DPW Lee Azinheira, Water Operations Manager and Chris Woodcock, Woodcock
Associates were present.
Mr. Azinheira noted that they provided the Board with a lengthy spiral-bound report. Mr.
Gaffney said that he is asking that Phase 1 of the water ban go into effect on May 27th and
be lifted on September 6, 2006. Mr. Gaffney noted that last summer was a dry summer. Mr.
McCarter expressed concern about people that have recendy installed new lawns. Mr.
Gaffney noted that the watering would still be allowed, but limited to the hours in the
morning between 5:00am and 9:00am and in the evening between 5:00pm and 9:00pm. The
Board discussed the impact of future DEP regulations.
Motion: To approve Phase 1 water restrictions beginning May 27, 2006 to be lifted on
September 6, 2006
(Amoruso - McCue) 5-0 Passes
Mr. Azinheira noted that a 4% increase in the water rates will be sufficient for this year for
the operating of the plant and operational costs. Mr. Azinheira said that we had anticipated
6% each year for four years, but we actually only need 4%. Mr. McCarter asked what the
average homeowner's bill will be. Mr. Azinheira replied that will be $85-90 a quarter, which
includes the 4%. Mr. D'Agostino suggested putting down the average homeowner's
r consumption from last year to this year. Mr. McCarter asked what else this money will
cover. Mr. Gaffney said that in 2008, we are looking to upgrade the Walsh Well at a cost of
$850,000, $1.5 million to replace the water main on Ware Street/Essex Street and the
installation of new generators at certain wells and looking to study the wells for manganese
removal. Mr. Gaffney added that he is going to ask the Board for a 20-year bond for these
projects in the future. Mr. Azinheira noted that the average bill will go up approximately
$4.00. Mr. Azinheira expects a 4% increase each year for the next few years, barring any
unforeseen circumstances.
Mr. Gaffney noted that the Ware Street project expects to be done in the next three weeks.
He noted that the Water Department replaced a lot of water mains in the center of town in
the 1980s. He noted that we don't get the full amount out of the Walsh Well and Mr.
Amoruso asked why that is. Mr. Gaffney noted that it was a design flaw. Mr. McCarter
asked if the Finance Committee has reviewed this budget and Mr. Gaffney replied that they
have. Mr. Gaffney noted that the Water Department is being recognized by the state for
being in the top 5% of the state for water quality.
Motion: To approve the recommended water rates on the memo entided "Mansfield Water
Rates effective June 1, 2006,"dated May 10, 2006

DPW Lee Azinheira, Ken Hackett, WPCF Operations Manager and Chris Woodcock of
Woodcock Associates were present.
Mr. Azinheira said that he and Town Engineer John Sullivan met with Chris Woodcock of
Woodcock Associates and asked him to work up a sewer connection fee based on the
existing wastewater treatment plant and sewer collection system and a sewer inflow &
infiltration (I&I) reduction component.
Mr. Woodcock explained the connection fee. There are two parts: part one is a charge to
renew connections to buy into the system. The idea was to model this to make it similar to
the water connection fee. The second part of the charge has to deal with the inflow and
infiltration component.
Mr. Amoruso said that the recommendation is that we have a connection fee that is based
on the value of buying into the system and a charge for I & I that everyone is currendy
paying for, with the enterprise fund. Mr. Amoruso asked how this will be administered. Mr.
Azinheira said that this model is very similar to the connection fee for water. Mr. Amoruso
expressed concern about the potential increases in the connection fees yearly along with the
sewer rate increases of 17-20%. Mr. Woodcock said that he doesn't think it will be that
much of an increase - it shouldn't change a lot.
('
Mr. Dentino said that the connection fees should assume $100,000 in revenues. Mr.
Woodcock said that we can estimate that the revenues may go up 3% annually - that is
probably a conservative number. Mr. Azinheira said that it all depends on the number of
new connections. In response to a comment from Mr. Dentino about projecting the
number of new homes, Mr. Woodcock said that it is difficult to tell that we will get the same
number of new home starts over the next five years. He thinks the $100,000 is a safe
number and hopes that the Town will get at least that every year. He added that he tends to
be conservative.
Mr. Azinheira said the connection fee is a capital charge and is something we have been
trying to do for a number of years. Mr. Amoruso asked when it would go into effect and
Mr. Azinheira replied that they are looking for July 1, 2006. Mr. D'Agostino asked if other
communities have a fee like this. Mr. Woodcock said that other communities have
connection fees and it is very common throughout the country. It is not an excessive or
large fee by standards in the Commonwealth or around the country. This fee is based on a
calculation of sound data that is applicable to Mansfield and only to Mansfield. He doesn't
guarantee that there may be some problems in court in the Commonwealth.
Motion: To approve the Mansfield Sewer Connection Fee as proposed to commence with
the upcoming fiscal year, beginning July 1, 2006

