Robert Chavaree, developer for Riverside Park, met with the Board to dis=
cuss the possibility of paving Union Street Extension. He told the Board
that this road leading to the subdivision is partly paved and unaccepted.
He said that the sewer line has been extended already at his expense, and
has discussed with Tom Bonome the possibility of paving this all the way.
Price was discussed. DPW Director Bonome estimated a cost of about $3,300.
Mr. Chavaree said that he would pay the cost for paving. Selectman DeLong
asked Mr. Chavaree if he would commit himself for an amount up to $1,800.
Mr. Chavaree said that he would. A drainage problem was discussed. The
Town Manager discussed the possibility of the 3 or 4 homes on Union Street
Extension hooking up to the sewer before the road was paved. They will
be contacted immediately to see if they are interested. After further
discussion, Selectman Caponigro moved to accept Robert Chavaree's offer
of one -half of the pavement costs to pave the Union Street extension, up
to a maximum of $1,800. Seconded by Selectman DeLong. The wording of
this motion was discussed, and then the motion and the second were with-
drawn. Another motion was made by Selectman Caponigro: to accept one -half
the cost of paving the presently unpaved section of Union Street Extension
from Benefit Street to the beginning of the Riverside Park subdivision, and
that this money be used towards the paving cost and /or the cost of the

drainge work in this particular area, up to a maximum of cost to Mr. Chava-
* ree of $1,800. Selectman DeLong seconded the motion, and it was voted 4 -0.
DPW Director Bonome and Engineer Ralph I. Maloon discussed costs for the
layout for West Street with the Board and Town Manager. After discussion
of how much of the road should be done, and the cost for each section,
Selectman Capoiigro moved that Ralph Maloon (Rim Engineering) be engaged
to make the layout of West Street as proposed in his letter dated Septem=
ber 29, 1976, from the North Attleborough town line to Tremont Street.
* Seconded by Selectman DeLong, voted 4 -0.

A hearing was held on the formal complaint against the dogs belonging to
Edmund Plonowski, 37 West Street, made by Mr. and Mrs. Peter DeTrolio of 92
Rumford Avenue. The formal complaint was read, which alleged a continuous
problem with the animals getting loose and getting into the fenced -in yard
of the DeTrolios. Mrs. DeTrolio stated in her written complaint that the
dogs had killed her ducks on September 11 and 12, and that the dog officer
and police had been called. The dog officer stated in his written report
that the problem has been continuous; the two dogs in question had been
violating the leash law and running loose after breaking chains. The dog
officer had requested that the Plonowskis build a cage for the dogs. This
was done, but there were still three other occasions on which the dogs were
loose. Mr. Rosado _ :recommended in his written report that the dogs be re-
moved from the premises at this time.
The Board heard testimony from Mrs. DeTrolio: she told the Board that her
yard was completely fenced in, and that the dogs had to jump the fence to
get in. She said that she had agreed not to submit a formal complaint if
the dogs were restrained in a cage, but they had been in her yard three
times since the cage was built.
Select man Caponigro asked Mr. Plonowski what kind of dogs they were. He
replied that they were mongrels - mixed breed. Mr. Plonowski also said that
the dogs had been good, that they had not been out of the yard without him
or his wife with them. He said that if the dogs got loose while being taken
from the house to the cages, he was right behind them to bring them back.
Mrs. Plonowski told the Board that the three incidents mentioned were during
the first weeks that the dogs were ever in the cage. She also stated that
when the dogs "took off" in the direction of the DeTrolios, she or her hus-
band were directly behind them and brought them back. She also said that
the dogs were getting used to the pen now. She said they got loose during a
house fire earlier in the day, but she had gone right after them..
Mr. DeTrolio said that he was not trying to be mean about the situation, but
that whenever the dogs got loose, they headed directly to his house. He
said that he did not want to see the dogs destroyed, but something should be
done. He said that his children play in the yard with the ducks, and he
would not want them hurt if they tried to prevent the dogs from getting
to the ducks.
Mrs. DeTrolio stated that the Plonowskis had offered to pay for the ducks,
but it was agreed between the two parties that the money would be used towards

the cost of the cage for the dogs. She told the Board about the instance
where the dogs got into the yard and killed her ducks. She said that
she has been caused great stress by the dogs getting loose, and is afraid
that they will get into her yard again.
Selectman DeLong asked the dog officer if he recommended disposing of the
dogs. Mr. Rosado replied no, that he had checked the situation almost
daily, and that if the dogs were restrained there would not be a problem,
but they had gotten loose three times since the cage was built. He also
told the Board that he has spoken to Mr. Plonowski many times, and that
the dogs have been picked up and taken to the dog pound.
Selectman DeLong and Caponigro discussed how a dog will keep going after
fowl once it has killed some. Mr. Plonowski said that once he realizdd
what the dogs were doing, he restrained the dogs.
Selectman Clemmey recommended that the dog officer keep the Board informed
of whether the dogs got loose again, and that they be removed from town if
found loose again.
Dr. Kenneth Torman of Rumford Avenue also expressed concern that the dogs
might harm his or other neighborhood children while trying to get to the
ducks.
Selectman DeLong stated that there would be no guarantee that the dogs
would not get loose again if they remained on the premises. He moved that
the Plonowskis be instructed to dispose of the dogs (or move them out of
* town) within a week. Seconded by Selectman Caponigro, voted 4 -0.
The dog officer asked for clarification: he asked that if the dogs were
not gone at the end of 7 days, then he should take the dogs away. Board
members answered yes. The hearing was closed. (Note: see discussion on
this item later in meeting.)

The Board as Light Commissioners reconvened their meeting from Monday even-
ing, October 18. The rates for apartment complexes with 12 or more units
was discussed. Selectman DeLong moved to approve the rates as proposed by
the Light Department Director: that Millhaus be increased by 10 %, and that
Twin Oaks and Bristol Arms be decreased by 25 %, assuming that they were
billed in the same manner. Seconded by Selectman Clemmey, and voted 4 -0.
* This will be effective December 1, 1976.

Mrs. Plonowski questioned the right of appeal of the order voted by the
Board at the conclusion of the hearing on her dogs. Selectman Caponigro
told Mrs. Plonowski that this could be appealed to a court. It was pointed
out that the Board could have issued an order calling for a $200 bond as
guarantee that the dogs would be restrained, but there was no change in the
previous order voted.

The Chairman advised Mrs. Plonowski to come back next Wednesday to the
Selectmen's meeting and ask the Board for more time to get this straightened
out. Selectman DeLong• said that he did not want the implication given that
he would change his vote. Selectman Caponigro told Mrs. Plonowski to go
to the DeTrolios and see if they would consent to the dogs staying on the
property if they were restraindd. The Town Manager asked for clarification:
should the Order be prepared as voted? The Board told Mr. Hannon to do so.

Also discussed: Fairfield Optical property gift, the pre - budget hearing to
be held in two weeks, and Millhaus management asked for a clarification on
their request to use individual meters for their apartments. Selectman
