Conroy; Re- cording Secretary Diane Hunt Meeting posted for 6:30 P.M.; called to order at 6:40 P.M. for a public hear- ing on Relocated Route 140. Expeditor David Chareth introduced other staff members from the State DPW. He said that the State would not make another presentation, as this had been done once before on April 20. He told the Board that he had met with resi- dents from Casa Drive to answer individual questions during the informal meet- ing between 5 P.M. and 6:30 P.M. He noted that he received several requests from people wishing to have their property acquired, and that he has answered more questions about intersections, land takings, and the timetable for con- struction. An unidentified Casa Drive resident questioned Mr. Chareth about the proposed noise barrier. Mr. Chareth suggested that individuals write to the Chief Engineer (Robert T. Tierney, Mass. DPW, 100 Nashua Street, Boston, 02114) to support this recommendation. Chairman Titus noted that the Ladd family of 197 School Street is interested in an early acquisition because of a handicap in the househould. Mr. Chareth noted that the DPW is aware of the situation and will make every effort to get the Ladds settled as early as possible; they should be contacted within the next month. Another question: when would the contract be started? Mr. Chareth noted that the bid would be awarded in August of 1978 and construction would pro- bably start in September 1978. The projected noise levels for 1990 will definitely affect Case Drive residents, so the noise barrier has been proposed to run the entire length of the property. The history of this project was discussed, and the reasons for relocation: partly due to the projected C.C. & F. park traffic, plus the increased traffic through the center of town on a narrow road. Residents questioned why a subdivision was allowed to be put adjacent to a pro- posed highway. Mr. Chareth pointed out that if a developer meets all other local Planning Board requirements, legally, the Planning Board cannot disallow the development. The traffic on West and Walnut Streets was discussed. Concern was expressed about the traffic from the construction site creating a hazard in a heavily populated residential neighborhood. One resident suggested that a committee be formed to look into banning heavy equipment from these roads. Board members said that they would have to look into this in more detail and also check the State regulations in this regard. Selectman Colella made the following motion: that the Board of Selectmen ban all the heavy equipment connected with the construction of Route 140 from the ( *- MOTIONS PASSED)' -I- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting June 29, 1977 Page 2 heavily populated roads in the vicinity. Selectman Clemmey asked that Mr. Colella add "pursuant to State regulations "to the motion. Select- man Caponigro noted that this is a very serious motion, and should be checked with Town Counsel. Other Boards members suggested that the Police Chief and the DPW Director be consulted regarding public safety. Mr. Chareth noted that the State is still waiting for a response from the Selectmen as a follow -up to the first meeting. Board recessed. At 7:45 p.m. Building Inspector Bertram Cook met with the Board and con- cerned residents from Circle M Estates in West Mansfield. The residents had met with the Board last week concerning complaints that had not been resolved. Chairman Titus questioned why the people concerned did not file a civil suit. After discussion of possible code violations, residents said that they wanted to make sure that the town had done as much as it was responsible for before they considered that avenue. As part of the same motion, the Town should find out who owns the strip of land between the state layout and the private property within the Casa Drive subdivision and ask the owner to donate this land to the town and the town might beautify the area as a small park; also, the town should get a petition of support from the residents for the above recommendations. The motion was seconded by Selectman DeLong, and voted 5 -0.
