Cable T.V. --
The Board heard a presentation from two companies interested in bringing Cable
T.V. to the Town of Mansfield. Colony Communications and Rollins INc.
Colony Communications presented their application, Form 100, which is a request
for a new license and Cable T.V. franchise. Jack Clifford, President and Joseph
M. Langhan, Staff Assistant were present and updated the Board on their back-
ground. Colony has a headquarters in Providence RI, with 38 franchises in nine
management groups, operating in six states in the U.S., mostly the Massachusett's
and New York area. They also have the only franchise in the RI area. They have
been in business for eleven years and tonight have presented their application,
Fomni00, for Cable T.V. franchise:in this community with the intention of install-
ing a modern Cable T.V. operation.
Selectman Avery noted that in reading over the material it is noted that there
are a series of hearings that have to be held. Mr. Clifford noted that the
licensing process may be initiated by the issuing authority by filing an appli-
cation or by the filing of a petition by registered voters, then within 60 days of
receiving the form a public hearing is to be held. It the community wants it,
1 then they must proceed with the franchising process, soliciting applications
from cable operators and have 12 to 18 months to approve or disapprove applicants.

Then another public hearing must be held to assess the qualifications of each
applicant. Following this hearing and within a reasonable time the issuing
authority must simultaneously approve or disapprove each applicant, and at
that time may issue a provisional license to _the approvedapplicant,.. After
receipt of a provisional license the successful applicant has specific time
frames within which he must accomplish several functions. Upon completion of
the many requirements by the successful applicant the issuing authority must
issue a final license.
Selectman Avery then questioned Mr. Clifford on some of the problems and merits
of application Form 100. Mr. Clifford noted that Mansfield would be one of a
group of five communities involved and that No. Attleboro would'be the headend.
Other problems which may inhibit the extension would be railroad and highway
crossings which would necessitate in the successful bidder negotiating for
rights of ways, however, consideration is also given in cases where it would
be, too costly to be economically feasible. Sections with underground utili-
ties will also cause problems, this type of right -of -way permission is usually
difficult and time consuming but usually obtainable, easements and permission
from property owners are needed in order to enter onto private properties.
Selectman AVery questioned Mr. Clifford if a certain percentage of subscribers
are needed and Mr. Clifford noted that 400 of the town's population would be
sufficient and so far they have not had a franchise that has hot been successful.
Selectman DeLong questioned what revenue the town can realize from something
like this. Mr. Clifford noted that they will not have a permanent headquarters
in the town so there will not be anything realized as far as tax revenue but the
town will receive 50C per year per subscriber plus rental for the use of the
poles in town.
Mr. Clifford pointed out that there is absolutely no cost whatsoever to the town,
only the person wanting the service pays, plus the company providing the service.
Full cost of the maintenance falls on the cable company. The cost of the service
to the homeowner ranges from $7 to $16.00 depending on what type of programs he
wants. (per month)
Rollins, Inc.
Attorney Michael Duggan and Richard Hubei were present representing Rollins, Inc.
and noted that they did not have with them tonight a formal application, but did
give the board information on their background.
Rollins Cablevwision.is a division of Rollins, Inc. headquartered in Atlanta, Ga.
Rollins, Inc. is a multi - million dollar company specialized in residential con-
sumer services, Rollins operates two cable television systems, serving over
85,000 customers located in Wilmington, Del. and Branford, Ct. and holds the
franchise for RI service area #1 which includes Woonsocket, Central Falls,
Lincoln, Cumberland, Smithfield, and No. Smithfield.
Selectman DeLong questioned what their fee would be vs. Colony and Mr. Hubei
noted that he is not sure but that it could be negotiated. Selectman Delong
noted that what he is fishing for is "how do we choose "?. Mr. Hubei noted
that once the hearing is held to go ahead with the licensing process, sealed
proposals are requested for conpetative bidding,

