Mr. and Mrs. Paul McCarthy met with the Board to discuss trees that they had lost to gypsy moths last year. The Town Manager said that there was no money for spraying this year, that the account had been depleted for trees and pests. Selectman Caponigro said that he wanted to see how successful the spraying was before going after more money for this. The Town Manager will check with the Division of Forestries for egg counts for the area. Bertram Cook, Building Inspector, met with the Board to discuss whether a fee should be charged for permits for municipal buildings, such a s schools. He said that the practice has been in the past to waive the fees, but the Municipal Building Committee wanted to collect the fee for the school addi- tions. In discussion, it was pointed out that the Town's Building Code Bylaw and the State Building Code allowed the Board of Selectmen to waive the fee at its discretion. Mr. Cook said that if the Board decided to col- lect a fee, the amount would have to be set, as the fee schedule does not include a fee for municipal buildings. * Selectman DeLong moved to issue the necessary permits for the school addition subject to possible charge of a fee. Seconded by Selectman Clemmey, voted 5 -0. The Municipal Building Committee will be consulted in this regard. Correspondence received: letter regarding HUD flood insurance study. Representatives of the various Veterans' organizations met with the Board to discuss Article 20. The Veterans said that the will said that the funds for the War Memorial would be under their jurisdiction, not the Board of Selectmen's. Town Counsel pointed out that the will did not say that, and that the judgement of the Court on October 6, 1975, called for the money to (* Motions passed) -1- Board of Selectmen Minutes of the Meeting April 28, 1976 Page 2 be accepted by the Town, and dispersed by the Board of Selectmen. There * was further discussion, and it was decided that if Town Meeting voted this article, then the Selectmen's representative, Mr. Titus, would call a meet- ing of the committee to be comprised of representatives of the Veterans' organizations and himself, then a recommendation would be made to the Board of Selectmen. Selectman Caponigro put this in the form of a motion, which was seconded by Selectman DeLong, and voted 5 -0. The budget line item for the Veterans' parades was discussed. The owner of the Mansfield Arcade (311 North Main Street), Mr. Doyle Chaille, met with the Board to discuss complaints lodged with the Police Department about the loud noise and abusive language coming from the Arcade. The Clerk read the list of complaints, which cited 3 complaints of loud or excessive noise or vulgar language from the Arcade. Mr. Chaille attributed the noise to a defective jukebox, which has been replaced. He said that the jukebox music should "cover" any abusive language from the establishment. Also dis- cussed were: the ages of the managers of the Arcade, and whether truants frequented there during school hours. Mr. Chaille said that his son and another employee (18) oversaw the building when he himself was not there, but that he had no control over truants. There was a consensus of the Board that since this was the first time that Mr. Chaille had been in since the issuance of the license, the license would not be revoked. But they agreed that if there were further complaints, there might be a vote to revoke the license. Mr. Chaille said that he would do his best to cooperate. Members of the Finance Committee, Board of Assessors, and the Town Manager discussed the overlay reserve ($65,000 to $70,000) and what should be done with this. The Town Manager explained that this could be used in an annual town meeting only for an extraordiary expense, and in a special town meeting for an extraordinary or unforeseen expense, if the Board of Assessors voted to transfer the amount. He pointed out that this money could not be used to reduce the general tax rate. The Board of Assessors said that they felt the money should be left in the account and not transferred. The Finance Committee agreed with this. Selectman Titus felt that the money should be usedin any way that it could to help reduce the tax. increase. The Assessors agreed that they would discuss any proposal put to them by the Board. The Town Manager asked that the Board approve a transfer request to be for- warded to the FinCom for $990 for a contractor to finish the work at the air- port necessary to receive the money from the federal; government. Mr. Hannon explained that there was some brush clearing work to be done to pass the federal guidelines, and that when the work was completed, the Town will be reimbursed. Ronald Montaquila said that the FinCom would approve this providing the money went into the town's general fund when the reimburse- ment came back. * Selectman Caponigro moved that this transfer be approved and forwarded to the FinCom. Seconded by Selectman Clemmey, voted 5 -0. -2- Board of Selectmen Minutes of the Meeting April 28, 1976 Page 3 Paul Dalton and Mike Murphy of Cabot, Cabot & Forbes met with the Board to turn over the 3 million gallon standpipe located in the industrial park to the Town of Mansfield. Selectman Titus moved that the Town accept the 