Their office is located in the Marion Town Hall and the Marion Selectmen have voted that the Town Hall be closed on Fridays from November to March , so the use of an an- swering'service will be used for calls due to the Friday closing. Selectman DeLont commented that Mansfield Town Hall should go on a 4 -day 40 hour week. A memo was noted from the Town Manager regarding Town Meetings and requesting that members of all town boards and committees not schedule meetings to con flict with Town Meetings so that quorums can be attained. A letter from the Town Counsel was noted requesting to meet with the Board in Executive Session next week at 7:00 p.m.. Request granted. Notice of a Public Hearing to be held by the Planning Board on December 12, 1979 was noted on the Mansfield Subdivision Control Regulations. Robert Mangi.aratti- Fairfield Project Bob Mangiaratti, Chairman of the Downtown Advisory Committee, introduced Mr. Robert Bowditch of the MB Group Developers and Emmanual Daskalakis, Architect of the project. The MB Group noted Mr. Mangiaratti were the final selection of 'three proposals being considered. The MB Group has an excellent record of achievement in building and maintaining their projects all through- out New England, Mr. Mangiaratti also feels that this project willibe a cornerstone to the revitalization of the Downtown area and also thanks the Board of Selectmen for all their supporti Mr. Bowditch noted that they are delighted to have been selected and feels that the Committee did a. very accurate'job in selecting their choice, Mr. Bowditch also praised the Committee's work and noted that it is unusual to find one that was as dedicated in their work as they are, they had input in the project from the first proposals to the final requirements the second time around, they did an exceptional job. The meeting was then turned over to Mr, Daskalakis who showed site plans and the development. The basic design problem was how to design a project for the maximum benefit of the Town and also retain the scale of the downtown area. The project would consist of 2 and 3 story buildings, 100 units for 55 years and over. Buildings;fronti'ng on East and No. Main Street would be two stories with a formal entrance off of East St. to the center of the project. The site plan allows them to use existing trees as focal points, finishing material will be wood clapboards painted or stained. There will be 5,000 sq. feet of com- mercial space near the main street designed to primarily take care of the building , there will be plenty of parking space, Selectman flahana commented that he is very pleased that just a couple of years ago people were saying sell it for $4,000 to $5,000 and how lucky the Committees its to have had Bob Mangiaratti to guide them throughout the project. -3- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting December 5, 1979 Page 4 Mr. Bowditch noted that the taxing process will hbethe customary approval and done according to the Board of Assessors of the Town of Mansfield, no short cuts, it is expected to generate: about $58,000 per year.. Selectman Caponigro reiterated what Selectman Mahana said and that this ,Group is the one that he had selected in his own mind and also gave praise to the Downtown Committee for the work that they have done. Selectman DeLong questioned if this project is 'restricted to 55 years and over and if so, is there a reason for this? Bob Mangiaratti noted that the Town Meeting vote was to plan this project for 55 and over, Mr. Bowditch noted that this is the restrictionf that the Town has set. Selectman DeLong ques- tioned if this 55 years and over is limited to income level and it was noted by Bob Mangiaratti that 250 of the project will have rent subsidized and re- quire income restrictions, the remainder will be open to anyone. A location for a new Drop-in center was discussed because of the fact that the Council -Of -Aging was disappointed that this was not included in the'final proposals. It was noted that since this is a private development the area has to be devoted to the people living there but there will be a facility such as a recreational room that will be available to them. Selectman Avery then questioned what type of surface there will be on the East St. entrance, Mr. Bowditch noted that it would be asphalt, Selectman Avery mentioned that red brick would be nice. However, this is not ruled out noted Mr. Bowditch although it is more expensive. The Downtown Committee will be involved in the final stages of building and changes can be made. Construction and financing of this project will be under the National Housing Act with all units qualifying for Section 8 rental assistance. The developer will also furnish fees, deposits and other customary costs required by the Town of Mansfield, HUD, MHFA and other agencies for the construction of this project. Bt- Monthly Meeting Airport Commission- Larry Pigeon, Chairman met with the Board and noted that nothrng new as appened since the last report but would be willing to answer any questions the Board may have on the correspondece received from the FAA. Selectman Avery noted that since an opinion has been requested from Town Counsel, we should wait for his ruling. Larry was asked if the complaint was followed up regarding the night flights? The Town Manager noted that he took the letter down to Leo LeFort for him to follow up, Leo told the TownManager that there are no flights after dark, scheduled, however, flights do come in after dark. The Town Manager will get in contact with Leo to find out if