Selectman DeLong noted that he wanted to comment on the letter from Mr. Teixeira
regarding Delores Benson since he was the one who said that he . was not satisfied.
The letter does exonerate her for the use of CETA workers -- htrher home and it's
too bad that these things get stretched out,.and requested permission from Chairman
Avery to ask_a question of Delores, which was granted. Selectman DeLong noted that
he heard secondhand that Delores had applied for a professionally paid position
with the Council-On- Agi,ng and feels that it is inappropriate for an official who
has resigned to apply for the position, and asked Delores if this vial so.
Delores said that she did not apply, has no resume that she has been asked but
has not. She noted that had never intended to get off the Council but feels that
she was pressured into resigning and cannot work for a board when she does not
get supported.. Selectman Avery referring to the letter from Mr. Teixeira noted
this was the information he had asked for: but also agrees with Selectman DeLong,
Selectman Caponi, gro noted that he is also in agreement with what Selectman DeLong
said..
Attorney John Santos of Walpole representing a Mrs. Merrigan of Foxboro met with
the Board. Attorney Santos doted that his client was ready to close a sale on
a pie(n of land located on Belcher Rd. in Foxboro. Attorney Santos noted that at
the closing last week earlier plans bore the legend of an easement and when the
Bank's Attorney did not see an easement on the plan he asked if there was aawater
easement. Rim Engineering who did the surveying did not pick it up and in checking
further records :4 it was found that the Town of Mansfield rather than take an
easement made a taking and now owns that piece of land. Attorney Santos noted the
reason he is here tonight is to see if vie are actually using it and if we are if
we would grant an easement to the perspective buyers to pass over it. The buyer
said that if he can get the fee fine and he can get the easment to pass over it
fine, Attorney Santos noted that he believes we don't have a water line in there
The Selectmen told Attorney Santos that permission to passnover this will require
a Town Meeting vote and that they will also have to investigate it and see if we
do in fact have a line in there and are using it. Attorney Santos noted that he will
prepare a draft article for the Town Meeting and speak.

The Town Manager noted that he spoke with Mrs. Merrigan regarding this and
there is some urgency and wonders if we could grant the right to go over this
piece of land until it goes!to a Town Meeting. The sale of the land was to
fund school tuitions. The Selectmen feel that this should be checked out with
Town Counsel. Selectman Mahana suggested granting an easement subject to Town
Counsel's approval. Selectman DeLong and Avery noted that they would not vote
for it until they find out if we are using it and what Tom Counsel has to say.
Attorney Santos, noted that he will write to Town, Charles Mulcahy
requesting his opinion on the matter.

A notice has been received from the Bristol County Commissioners that the
County's assessment for FY 79/80 is $3,617,802.38 and that Mansfield's share
is $138,231.79.
Last weekend the light plant worked putting in the blest Mansfield feeder and
this weekend will be working on the feeder for the Bristol Arms Complex, also
they will work Sunday on the transformer for the new T.I. building in the in-
dustrial park.
The routine work performed by the highway department for the week was read by
the Town Manager.
Whitman & Howard has started work in the water rate study. Selectman DeLong
asked what the progress is on the master plans that the Town Planner is working
on. The Town Manager will check this out.
The Town Manager noted that he had a response from the Town & Country Fire
Department and they stated that what we have is a good fire department and
they would be of no good to us.
Walter Day, representing the Little League asked if he could with the Select-
men, he was not on the agend for this evening. Chairman Avery granted his
request after polling the Board. Mr. DAy noted that he had a meeting Monday
with the Conservation Commission and have resolved their differences pretty
much down but they are requesting a set of plans and he wants to know if the
Town Engineer can do it, this is the only problem that the Little League has
right now. Selectman Avery said that he works fulltime for the Town and is
now working on several plans for the Town, the Back Bay Brook being one of them.
Mr. Day noted that he nee& the plans by the end of October. The Board told him
that it would be impossible for the Town Engineer to have them by then Mr.
Day noted that the Town Engineer was present at the meeting Monday night and
said that it would take about three days to complete the plans. Mr. Day then
asked the Board if it would be alright for the Litttle League to hire the Town
Engineer on their own and pay him. The Board said that it was alright as long
as it did not interfer with his Town job.
Board Reports
Selectman Caponigro told the Board that he attended the GATRA meeting today
in Norton. The committee voted more buses for Taunton. The committee also
read the letter from COMPARK and complimented Selectman Mahana on the letter.
However, more federal funds will have to be applied for before they can enter
into a contract and if approved monies won't be available until June 1980.
Selectman Caponigro noted that he discussed the work to be done with GATRA and
if the Town Engineer can do the work we could have this deducted from our share
this cannot come from regular GATRA money. Selectman Mahana noted that the
reason he wrote the letter was because he thought it was alright under a Capital
Improvement project that the Cities of Taunton and Attleboro received and was
led to belive that action could be taken within a week. Selectman Caponigro
noted that it can't come from GATRA because they do not have the money appro-
priated.

the press if they are interested and also noted thatthe Tosco Counsel is
still in the process of doing title reseach work.
Selectman Mahana noted that road side cutting is needed on Williams and Tremont
Sts.
Selectman Mahana noted that he would like to know just how many unmetered
homes (water) there are in Mansfield. The Town Manager noted that he thinks
there are about 100. Selectman DeLong noted that there is a reason for the
homes being unmetered but can't remember just what the reason is.
Selectman Mahana wanted to know what the pump truck was doing on School St.
watering down the bridges. He was told by the Town Manager that this is
outside duties paid by the contractor and that a measured meter is put on
the pump charging the water consumption to the contractor.
Selectman Mahana questioned what the Board of Health is doing about the junk
cars and also that the wood pile on Elm St. is a health hazard. The Town
Manager noted that the building inspector informed him that the owner of the
wood piles is intending to sell it off. Selectman Avery wants to know why
the Board can't send him a letter to stack the wood. Selectman DeLong does
not agree with this.
Selectman Avery feels that we should send him a letter indicating that the
areas is an eyesore and to clean up the area. This was put in the form of
a motion by Selectman Mahana, seconded by Selectman Caponigro. Voted 4 -1