(McCarter - McCue) 5-0 Passes
Town Engineer John Sullivan said that the developers have successfully completed the
punchlist items, he and the Town Planner have inspected and are recommending acceptance.
Mr. Amoruso suggested that Mr. Dentino abstain from the vote, as he was not involved in
the previous discussions of this petition. Mr. Dolan asked for public comment, of which
there was none.
Motion: To close the public hearing

Motion: To accept Nicole Road and Noreen Road as public ways

Lynn Tokarczyk, Business Development Strategies & Mark Peters, CPO, Innovative Spinal
Technologies were present for the presentation.
r
Mr. D'Agostino said that the TIP Committee reviewed the proposal by 1ST. We made some
changes to their original submission. Last week, I indicated to the Board that there may be
some changes; including capturing the entire square footage. The proposal calls for a TIP
arrangement over 7 years. The current annual estimated taxes paid to Mansfield on the total
building is $50,510. The estimated taxes to Mansfield over the 7-year period is $398,641, the
new estimated tax revenue with TIF to Mansfield over the 7-year period is $16,934, the
current and new tax revenue with TIP to Mansfield the 7-year period is $415,575, the
estimated average tax relief annually is $20,490 and the estimated tax relief over the 7-year
period is $143,430. Mr. D'Agostino went on to say that 1ST is an emerging medical
technology company. Mr. Peters noted that 1ST has just recendy signed a lease. They
expect to employ 168 new employees over a five-year period.
Ms. Tokarczyk recognized Stephanie Mercandetti, Regional Municipal Coordinator for
Norfolk County, and Ed Tartufo and Jay Barrows from the Tri-Town Chamber of
Commerce. In order to make this project move forward, the company is looking for these
incentives to move forward with Phase 1 and Phase 2. Mansfield is part of the economic
target area. The company expects to spend $1 million annually in local businesses.
Mr. McCarter asked how many employees the company has now. Mr. Peters said that the
company currendy has 38 and expect to be around 65 by the end of the year. Mr. Peters said
r
Board of Selectmen Minutes of May 10, 2006
4
that we are in a temporary space in the industrial park. Mr. McCarter said that he hopes that
(' Town Meeting will approve it and noted that he doesn't have a problem with it.
Mr. McCue asked what the median salary is for employees is and Mr. Peters said that it is
roughly the same as the average of $90,000. Ms. Tokarczyk said that the savings to 1ST in
the flrst year is approximately $12,000. Mr. McCarter asked if local candidates will get
preference. Mr. Peters said that they are advertising in the local newspapers and noted that
25% of the new employees come from the ETA.
Walter Jenkins, a member of the IDC and the TIP Committee asked to speak. He said that
there is $12,000 in relief for 1ST over the first year! and then jumps up over the next few
years. The TIF Committee has reviewed and is comfortable with the layout as is.
Mr. Amoruso noted that he represents the Board on the TIP Committee. He thinks it is a
reasonable TIF and the Town gets a higher percentage when the company is expanding. Ms.
Tokarczyk said that Phase 1 will accelerate their expansion plans. Mr. Dentino said that the
long run, the 1ST will be saving 90% of the new tax:es over the 7 -year period. Mr. McCue
asked if 1ST plans to consider manufacturing and Ms. Tokarczyk replied that they are.
Mr. Dentino asked if 1ST is going to apply for a ta~ abatement. Mr. D' Agostino said that the
owner of the building could apply for a tax abatement. Mr. Dentino asked if 1ST could
apply for an STA and Ms. Tokarczyk said that they cannot - it is either one or another.
r
Mr. Jenkins said that we should do a TIP is because the Cabot Business Park has been the
crown jewel of Mansfield and was primarily a warqhouse and distribution facility in the
beginning. Currendy, AMB is posting a vacancy of 20-25% in the park. It is alarming.
There are new parks in Freetown, New Bedford, $. d Franklin now and we need to entice
business to come to Mansfield. We need to consi er competition as well. Por us to remain
competitive, we need to be in the same boat. Mr. cCue noted that they intend to create
168 jobs. Mr. McCarter asked Mr. Jenkins if he b . eves 1ST will increase competition in its
field and he replied that he believes it will. !
Jay Barrows, 370 Pratt Stteet and President of the Lri-Town Chamber of Commerce asked
to speak. He noted that he believes that 1ST will taw others to Mansfield. He urges the
Board to support the TIF and to speak for it at To n Meeting.
Ed Tartufo, a member of the regional ETA group asked to speak. He pointed out that
Mansfield is the envy is the other towns by atttacti g businesses like 1ST. He noted that the
town managers in the communities in ETA are w rking to get businesses to their towns and
we are fortunate to have 1ST would like to come. e believes that the chance that a
company will get an STA again is very unlikely.
r
Mr. Dentino agrees that we should welcome 1ST 'fth open arms but we should not say
goodbye to our seniors. !