he has made contact with the person making the complaint. Historical Commission - Chairman Dave Loving reported to the Board that his committee is still in the midst of getting started and is currently surveying cemeteries. There are eleven recognized cemeteries in Town, another small one on Reservoir St. that they have not be able to locate and also a small private one on Gilbert Street, not the Sweet one. They have alsonnot be able to locate the White Farm. The Lambert cemetery in East Mansfield is in pretty bad sh -4- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Mlhutes of the Meeting December 5, 1979 Page 5 shape, four stones are flushed to the ground with a path going directly through it. The land is privately owned by Joe Gonsolves and he is willing to allow the town to go in and fix it. The Town Manager feels that the Town should have an easement to go in there and Selectman Mahana believes that the Town does have a right -of -way. Bob Chevree is building on the property and providing a right -of -way. Dave is looking into having the Town purchase these private cemeteries , they can't be touched and don't have to be maintained, Dave also noted that there is no money available for graves. Selectman Avery asked Dave to submit a list on these cemeteries for further action to be taken. Computer Advisory Committee Howard Heaton noted that Joe McGonagle has advised them that he is ready for Phase 3 - Assessors', Collector's and Accounting departments, what he needs is an official go ahead and was advised that the Town Manager will be asked to send his official authorization and that the specs will be drawn up no later than the middle of January. The light department is 98% to where it reeds to be, the code for high tension has to be re- written. Selectman DeLong asked if we will be able to get the balance 'sheet and income statements off the computer? Howard replied yes. Selectman DeLong asked how many days after closing will we be able to get it? Howard replied 3 to 4 days no later than 10: Data for the Water Dept. is 95% loaded, with information on billing to be loaded next. Should be able to hit metered and unmetered homes, the new rate schedule will make no difference in the operation as far as holding it up. The Committee met tonight with the Board of Assessors to discuss the specifications for revaluation and computer- ization of various functions in their area. Selectman DeLong brought up the memo from Diane Dubuc regarding someone being responsible for using the computer, a coordinator, and asked the Town Manger if this has been discussed with him. The Town Manager noted that there were only two people at the last meeting he attended and this was discussed. Howard noted that ii;t`i.sthe opinion of the Committee that some organization will have to be addressed and a request for a meeting with the Board of Selectmen and the FinCom is being planned to discuss the need for an organizer, someone who knows the Town. The problem is not now, but it will be when the rest of the departments come on -line. Selectman Avery noted that he feels the problem is there now and that it should be taken care of immediately. Howard Heaton noted that the Com- puter Advisory Committee will be requesting a meeting with the Board within the next week and Selectman DeLong questioned Howard if this is when the person will be named, or should the person be named then. Howard noted that the Com- mittee will meet with the Town Manager first before they meet with the Selectmen. Regarding the LP2 Printer: The Committee will recommend to the Town Manager that he send a letter. to DBS along with a summary of problems experienced since its purchase, expressing their complete dissatisfaction with the performance and asking for a full credit on it towards the purchase of the 300 LPM printer , they will also ask credit for the monthly maintenance charge on the LP2. Council -On -Aging - Paula Fowler Kilby, the new Coordinator and Linda Martinelli, Council member met with the Board. Services provided by the center include, shopping trips, flocal errands and medical appointments on the minibus. The hot lunch program, three times a week, and a registered nurse available every Wednesday at the DIC to take blood pressures and referral assistance. -5- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting December 5, 1979 Page 6 The DIC is working under Self -Help to assist persons in filling out their forms to get fuel assistance. Recreation and Education are on -going programs at the DIC, bowling, bingo, cribbage, birthday parties, etc. Meetings with the Governor and a visit to the Department of Elder Affairs was made .during the month. The Jaycees are providing sand buckefls`: -to the elderly to keep their walks safe, the DIC is also grateful to the Rotary Club who pay for the lifeline telephone which is manned by senior citizen volunteers. The new Coordinator noted that she is planning on making some changes in the center on office space due to the noise level caused by all the activities and making it difficult to handle phone calls. The Council made it knowntthat they are very disappo(i.nted that no plans for a DIC is being considered at the Fairfield development site and asked that the Selectmen give serious thought to a new center because the present location is inadequate to carry out the needs of the elderly population. Lastly, the Council wanted to publicly.thank, former President, Delores Benson for all her help in assuming the positon of Acting Coordinator without pay until the post was filled and also