro noted that they sent notices to all Boards and Committees in the Town and then turned the meeting over to Mr. Bob Archilla from HUD. Mr. Archilla noted that he, along with his associates Judy Holloway, and Bob Tierney, were here to solicit comments on the study prepared for the Town. He noted that the study started in June of 1974 after a meeting in Mansfield. He noted that prior to this a meeting had been held with Town Officials back in December of 1974. Since then Anderson Nichols, with Mr. Warren Gynon and Charlie Namous, helped to prepare this study. He noted that Mansfield had been in the National Flood Insurance Program for over 1 I years and have been participating in the emergency phase of the program. He noted that the initial step was to place restrictions on building. After a community like Mansfield has been in the program for quite a while HUD will do a hydraulic study. After the study they come up with the final draft results. He noted that five (5) copies of this were sent to the Town and they did the appropriate thing by forwarding the copies to the various Boards and Committees in the Town. Mr. Archilla noted that the meetings with the Town Officials, such as this, is called consultation officers. This is due to the act-of 1973, which intends that HUD be involved in all of the steps of the study. He noted that basically the intent of this report is twofold. It is to advance the availability of Flood Insurance by adding another layer of coverage. Also by applying the proper risk value to the premium rate for insurance. High risk areas will have appropriate premiums applied to that area. Theother use of the report is the basis for adoption of a more defined flood plain in the form of zoning. The State of Massachusetts has seen that each community is provided with a Building Code. Under 7.80 of the Building Code this has been defined. Minutes August 27, 1975 Page 3 Mr. Archilla noted that they do not insure structures underground such as shelters. Bridges are not insurable nor any type of transportation structure, such as roads. It only applies to buildings and utilities. He noted that in the second, more definitive level, it is required that no residential structures be built within the 100 year flood plain so that the lowest point in the floor is at least 1 foot above the level of the 100 year flood . All other requirements of the first phase of the program still apply. Mr. Robert Show questioned what the 100 year flood was. Mr. Archilla noted that Congress has set up this as a basis for the flood program. It is a 1% chance each and every year of occuring. Mr. Archilla turned the meeting over to Mr. Tex Gynon of Anderson Nichols who presented slides on the Flood disasteract of 1973, House and Urban Development Act of 1969, House and Urban Development Act of 1968 as the base of this report. He noted that the purpose of the flood insurance program is to provide financial assistance for victims of flood disasters in order to rehabilitate their property and to help provide use of land where flood damages would mount steadily and rapidly. He presented the flood plan poorective measures where you build dams and levis and noted that the amount of damages kept rising. The other plan is the protective measure which would keep building out of the flood plains. He noted that flood plain regulations and flood insurances were main items in this program. He noted that the Flood Disaster Act of 1973 provided more coverage. Showed the properties which had restrictions on new development such as items requiring federal funding such as FHA mortgages and VA mortgages. He noted that funds would not be provided for these without flocd insurance. Showed the streams that were studied in detail and which had an approximate study. He noted that the approximate studies were taken from the USGS r'quardrangle maps, Soil conservation survey maps, obtained information form the Zoning By -law, stream chanalization from Cabot, Cabot and Forbes on the Hodges Brook, and survey data from John Leverault, special flood areas map from HUD, information on Flood History from Boston Public Library and information received from Town Officials. Mr. Gynon noted that 15 days from this date he would be required to send a report with any comments received this evening to HUD, for their review. They then have 30 days to review that and return the report to Anderson - Nichols for corrections. Then, additional cop,i.es are prepared and provided to the Town along with Maps and within 30 days from that it has to be completed by Anderson - Nichols. Planning Director Maurer noted a few years ago they had come up with the Wetland Protection Zoning and that some areas of the zoning are more restrictive, than the plan and other areas in the zoning would have to be amended. Planning Directoe'Maurer questioned if more information could be obtained on the approximated areas. Felt that it would be better to get the exact location as opposed to having to make someone go through the appeals period and so forth. Noted that some areas are in the vicinity of streams but do not include the streams. He noted that the lowest habitable floor has to be one foot above the flood area. Minutes August 27, 1975 Page 4 Mr. Leonard Flynn questioned if there were areas shown prone to flood due to topography and soil. Mr. Gynon noted that it is more from ponds and rivers rather than local drainage problems. Chairman Caponigro questioned if it would be a map at scale of 1" = 200' or if it would be the elevation that would be the determining factor. Mr. Gynon noted that the elevation would be the determining factor. Chairman Caponigro questioned how they could determine a 500 year storm when they have only been there 200 years. Mr. Gynon noted it is a statistical factor. Chairman Caponigro questioned if they had uncovered any records that determine what.damages they received during the last storm. Mr. Gynon noted that this was in the report. Selectmen Chairman Caponigro questioned if it was possibl8 for a field review to go out and give a double check to see how close or hoot accure this will be and questioned what happens to existing construction like Cabot, Cabot and Forbes who have spent; hundreds of thousands of dollars building roads. It was noted that this is not In effect yet, and that the requirement is only after the final document is adopted by the Town and that it is only in the preliminary stages now. Mr. Archilla noted that after it is presented to the Town it will be published two times in the local paper and there will be a 90 day appeal period to repute any of the data in the report. He noted that the insurance rate is determined by the location of the property in relation to the flood areas and that information in this report can be continually updated. 12)-Meeting adjourned at 9:30 P.M. er Date approved
