The Town Manager introduced John Edwards, a student intern from StonehiII who will be working on centralized purchasing under the direction of the Town Manager. Jerome Wieczorek and another representative of the Little League met with the Board to request that the Town give help in putting in a second field. Mr. Wieczorek asked that the town bulldozer be used with the operator for one day, and that the backhoe also be used for about 3/4 of a day. After further discussion, Selectman DeLong moved that permission be granted sub- ject to the approval of the Town Manager. Seconded by Selectman Caponigro, * voted 5-0. The Town Manager reported that he had met with Ralph Maloon of RIM Engineering about the West Street layout and that a report will be forthcoming to the Board in this regard. * * A hearing was held on the complaint about a barking dog belonging to Mr. and Mrs. Ralph Kelley of 34 Cottage Street. Selectman Clemmey read the two formal complaint forms submitted by Johanna Roses and Marion Eastman of 32 Cottage Street, which stated the dog barked continually and was left out late at night. The dog officer's report on the complaints was read: that on June 4, 1976, the dog's owner, Mr. Kelley, had visited the.neigh- bors making the complaint with the dog officer to work out a settlement, that the dog would be kept inside the house when the owner was not home. Mr. Rosado said in his report that he had not received any more complaints until September 8, when he was advised that there'was still a problem. Ralph Kelley, owner of the dog, questioned the specific complaint. A report read earlier in the meeting referred to a vicious dog at 36 Cottage Street, and Mr. Kelley reported that another dog in the neighborhood that had been causing a disturbance has since been moved. He said that he was not respon- sible for the other dogs, only his own. Mr. Kelley said that he has only lived on Cottage Street since last May, and that he lived in the country before, and the dog was not used to the cars and pedestrians, and would bark at traffic going by the house. He said that-the dog had barked at 11 p.m. one night and that he had apologized to the neighbors for it and said that he would keep the dog in the house when he was not home. He said that he has -2- Board of Selectmen Minutes of the Meeting September 22, 1976 Page 3 not received any other complaints until the dog owned',by Diane Stewart recently caused a disturbance in the neighborhood. He also stated that the dog does not go out in the morning and stay out all day. He said that it goes out and right back in and is closed in the house until he and his wife come back from work about 4:30 in the afternoon. He said that the dog is let out in the evening, and that if it barks, he is let in immediately. He said that the dog barks at the fire whistle. Jocelyn Rosado, dog officer, said that he had not received any further complaints on this dog until the other day. Johanna Roses said that the dog has been restrained lately, but was out- side before when the people were not home. She said that in the past week, the dog has been kept inside. She said that the dog was "very nice" except for the barking, although in the last week the problem seems to have been resolved. Charles Mulcahy of Cottage Street said that the dog barked last night un- til 11:15 p.m. and was put in. He said that he had made a complaint 2 weeks ago to the Town Manager's Office because he had been home sick in bed and the barking of the dog had disturbed him. He said that he went home and the Police Department had been called because Diane Stewart's dog was loose. He said that his complaint was specifically against Ralph Kelley's dog, that the dog has been left out all summer from 7:30 in the morning until 11 at night. He said that the reasonable thing to do would be to keep the dog in when the owners are not at home. Mrs. Mulcahy added that the dog.has been left out and barked continually. Mrs. Kelley said that they have really tried to keep the dog quiet and in- side. She said that even though the dog is inside the building, that dog had been barking out an open window and they had not realized it. She said that she has since closed the window, and that the dog is not let out unless they are home. Mr. Mulcahy said that the Kelley dog had been tied outside on the day the police officer came to the neighborhood on the Stewart dog complaint. He (Mr. Mulcahy) said that the dog officer could verify this. The dog officer said that he honestly could not say one way or the other because that day he had been so concerned with the Stewart dog that he had not noticed. Both Mr. and Mrs. Kelley said that their dog had been inside. After further discussion, Selectman Caponigro said that he would like to give a chance to the Kelley's to resolve this problem. Selectman Clemmey said that he felt the same way. There was further discussion, then Chairman Colella said that if there were further complaints, that stronger action wound have to be taken by the Board, then declared the hearing closed. Selectman Caponigro moved that the case be taken under advisement and reviewed * again in three weeks. Seconded by Selectman Clemmey, voted 5 -0. -3- Board of Selectmen Minutes Of the Meeting September 22, 1976 Page 4 Fernando Requena and Paul Prendville of Camp, Dresser and McKee engineers met with the Board to review the draft report on Facilities Planning for the Regional Sewage Treatment Plant. Town Manager Hannon also discussed with Camp, Dresser, & McKee engineers and the Board Nabisco's effluent add its effect on the present treatment plant. After discussion, he requested that the Order of Compliance he had drafted be imposed on Nabisco. He pointed out that Nabisco would be compelled, under this Order, to improve their BOD, suspended solids, etc., to prevent "shock ✓ loads" to the plant. Mr. Hannon pointed out that the Environmental Protection Agency and State Division of Water Pollution Control would hold the Town of Mansfield responsible for the plant's performance, and that this "shock load- ing" had to be controlled. There was further discussion, and Selectman Clem - mey moved that the Order of Compliance, as presented to the Board of Selectmen, * (attached) be sent to Nabisco. The Town Manager explained a proposal made to him by Camp, Dresser & McKee, and this was discussed by the Board. After further discussion, Selectman Caponigro moved that the Board of Selectmen recommend to the Capital Improvement Progam Committee that an article be inserted at the next annual town meeting seeking funds to divert the water (effluent) from the sewer treat- ment plant around the Lagoon to alleviate the problem of the Lagoon effluent being dumped into the Norton Reservoir in the summer months. The motion was * seconded by Selectman Clemmey, and voted 5 -0. Selectman Caponigro also moved that the Board of Selectmen meet with Norton's Selectmen tomorrow night and discuss their supporting the bills now in the Legislature for acquisition of land (Dever property)fbr the proposed regional plant, and also to advise Norton of the action taken here tonight regarding x a solution to the Lagoon problem.