that the Council is very pleased with Paula Fowler Kilby, the new Coordinator who is assuming her duties with interest and enthu- siasm. A discussion on a why plans were not considered for a DIC facility in the Fairfield development was discussed- Linda' noted that plans were supposedly drawn up by former Coordinator Margo Fisher and presented to the Board, however, the Board told U.nda that they never saw the plans. Chad Maurer was asked to join the meeting and he noted that it was true that this had been discussed and considered and in the preliminary plans this was considered, however, with the final specs a decision of the Downtown Advisory Committee was made and this was not to include this as a requirment. However, Linda noted that they do need a better place which prompted Selectman Caponigro to make a motion: to send a letter to the Municipal Building Committee and advise them of this problem requesting them to do a study on the needs and come back to the Board with a propdsal for another site or location for a Drop -In- Center. Seconded by Selectman Mahana. Voted 4 -0. Linda was also informed that the new Fairfield development will have a recreation center available for use by the public, however she noted that this was t6 be the case at Bicentennial Court and they are not allowed to use the hall. Board of Assessors - Al Turinese noted that his Committee is meeting with the Computer Advisory Committee tonight 10/W revaluation and going on-line. They are now in the process of looking over the bids for revaluation also. Classification is still a problem and all seminars being held are discUssing just how to go about it. Al noted that revaluation is two years away before Classification has to be implemented. AI also noted that the addendum recommended by the Computer Advisory Committee in the specs for revaluation is approved by the Assessors and will be part of the contract for revaluation. Municipal Building Committee - James Douglas represented this Committee. He noted that after several meetings with the architect and the Board of Library Trustess on the Library addition, guidelines have been set up and a presentation will be made to the Board of Selectmen sometime !im January- -6- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting December 5, 1979 Page 7 Mr. Douglas noted that they had a meeting with the Capital Improvements Committee to discuss the DPW building and it will be given an "A" priority rating by Capital Improvements. Recreation Commission - Edgar,'Vernon reported forathe Commission. He noted that the Recreation Director Paul Split's night program is going well, he is using the Robinson and Middle School Gyms. Vandalism is down in the park department and they are waiting for delivery of the new truck. The Committee has voted to submit an article for the Annual Town Meeting to put the Recreation Program on a self - supporting basis by a revolving account,; however, he noted this was not a majority vote by the Commission. Civil Defense- Bob Buttons noted that regarding the energy problem he met with representatives from Self -Help last night and they have asked the Civil Defense to become involved. Regarding fuel allocation, since 1974 they have been involved in this, if a dealer cannot supply oil because he is out, Bob can call the State and have oil allocated he does receive calls from time to time when people run out and has called a dea,/ler to deliver 50 to 100 gallons to this person however, he has been burnt a few times doing this and has been helped on three ocassions by the agency. Self -Help indicated that they wouldilike to have a representative from the Board of Selectmen, Fire, Police, Red Cross, Council -On- Aging, Clergy and Civil Defense. The first step would be to set up an Energy Commission and hotline in which the police station was designated for this. Twos set up a meeting with the oil dealers in the area and see who will be available on a 24 hour basis. Three- set up an Energy Bank - some people do not meet the federal and state guidelines of the $400. allocation The Energy Bank would work so that if someone needs oil, does not have the money to pay for it right away, they can call the Committee, who in turn will pay for the oil, but these people will have to pay the inbney back to the Energy Bank. However, Bob noted the way this money is to be received'by soliciting it from private donations and industry. They would also like to have a Shelter set up for freeze outs and 13* tonight he is looking for the Boards guidance in this, he wonders whether or nor the Town should get iinvolved. Selectman Avery feels that this Town does not need anther agency. Bob Buttons noted that he has mixed emotions because of other problems that he has runiinto. One being the money kept in a bank account, who will be in charge of it? Two, soliciting funds from the business community . Selectman Caponigro feels that the Town Manager and Bob should get together and settle it. Selectman DeLong sees the need but questions'the Town getting involved. Selectman Avery feels that having the Town get involved is duplication of effort and as far as a mass freezout, the school can be used and the Civil Defense can handle this. Bob Buttons noted that they have not yet received the School's Emergency Operations Plan and that the State is getting after him. The Town Manager :noted that he will again contact them tomorrow on this and request that they send it immediately. BOARD OF HEALTH - Meeting with Howard Winsley and Nancy Roncetti of the State Department of Public Health