Further questioning continued on the operation of cable t.v. once the contract
has been awarded. It was noted that cable t.v. programs pperpte. every day with 14 to
16 new movies every month, no contracts'to sign, and a person can disconnect
anytime.
Selectman Mahana then asked the Town Manager to see if he can get information
on other companies that are in the business. Mr. Clifford of Colony noted that
the Cable Commission will do everything in their power to explain anything that
the Board wants to know, it is their job to explain the operations of cable t.v.
Also, Mr. Clifford noted that he operates out of New Bedford and Fall River and
invited any of the board members to go down and see their operation, the office
is open 8 to 5 every day.
Selectman Caponigro asked what would happen if only Mansfield wanted it? Mr.
Clifford noted that their proposal if for the five (5) towns, so it is all or
nothing. Rollins, Inc. noted that they would like all five but could possibly
handle just Mansfield because of the fact that they operate now in Woonsocket,
not that far away.
The Board then decided that they would hold a public hearing and on a motion
by Selectman De Long, seconded by Selectman Caponigro a public hearing will be
held on Wednesday, January 9, 1980 at 8:00 p.m. Voted 4 -0.
Light Commissioner's Meeting
James Hall, Director and Geraldine Lemieux,Bookkeeper met with the Board.
Mr. Hall noted that the rate study should be finalized by Wednesday. R.W. Beck
and MMWEC officials are now preparing a budgetary cost of purchase power for 1980
because of the many mixtures we buy. Mr. Hall noted that he does not antici-
pate a change in the rates, just in the fuel adjustment charges. Selectman
DeLong questioned Mr. Hall as to just what we get out of this rate study? Mr.
Hall noted to make sure the fuel is covered , they did a year comparison study
from October '78 to October '79 to see if we were recovering and it has been
determined that we were not charging enough for fuel adjustment. It was also
noted that there has not been a rate change since 1975, that the department has
been running on that same rate since then. Selectman Avery asked Mr. Hall if
he had any idea on what the percentage of increase would be because of fuel and
he noted that OPEC is having a meeting in January and'he. would never project.
Mr. Hall noted that the Bristol Arm.feeders are 990 .done, two splices are to be
made and the final taps to be made, and his men will not be working anymore
overtime. The state will cover the $100,000. for the feeder cable out of Gilhert
Street, and there is still 10 more miles of feeder to be installed.
Selectman Mahana then questioned Mr. Hall regarding Bristol Arms installing their
own meters? Mr. Hall noted that they cannot do this, that they are not a utility
co. and wouldhave to go before the Department of Public Utilities.
The Board then discussed in length Christmas Lights for the commons. There was
only $1.00 budgeted for Christmas Decorations this year.

After a lengthydiscussion with the light director present Selectman Mahana
and Caponigro volunteered to decorate on Saturday and hopefully someone would
volunteer to drive the bucket truck.
Mr. Hall noted that he had a call from a Mr. Gruhn representing the Common-
wealth of Mass, noting that the state is willing to install street lights on
a section of Rt:1140 about 1' miles long and that the Town will be asked to
assume ownership and maintenance after the installation. This was approved
by the Board of Light Commissioner's on a motion by Selectman Caponigro,
seconded by Selectman Mahana. Voted 4 -0. Mr. Hall, however, noted that he
will draft a letter to Mr. Gruhn requesting that they install the same type
of lighting that we have.
Mr. Hall noted that the air - conditioner for the computer room has been delivered
and he has to get together with Thom Bonome and a plumber for the installation,
it was decided that they would put in a dry well.
House Moving - Home Coal Co.- Woonsocket, R.I.
Henry E. Pouliot, President of Home Coal, INc. met with the Board due to a
problem with back bills owed to the light department and a pending house moving.
Mr. Pouliot noted that these bills date back to 1977, at that time the people
were told and it was part of their contract that they would be responsible for
all utility bills. He noted that he did receive a bill from the light depart-
ment and forwarded it to the people whose 'house he moved, that is the last time
he heard anything about it, until how. Since that time the Board has adopted
a new policy -that the mover is responsible for all bills since he is the one
who is requesting permission. The Board decided to grant permission for the house
moving since this happened before the new policy went into effect and bill the
people whose houses were moved for the balance due. A motion was then made by
Selectman Caponigro to grant permission for the move subject to Home Coal being
responsible for the electric bill in this new move and that no trees be cut with-
out approval of the highway foreman. Seconded by Selectman DeLong. Voted 4 -0.
Whitman & Howard- -Water-Rate -Study - Arthur Stockus and RogerLbpton.of Whit-
man & Howard met with the Board.
Roger noted that data was taken from the water meter books and ran through a
computer in order to figure out the consumption. The proposed improvements
will provide practical and feasible development of Mansfield's water supply
and distribution system which will be necessary in order to meet expected water
demand requirements for the year 1990. The cost of the system operation and
maintenance along with debt service are distributed among the classes of users
in an equitable, accepted way. Hopefully, through this study the rates that have
been developed will bring in revenues adequate for operation and maintenance
of the system . People using the water would be charged along with private
fire protection being included in the water bill , public fire protection charge
will be added to the taxes.
Roger noted that there is a 35% water loss, that he has no idea where this is
being lost, could be leaks in the pipes, homes not metered, etc.