3 million gallon water standpipe from Cabot, Cabot & Forbes. He expressed thanks for the very generous gift from C.C. & F. The motion was voted 5 -0. * Selectman Titus moved that the Board of Selectmen give C.C. & F. a letter authorizing them to record the deed for the Water Tank. Seconded by Select- man Caponigro, voted 5 -0. * Selectman Caponigro moved that the Chairman of the Board be authorized to sign the above letter on behalf of the Board. Seconded by Selectman Clemmey, voted 5 -0. The Town Manager discussed the request for an allotment of 15,000 gallons of sewage to be connected per year for the C.C. &F. Industrial Park. Mr. Hannon said that the request was for 15,000 for the next 5 years, making a total of 75,000 gallons. He said that once State approval is received, there would be no problem that he could see. Mr. Hannon reported that he had been in contact with the Water Pollution Control Division, and had been told verbally that this approval would be forthcoming, but to date has not received the written verification. Selectman DeLong said that some action should be taken pending state approval. Paul Dalton of C.C. & F. said that they would appreciate that step; that they would be able to bring in new clients. • Selectman DeLong moved that the Town of Mansfield allocate 15,000 gallons of additional sewage each year for the next 5 years, totalling 75,000 gallons of new sewer connections for the industrial park, subject to State approval. of an additional 200,000 gallons. Mr. Stockus pointed out areas where there seemed to be a good water supply and suggested prolonged testing in those areas. He said that the Town would need more water if the industrial base kept expanding. The Clerk of the Board read a sewer connection from Pring Plumbing to do a sewer connection for Copeland Realty Trust at 84 Copeland Drive. Attached to the application was a letter from the Mansfield Credit Union allowing the connection to come across that lot. Supt. Cahoon said that he saw no problem with the connection. The letter from the Mansfield Credit Union allowed the connection to come through the lot providing the area was restored to its original condition. * Selectman Caponigro moved that.the sewer connection for 84 Copeland Drive be approved as per the plans submitted. Mr. Johnson asked that the Board of Selectmen recommend $576 in next year's Council on Aging program budget to participate in this administrative agency. Selectman Clemmey said that before signing the contract, he would want all the town's responsibilities spelled out, and what the Town would be getting in return. * After further discussion, Selectman Titus moved that the Town of Mansfield join and continue with the Bristol Home Care Corporation, and that $567 be recommended in the budget for next year for this program. Board of Selectmen Minutes of the Meeting April 28, 1976 VFW Liquor License Hearing (Note - alleged violation occured on September 5, 1975) Town Counsel Grady noted for the record that this was the first formal hearing on this complaint, although there had been two previous hearings on the matter. .In accordance with the law, Attorney Grady noted, notices had been sent to both the parent of the minor and to the Commander of the VFW. Mr. Grady said that before getting into the evidence, it should be established who was present at this hearing. The Chairman of the Board of Selectmen asked if Mr. Talbot was present. Air. (Thomas) Talbot indicated that he was and his son (Richard) was also. Attorney Grady asked if Mr. Talbot was prepresented by counsel. Mr. Talbot indicated that he was not. Attorney John White, representing the VFW, said that he originally repre- sented Mr. Frank Monett. Mr. Frank Monett, bartender at the VFW, was also present. Other present: Arthur Terenzi (VFW), Officers Roger Miller and Arthur O'Neill of the Mansfield Police Department. Officer Miller stated that he and Officer O'Neill were on their routine bar checks, and went into the VFW at approximately 9 p.m. He said that when he walked down the stairs he observed Richard Talbot sitting there. Officer O'Neill brought to attention the fact Richard was not 18 years of age. Officer Miller called back by phone to the Desk Sergeant (Sgt. Carr) to check in the Police Dept. files the date of birth of Richard Talbot. Subsequently it was found that Mr. Talbot was only 17 years of age. Attorney Grady asked Officer Miller what, if anything, was in front of Mr. Talbot when he walked in the door. Officer Miller replied that there was a partial bottle of Budweiser beer with approximately a quarter of a glass alongside the bottle sitting in front of him. Attorney Grady asked Officer Miller what he did after he obtained the infor- mation from the Sergeant. Officer Miller said that he spoke to Mr. Monett (identified him as the gentle- man in the.red jacket) who was behind the bar. He asked Mr. Monett to step over towards the back so they could they could speak. Officer Miller said that Mr. Monett was the bartender that night. Attorney Grady inquired what conversation took place. Officer Miller said that he asked Mr. Monett if he knew that Richard was a minor, and if he had served him. He said that yes, he had served him: Mr. Monett told Officer Miller that