regarding the hiring of a Sanitarian for the Town was held. The Board of Selectmen requested additional input to show that the request is a necessary function. Mr. Winsley advised that this could be a joint program. He was aware of the situation last year and its' failure. This year he became involved through com- -7- BOARD OF SELECTMEN /LIGHT COM14ISSIONERS Minutes of the Meeting Decembe5, 1979 Page 8 plaints that came through his office from citizens in Mansfield regarding Health Complaints not being followed -up, by the local Board of Health. Mr. Winsley came to the Board to discuss problems and needs for assistance. The Board of Health, noted Mr. Winsley, is the most powerful agency in ahy eommunityy they -are morerpowerful than your Board (Selectmen). They are responsible for the health, lives and safety of the citizens of Mansfield. They are mandated to uphold certain statues in'dealing with the community and failure to do so can result in court action. The majority of the work that they have to do, they don't have the knowleged and need the help of professional assistance. These are in the areas of sewerage, dealing with solid waste. The landfill is on its' last legs and soon will' be filled to capacity, a new location has to be found. Industry can no longer use your landfill and someone has to work with them to find the proper site and to handle any problems with toxic waste. There are housing problems, the sanitary code spells out what types of inspections should be made. The staffing of your Board of Health does not allow for this, the full' time person that you have is not available to the Board of Health, problems cannot be dealed on a one to one basis and follow -up is not adequate. Once a violation is found, it has to be followed -up. There are also major problems with inspec- tions, restaurants, cafeteria's,ccaterer's coming into Town, schools, etc. Mr. Winsley noted that he does not see how a part -time person can handle all of this, which is how it is done now 4 times a year. Violations found are not dealed with on a one to one basis, just through written correspondence , v'iolationslfound as a result of these inspections must be followed -up right away, not three to four months later. This is a very real problem that needs to be addressed. 4 Also another very real problem are the nuisance complaints, such as the recent pigeon problem. These have to be handled by the Board of Health. The Town is leaving itself wide open for law suits due to failures of the Board of Health. Because of all these responsibilities they cannot even address themselves to citizen immunization programs, lead paint poisoning, etc. These are some of the very important things that the Board of Health should be doing and they don!t have the manpower, it is time Mr. Winsley noted that Mansfield move into becoming more professional int'the area of the Board of Health. The average salary,,for a Sanitarian is $12 to $15,000 per year with a Bachelor's degree; Mr. Winsley noted:'that he would like to see the communities regionalized but here in Massachusetts he cannot see this happening. There1 s one such regional, system in Nashoba. They have a membership of thirteen communities- This allows them to maintain their own Health Board. There is a possibility if we are willing to go regional that we can get assistance Idealy,,,we could go with Foxboro, since they are in the same position we are. Selectman Mahana noted that the Board of Selectmen has taken the regional ap- proach with the 128 West Resources and the Waste Water Treatment Plant. They are also a member of GATRA. Selectman Mahana noted that he would like in writting from Mr. Winsley statements that he made here tonight in order to present them. to Town Meeting . Mr. Winsley noted that he has made the Board of Health aware that he would be available for Town Meeting. Selectman Caponigro noted that he agrees with everything Ghat Mr. Winsley has said tonight and that years ago the Selectmen were the Board of Health , but feels now that the Town needs a full time person. The septic permits would pay for one -third of the man.Ss salary. -8- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the igeeting December 5, 1979 Page 9 Selectman Mahana noted that one of the advantages of going regional is that there would be a wider range of services available. Howard Winsley felt that in the long run it would cost more not to have someone to handle the problems. You need someone to put sometime into this. There were three or four sub - division plans before the Board of Health tonight and they have to stay right on top of this. Selectman Avery noted that he was hearing two approaches: 1. would be regional, 2. that the town go it alone , going alone the town will not get' any assistance and qsked Mr. Winsley what he recommended , regional or alone, considering all the problems noted tonight and the size of the Town. Mr. Winsley feels that we probably could use a full time person and this could also be done on a regional type of set up. Could probably use one and half persons , one full time Health Agent and one part time Sanitarian. Selectman Avery noted that he does not quarrel with the need, we are certainly not. the only town facing these problems and questioned Mr. Winsley as to how other towns are handling this problem . Mr. Winsley noted that Norwood has a full time Sanitarian, Can -bon has none, Belchertown and Wareham on working on this. Mr. Winsley notdd that he is having a hard time giving money away. Most towns are not doing anything . Selectman Mahana asked