Discussed also was the bonding for the project in which the town would save
an estimated $1 million by putting all the water needs into the same bond issue
over the next 10 years which would include upgrading of Well #2, construction
of pipe and construction of a 3.0 million gallon storage reservoir on Foolish
Hill. The bonding will be done through Farmers Home Administration. . There
will be three bonds, one fifteen year bond, one twenty year bond and one bond
for twenty -five years., Cost to the average homeowner with the bond issue would
be $128.00 with future debt service vs. the phase in method of $214.00 yearly
Arthur Stockus had with him tonight an application for the bonding through the
Farmer's Home Administration and noted that he usually hears back from then
in a couple of weeks . A motion was made to have Chairman Avery sign the loan
application for bonding through Farmer's Home Administration by Selectman
Mahana, seconded by Selectman De Long. Voted 4-0.
The Board also made a motion to instruct the Town Manager to have Whitman &
Howard proceed with the testing and rehabilitation of Well #2 , motion by
Selectman De Long, seconded by Selectman Caponigro. Voted 4 -0.
Arthur then wanted to know if the information presented to them tonight was
clear enough for them to understand , all agreed that it was, Arthur noted
that a finalized copy will be sent to them in about 2 -21 weeks.
Selectman Mahana questioned the way Table 7 was figured out jumping from a
consumption rate of 10,000 to 20,000 when the average consumption is 12,900.
why was it not figured out in the 10,000 to 12,000 range. The finalized copy
will have a refigured schedule for Table 7, Mr. Stockus noted.
Fire Dept,
William Sarro met with the Board regarding the Special Town Meeting on November
19th in which a quorum was not reached. Bill wanted to know why the Town Meeting
was postponed indefinitely and that they are very unhappy with that, so tonight
they are requesting another special be held on Monday, January 21, 1980. If the
Selectmen refuse to call it they will go ahead and get the required 200 signatures.
Bill noted that the reason a quorum was not reached on November 19th, is because
of the many other activities going on that same night in the school department,
at the Town Hall and also a sports event was held that night.
A motion was made by Selectman Caponigro, seconded by Selectman Mahana to call
a Special Town Meeting on Monday, January 21, 1980 at 8:00 p.m. at the Mansfield
High School Auditorium, on an ''Article to raise monies for the Firemen's raise
plus all the other articles that were included in the last special. Voted 4-0.
Bill Sarro questioned that if a quorum is not reached at this next special, can
the money be taken out of the reserve fund and Selectman Avery noted that as a
former member of the FinCom he said he did not think so, the Reserve Fund is
for unforeseen expenditures.