Mr. Talbot had been in there several times before, and that he had produced valid ID on other occasions. Officer Miller said that he asked Mr. Monett what kind of ID, and he replied that he did not (Hearing - -1) Board of Selectmen Minutes of the Meeting April 28, 1976 VFW Liquor License Hearing know, but he knew that it was not a driver's license. Attorney Grady asked officer Miller what he did after the conversation. Officer Miller replied that he advised Mr. Monett that he could be charged with delivering alcoholic beverages to a minor. Mr. Talbot was ordered out-of the.bar and Mr. Monett was advised that Mr. Talbot was a minor. Attorney Grady asked Officer Miller if he had the official police report. Officer Miller replied that he did. Attorney Grady asked what, if any, further investigation as it pertains to Mr. Richard Talbot was carried out. Officer Miller replied that on September 6, Mr. Richard Talbot gave a volun- tary statement to Sgt. Carr at the Mansfield Police Department along with a copy of his birth certificate. Attorney Grady asked if the officer had a copy with him, and he replied that he did. The officer was asked by Attorney Grady to show the statement to Mr. Talbot to see if it was his signature. Attorney Grady asked Mr. Talbot if that was his signature. Mr. Talbot replied that it was. Attorney Grady also asked Mr. Talbot if that was the birth certificate that was supplied to the Police Department. Mr. Thomas Talbot (father) examined the birth certificate and stated that it was an accurate copy from the City Hall in Boston. Attorney Grady asked what, if anything further, was done by the Police Dept. as a result of the investigation in this matter. Officer Miller replied that Mr. Monett went to Fourth District Court on a complaint. Attorney Grady asked if the matter ever reached trial. officer Miller said that on the day the matter was to go to trial, the defendent, Mr. Monett, did admit sufficient evidence. (copy of complaint presented to the Board) Attorney White asked the officer to repeat if the matter actually reached trial. Officer Miller said that it reached the hearing stage, before the judge, and that the defendent, Mr. Monett, did admit certain facts before the court, with the recommendation that the case be continued for 6 months without a finding. The copy of the complaint was shown to Attorney White. Attorney Grady questioned what the result of that was. Officer Miller said that the case was continued for 6 months without a finding, as recommended. Officer Miller stated that Mr. Monett at the courthouse did produce an ID card which was allegedly used by young Mr. Talbot. He said that this was in one of the conference rooms. The card was shown to Richard Talbot and he was asked if he could identify this as something that he produced. (Hearing - -2) Board of Selectmen Minutes of the Meeting April 28, 1976 VFW Liquor License Hearing Richard Talbot answered no, he had never produced that. (Board members examined the ID card). Attorney White questioned Officer Miller, asking him if he actually saw the transaction where it is alleged that Mr. Talbot was served beer, and if Mr. Monett mentioned the name of one Mr. Vasolotti, and if Mr. Monett had not in fact told the officer that he had served the liquor to Mr. Vassolotti. Officer Miller said that he did mention the name of Vasso- lotti. Attorney White asked the officer if was aware of the fact that the prosecuting officer asked us if we would continue without a finding. There was further discussion about the continuance without a finding, and Attorney Grady reminded Attorney White that the hearing was on the liquor license and questions should be limited to such. Attorney White asked if any mention was made at the courthouse about pro- ceeding against the VFW liquor license. Officer Miller said that no mention was made to him. Attorney White asked Officer Miller if there was at any point a trial where Mr. Monett pleaded guilty to anything. Officer Miller said that there was not. Officer O'Neill said that the only thing that he could add to what Officer Miller said was that he was aware of Richard's age because of something from a few months earlier. He mentioned the age to Officer Miller and to double check the date of birth. Attorney Grady asked Officer O'Neill what he observed on that night when he want into the VFW. The officer replied that he observed a bottle of beer and a partially full glass. Attorney White asked Officer O'Neill if he knows young Mr. Vassolotti. The officer replied that he did. Mr. White asked if Vassolotti drank that evening and the officer replied yes. Mr. White asked if Mr. Vassolotti was sitting at the table with Mr. Talbot. Officer O'Neill replied that he was at the pool table. Attorney White questioned if he was drinking the same type of beer. Officer O'Neill said he did not recall. Attorney White said that he would like to have Mr. Monett testify. Mr. Monett said that he was the bartender on September 5, and that Richard Talbot came in with Vassolotti around 9 o'clock. Mr. Monett said that he sat down at the bobth where Officer Miller found him when he came in, and Vassolotti came up to the bar and ordered one Budweiser. When Mr. Monett went to the end of the bar to get the