Mr. Winsley if he has approached neighboring towns; Mr. Winsley replied that he has not done this because of the staffing of his office, but has heard through the grapevine that Norton may be interested and heard also that Sharon is not. Karl Clemmey noted that the Town Manager and the Board of Health has already gone to Foxboro and Norton , that the Town Manager has done all the work and should get the credit, Karl noted that he would like the state representative to explain how the Town will get reimbursed? Also that the Board of Health received over 600 complaints and only two of them were referred to the State. Mr. Winsley stated that the reimbrusement is 60,40 and 20. He did note that they are not sitting with the money in their pockets, the money is given out on a first come first serve basis. Selectman Avery questioned that if we have a Town Meeting in :April and'ask'you to come; can you say at that time that the money is there . Mr. Winsley replied, yes, he can at that time, but cannot say at this point that the money will be available. Karl Clemmey noted that the Board of Health just wants to go with one other Town. Selectman Caponigro feels that there is a need for a full time Sanitarian. Mr. Winsley noted that the Board of Health should be policy setting not out doing inspections on Saturdays and Sundays and should be able to rely on professional staffing. The Town Manager noted that he spoke to Foxboro today and that they are still interested . The only question is who would appropriate the funds. One town should be the administrator of this. Selectman Avery questioned how the two towns would work out the problems such as benefits. Mr. Winsley noted that he was not sure how that would be worked out and felt itwouilldl6iDt %be -too. big a• problem and would get back to the Board on this. U BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting December 5, 1979 Page 10 Karl Clemmey noted that the problem with going with Foxboro would be time schedule and car, and gas problems, he feels that the Town is big enough and ready for a full time person. Karl said that he would like to see the Board of Health, Finance Committee and the Board of Selectmen sell this at the Token Meeting. Mr. Winsley felt that it could be brought out at Town Meeting the income that is coming into the townfrom perk tests, sub- dlvisions. Karl noted that the Board of Health has already spoke with the Finance Committee on their budget and has sent letters to them. It was left that the Town Manager will meet with the Finance Committee and the Board of Health to discuss this further. World War 2 Scholarship Fund - Sandra Levine representing the Committee met with the Board and noted that the Committee has held its' two yearly me- tings. Last year 45 scholarships were awarded totali.ng;$4500.and it won't be know until February y 1980 the final financial end of it, because some students do not continue and unless they go back the second semester, they don not receive it. Sandra noted that she had new forms drawnnup , one a Scholarship Certificate, sent to the Schood itself and the other a form to be filled'out by the student. The next meeting scheduled by this Committee is next May. COMPARK Committee - Selectman Mahana noted thattthe last meetting he attended with GATRA was in Rehoboth and through a lot of arguments and debates, plus another obstacle throtarnsin their Oath he let them know of his displeasure. However, they have agreed to forward the request for improvements without the signing of the lease agreement with the MBTA. Selectman Mahana noted that he had a meeting last night with his Committee and they went over the lease agreement and will probably within the next 2 -3 weeks reach an agreement.. Town Manager's Report The Town Manager noted that the repair shop problem on Pratt St. has been turned over to Town Counsel , Selectman Avery noted that this was turned over to him 8 weeks ago. The Town Manager noted that he understands it has been filed for - court action. The Town Manager noted that the Civil Service list has been released, with nine names on it for 3 positions. The Chief is now in the process of setting up inter- views. The Town Manager was asked how many of the applicants are from Mansfield, and he noted that he did not know. The Town Manager also noted that the Sergeant's test was held, one passed but is not being promoted and he, is appealing this decision. Selectman De Long questioned the Town Manager if you can go out of the department to hire a Sergeant and he noted he could see no reason why this can't be done. The Back Bay Brook is underway with no problems , the Town Engineer has spoke to Mr. Lamarre on Pleasant St. , Selectman Mahana noted that what upsets him is that no one approached Mr. Lamarre. until last Thursday. The Town Manager noted that he -10'- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting December 5, 1979 Page 11, 1979 was told.by' the Town Engineer that Mr. LaMarre was told before this time. Board Reports. Selectman DELong noted that he would like the Town Manager to check with the Conservation:Commission about stream cleaning, he does not think that this has been done the past four years. Selectman De Long questioned Grace Genatassio.,who was in the audience, on the 128 West Resource Revovery Committee and the fact that he read Plainville is being considered for a facility. Grace said that the last meeting she attended was in Wellesley in November , they still have not been able to get the STate to make a committment and Stoughton is not yet committed.