The Board brought up a discussion about the Roast that is being held for John
Prescott on Friday night, and noted that Al Turinese was wondering if some sort
of a plaque could be presented to him from the Town. It was noted that we do-
have plaques here at the Town Hall and so a motion was made by Selectman
Caponigro that a plaque be given to John Prescott, properly inscribed that he
served the Town for 50 years in various positions, included in this motion is

desires for a recreational facility.
A letter was noted from Town & Country Transportation and Leasing Corp. re-
garding damage to the school buses which are parked in the Town yard. In the
letter they are requesting more protection,- either more police patrols are
installation of a fence around the area (highway barn). Selectman Mahana noted
that he has stated a million times , that a fence should be put up , he also
spoke to Bob Saquet about this. The Board noted that it is not up to Bob Saquet,
it is up to the Board. Selectman DeLong, questioned what the cost of the damage
is so far this year, that he would like to know. The Town Manager did answer the
letter informing Town & Country that police patrols in the area have been in-
creased, and also that they might consider the services of a security agency.
The Town Manager noted that he will call Town & Country and get an estimate on
what the cost of damages have been to date.

store an additional 20,000 gallons of N2 fuel oil. A hearing is necessary and
the Board approved December 12, 1979 at 8:00 p.m. as the date of the hearing.
Town Manager's Report
The Town Manager noted that he had the results back of the sample taken from
Fulton Pond on the mysterious "soap suds" floating on top. The results indicated
a trace of detergent and no pollution problem.
The Town Manager noted that he spoke to the building inspector regarding the
wood pile on School Street: A discussion followed on this by Selectman Mahana
regarding the zoning -by -law and he interprets it to read: that we did not
intend for him to not cut and stack wood but he should not be able to bring it
in and stockpile it. Selectman DeLong disagrees, noting that the by -law does not
say that he can't do it, also that this is agricultural land. Selectman Avery
noted that he agreed with Selectman DeLong in the beginning but now feels that
it is getting out of -hand. Selectman Mahana requested that the Town Manager
speak to Town Counsel on this.
The Town Manager noted that he is in the process of doing the budget and is
meeting with department heads. Also, that there is a Capital Improvements
Committee meeting tomorrow night.
A Conference on Cable T.V. will be held on Saturday, December 8, at the Newton
City Hall for anyone wishing to attend, donation is $1.00. The Town Manager noted
that he will be attending.
The Town Manager noted that he has two boys from the S.E. Regional School on a
co- op.,program, work 2 weeks, school 2 weeks. This could not be funded under
the CETA program so they are being paid by the Town at $3.70 per hour, the program
is to last about 6 weeks. They are here to help the Town Engineer in drafting
and will be working on the Back Bay Brook, as built drawings, the bridge on Oak St.
etc..
The Back Bay Brook project had some problems with vandalism to equipment left
overnight; in the amount of $1000. , but the project itself is going well.
A request has been submitted by town employees to swap the Martin LutheH.King day
January, for the day before Christmas. This was approved by the Board.
Board Reports
Selectman DeLong noted that he would like to see a new form printed up for ap-
plicants making our applications to,serve on town boards and committees, so that
there is a place on the form for them to list -their background.znThe Town
Manager noted that he will discuss this with the Town Clerk.
Selectman Mahana noted that the grader did go to King St. as requested to level
off the street, however, it only did half the street, the half from King St. to
No. Main was not done. The Town Manager noted that he will inform the highway
director of this.