Budweiser out of the chest, Mr. Monett said that Mr. Vassolotti hollered to him to "make it two ", and a brought two back to Mr. Vassolotti, who paid for the two. Mr. Monett said that since there were only three other people at the bar, he sat doom and started watching TV, then Arthur O'Neill came in Officer Miller. It was Vassolotti that was served, not Talbot, claimed Mr. Monett. Attorney White asked if Talbot had ever been in before. Mr. Monett said that yes, he had been in quite a few times before. Mr. Monett said that when he asked for identification, he was shown the card that Officer Miller has. Attorney White asked what kind of card it :was. Mr. Monett said that it was an ABC card, an old one, without a picture on it. Attorney White asked if Mr. Monett had ever seen the card before. Mr. Monett said that he had (Hearing - -3) Board of Selectmen Minutes of the Meeting April 28, 1976 VFW Liquor License Hearing seen it before, as had every other bartender down there. Attorney Grady asked Mr. Monett if, when he (Talbot) had been in there before, had he been drinking. Air. Monett replied yes. Attorney Grady asked if Mr. Monett served him. Mr. Monett again replied yes. Robert Marquis, bar manager of the VFW, also said that Mr. Talbot had been in there before with a selective service card. Edward Creeden, commander of the VFW, said that he had seen Mr. Talbot in there on other occasions, but could not recall if an ID was shown. Selectman DeLong questioned how Mr. Monett happened to have the ID card. Mr. Monett answered that it had been left on the bar, on purpose, after this incident. Selectman Caponigro asked what the name on the card was, and then looked at the card. Attorney Grady reminded the Board that Mr. Talbot had not identified the card as his. He then asked Mr. Talbot again if the card was his. Mr. Talbot answered no. Attorney Grady asked Mr. Talbot if he had ever used that card in the VFW. Mr. Talbot again said no. Mr. Grady said that it was a crime for a minor to be asked to be served liquor, but this was not a criminal investiga- tion tonight. He said that Mr. Talbot had certain civil rights, and was not represented by Counsel at this time. Attorney White examined the card. Mr. Grady advised Mr. Talbot that he did not have to answer any questions if he did not want to, and that he was sent a notice only because the statute required it. Selectman Titus asked Richard Talbot how tall he was.. Mr. Talbot replied that he was 517" and weighed 145 pounds. Selectman Titus said that the ID description was for a person 6' tall and 195 pounds. Attorney White asked Richard Talbot if he had ever used this card or any other card in the VFW. Mr. Talbot replied "no ". Attorney White asked Mr. Talbot if he understood the questions he had asked Mr. Monett. Mr. Talbot answered yes. Selectman Caponigro said that he would like to have something clarified. He asked Mr. Monett if he had served him. Mr. Monett answered that he had, but not on the night of September 5 (refers to Mr. Richard Talbot). Commander Edward Creeden said that he may have served him, but did not recall. Attorney White asked the officers if, when the case went to court, was Mr. Vassolotti there as a witness. Officer Miller replied that he believed Mr. Vassolotti was summonsed, and did not recall if he was there or not. Mr. White asked the officer if Mr. Vassolotti had been asked to come here tonight. Officer Miller replied that he had ,not. Selectman Clemmey said that he had not been at the first tw o discussions on this. (Hearing —4) Board of Selectmen Minutes of the Meeting April 28, 1976 VFW Liquor License Hearing Selectman Clemmey asked if there had been other problems like this. Officer Miller replied that to the best of his knowledge, he did not per- sonally know of any violations of minors being served. Officer O'Neill also stated that he felt the same way, that he did not know of any other violation where a minor was served. Selectman Titus questioned Officer'Miller's statement that Mr. Monett had said he served the youth. Officer Miller said that Mr. Monett did say that, that Officer Arthur O'Neill was there and witnessed the con- versation. Mr. Monett said that he thought he could clear this up - when Officer Miller asked him if he had served him (Richard Talbot), he had answered that if he (Richard Talbot) had gotten the beer from the bar, he had to get it through me, but not directly - he (Mr. Monett) was the only bartender there. Even though Mr. Monett served Vassolotti, it still came from him. Mr. Monett stated that he did not serve Richard Talbot personally. Attorney Grady stated that assuming the evidence was closed, it was customary for the counsel for the licensee to state a summary or plea - to address the Board if he chooses, then the Board could take the matter under advisement. Attorney white said that he would like'to make a very brief final statement. He said that they did not deny that Mr. Talbot had the beer, but vehemently deny that Mr. Monett gave it to him personally. Mr. Vassolotti had purchased the beer, and he was 18. The Chairman declared the hearing closed. * Selectman Clemmey moved that the matter be taken under advisement. Seconded by Selectman Caponigro, and voted 5 -0. (Hearing - -5)