Mr. Azinheira noted that he went over the capital resentation at a previous Board meeting.
Last year at Town Meeting, money was appropriat d to do a detailed facilities assessment.
That was done in April and they met with DEP a d went over the report. One of the
questions Mr. Azinheira asked DEP was what wo d happen if we don't fund the
improvements. DEP said Mansfield has always b en a good community, but if things fail,
Mansfield could be subject to fees and consent a eements. Mr. Hackett said that the
equipment in the headworks area is in disrepair. I needs attention right now for the plant to
operate properly. These are the things that need t go forward today. We are putting
patches on patches. In Phase 1, these are things at have to be done in order for the plant
to continue its high quality effluent. Mr. Azinheir said that we tried to put the expansion in
Phase 2 and do only the necessary things in Phase 1. Mr. Azinheira said that the numbers
are staggering but the plant has been in operation nd online for 21 years and much of the
equipment has met its useful life.
r
Mr. Azinheira said the other component is $455,0 0 for the School Street sewer interceptor.
The majority of the money for the interceptor is c ming from Mansfield Crossing. Phase 2
comes from the town and Phase 3 comes from F field Green and then Phase 4 will also be
by the Town.
Mr. Azinheira said that the sewer rate increase sce arios are for the existing plant and not on
any plant expansions. He pointed out that in the scal year 2010, the increase would be
12%, not 6%. He said that in scenario B, the flrst ear would be 20%, then go to 18% for
the next two years and then in 2011, it would be 6 0, not 17%. Mr. Amoruso asked what the
difference what the difference is between scenario A and B. Mr. Azinheira replied that the
scenarios are for the same but spreading the rates 0 different ways. Mr. Amoruso asked if
this increase will just pay for operating costs and r. Hackett said that it will keep our head
above water. Mr. McCarter asked about the waste ater depreciation account. Mr. Azinheira
said that was factored into this. Mr. Azinheira sai in the flrst year, it is basically a wash, but
when the debt service kicks in, we will be using so e of the depreciation account. Mr.
D' Agostino asked for the amount in the wastewat r depreciation trust fund and Mr.
Azinheira replied that there is over $100,000 but h cannot point to a specific number.
Mr. Amoruso said that he doesn't want to slam pe pie 20%, 20%, 20%, 12%. Mr. Azinheira
said we expect to revisit the percentage rates every year. Mr. Azinheira said that we are
r currendy below the state average at $301 for the y ar and the 20% would increase the
Board of Selectmen Minutes of May 10, 2006
6
average to $360, which is still below the state aver ge of $450. He doesn't see an easy way
r around it. Mr. Woodcock said that they are trying to minimize the increases because he
doesn't want to bring the $750,000 too low.
Mr. McCue said that tough choices need to be ma e. Mr. McCarter said that they make a
compelling argument but he doesn't believe he ca support a 20% increase and suggested
scaling back. Mr. Hackett said that we have scale back as much as we possibly can. Mr.
Dolan noted that there are state requirements that need to be met. Mr. Azinheira pointed
out that Attleboro raised their rates 80% for 2 yea s a couple of years ago.
Mr. Azinheira said that our goal is to get the desi and then get actual numbers for the
expansion. Mr. Amoruso pointed out that the 200 0 increase is for sewer customers only.
Mr. Azinheira said that he plans to hold a meeting with Norton and Poxboro after Town
Meeting to discuss this issue.
Mr. Amoruso said that we need to look at both si es - we need to look at the 20% and look
at ways to mitigate to expand it out. Mr. Dolan p inted out that we need to see where
Poxboro and Norton are with respect to the plant expansion. Mr. McCue pointed out that
we need the 20% to keep operating the way we ar today, tomorrow.
Mr. Azinheira said that he met with the Pinance C mmittee on this.
Mr. McCue conflrmed that they cannot do with a 7% increase and Mr. Azinheira said that
r they cannot. Mr. Amoruso asked if they looked at going higher than the 20% so the next
years will not be as severe and Mr. Azinheira said at they did not, but he will put the
numbers together if we were to do a 25% increase the flrst year. Mr. Woodcock said that
the 20% brings you up so that the revenues meet e expenses.