Selectman De Long referred back to the information received from the Mass.
Municipal Associaton on the State Ethics Commission's municipal disa, losure
proposal, requiring public disclosure of certain interests and associations
by key officials and employees of cities, towns and certain special districts.
Selectman Caponigro noted that it does not bother him, but would vote against it.
Selectman De Long noted that he feels non -paid offia,i,alp.should be.exempt.
Selectman Avery and Mahana made no comment.
Selectman Mahana wanted to know, if anything can be done about people stopping
at No. Main and Thomas St. to wait for the light before turning left onto
Thomas St., also if anything can be done about the problem at No. Main and
106 where right turns are being made from the middle lane.
Selectman Mahana noted that Mr. LaMarre, 99 Pleasant St. is still upset over
the fact that the town has not approached him regarding the Back Bay work
and his land being trespassed on. The Town Manager noted that the Town Engineer
spoke to Mr. LaMarre and told him that the town owns the land and it is not his.
Selectman Caponigro noted that he spoke to Mr. Beggs today, and the work on the
WW-2 monument is almost complete and that his next project is the West Mansfield
monument, he also wanted to know who was going to complain to the Rock of Ages.
Selectman Caponigro noted that before Mr. Peck died he left the bank book with
him and he would like to see something inscribed on the back of the WEst Mans -
field monument in honor of Bill Peck.
Selectman Caponigro noted that money should be put into the budget-this year for
painting the outside of the Town Hall building, other town buildings and the rails
on the underpasses.
Selectman Avery noted that he asked Chad Maurer and Ken Parsons to come before
the board regarding the letter that the Town Manager received from Margo Jellinek
on various charges she made against Chad Maurer. Selectman Avery asked the
Town Manager where it now stands. The Town Manager noted that he asked Chad to
respond to the various charges: in a letter and this is what he had told Margo.
Chad noted that several acqusations have been made against him in reference to
his conduct as a Planning Director, especially the Circle C Subdivision. The
allegations that she is referring to is the action taken by the Planning Board,
so if there is something wrong with it, he is not responsible. Mrs. Jellinek
is claiming that the covenant on the Circle C was allowed to!ezpire without se-
curing some legal arrangement to complete the work. Chad noted that the
covenant can be released by posting securities, which was done.
Mrs. Jellinek is also questioning the development of lots on Bird Road, which
i,is an unaccepted street. Chad noted that last year he wanted an article in
the town meeting to have the road abandoned and Town Counsel ruled against this
because it is a county way and could not be abandoned, also this past summer
while he was on vacation the Planning Board approved the building of some lots
on Bird Road so he should hot be held responsible and that the town still has
control and the applicant must obtain a building permit. However, before a
building permit will be granted by the building inspector paved roads and proper
drainage will be required. The sinking of a well will need approval from the
Department of Public Health as well.

Chad noted that he feels that any information he gives to the Planning
Board is in the best interest of the town.
Selectman Mahana noted that he thinks that Margo is construing Chad's re-
commendations as directives and not recommendations.
Ken Parsons noted that he finds her remarks very much out of order. On Circle
C, the Board followed that to the very end, ran into many problems and recently
threatened to foreclose on the bond, but tonighiheard that the work will be done
by Spring, and also feels that the town always had the upper hand. The ap-
proval of the form A application for Bird Road was bad timing with Chad on
vacation because they thought it was an accepted street, and feels that the
way it is being handled now, not issuing the building permits until all the
requirements- are met is the best way.
Selectman Avery noted that this letter was directed to the Town Manager and
the Planning Board has taken Chad's recommendations in good faith and they
have acted in good faith but the letter has to be answered as Town Counsel
said, he also agrees with the statement that the Planning Board should give
their input and also agrees with what he heard here tonight and that a motion
should be made to give both Chad and the Planning Board a vote of confidence
commending them on what they have done.
Chad noted that there is no shadow over his head over these allegations, but
there is a shadow over his head for not recognizing all the work that he has
done for this town over the past years when he has to come before this Board
and answer these allegations, he would like to see a vote of confidence for
the work that he has done.
A motion was then made by Selectman Caponigro that after reviewtng the comments
from Margo Jellinek and discussing it with Chad and Ken tonight that the Board
vote to give a vote of confidence to Chad and Ken for the work that they do
and have done in the pastand if the Town Manager wants to answer the letter,
Ws up to him. Seconded by Selectman Mahana. Voted 4 -0.
Selectman Avery then questioned the Town Manager on the status of the salary
for Caroline Bregnard . The Town Manager noted that he has been working on it,
and should have some figures by next week.
The Board then discussed trying to find a superintendent for the water depart-
ment. The Town Manager noted that he would like to find a qualified foreman
for both the water and tAJTP , but has not been able to locate anyone. He will
advertise again next week for a Water & Sewer Superintend (tnt.
Selectman Avery noted that last Sunday he counted 21 cars on the Cotterill
property , and wants to know if anything can be done about it he was under
the impression that only 10 cars were allowed. The Town Manager will speak
to the building inspector about this.
