A letter was noted from the Board of Selectmen in No. Attleboro inviting our Board to attend a meeting at the North Attleboro Town Hall to hear discussion on the possibilities of Cable Television in this area. Selectman Avery noted that since this meeting is on a Wednesday night and conflicts with our meeting, that we write them a letter thanking them for the invitation and that we are sorry we cannot attend. A letter was noted from the Town Manager to Self -Help, Inc. regarding the Hartwell School and the heating system. An application was noted for a street opening permit from Carlson Corp. who will be doing work in CC &F installing telephone cable for the new Codex building. The cut in the road will be newly paved road. Selectmen Colella moved that this be postponed indefinitely because he feels once a road is patched it is never the same. The Board voted unamiously on this and requested the Town Manager to have a representative from the Carlscn Corp meet with the Board next week. Correspondence from the Tourist Information Center on I -95 was noted. It was noted that the number of people stopping in at the Center is down compared to statistics from last year. Correspondence was noted from the Bristol County Selectmen's Association with information of the Annual Clambake to be held on Thursday, August 22, 1979. The Clambake will be held at Shdlers Pavillion, Rehoboth. A Sewer Connection Permit for William & Marie Brooks was approved to connect to the Town sewer main at 8 South Walnut St. Motion by Selectman Mahana, seconded * by Selectman Caponigro. Dog was also notified. -2- Fulton Place regarding E. Glenn. Under the The date of this Notification of the Glenn with copy of )fficer, Jocelyn Rosado BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting July 11, 1979 Page 3 ( Chairman Avery declared the hearing opened at 8:00 p.m. and requested that all interested parties in the case to come forward. Dog Officer, Jocelyn Rosado and Mrs. Glenn were the only interested parties present, none of the complainants against the dog were present. Selectman Avery asked the dog officer i the complaint was directed to him and the dog officer noted that he is familar with it and feels that it is a personality problem between the Glenns and the residents at 17 Fulton Place and that the dog is being used as the scapegoat. Mrs. Glenn was asked if the dog had ever bitten anyone and she noted that it appears he nipped at someone but now he is always tied to a tree and someone would have to come on her property to be bothered by him. Selectman Caponigro asked Mrs. Glenn if the dog barks at people or the residents and she noted that he will bark and in the past he has had beer bottles and rocks thrown at him, Mrs. Glenn noted that she knows who is doing it but it is a case of trying to catch the person. The first name on the petition listing the complaint is Joe Brown and Mrs. Glenn noted that she had to take Mr. Brown's son to court because he drove over her lawn with his car, and this is when the trouble started with her dog. Selectman Caponigro again asked Mrs. Glenn if her dog barked a lot, and she noted that he will if bothered, Selectman Caponigro informed Mrs. Glenn that a barking dog is a nuisance and if it continues something would have to be done. Mrs. Glenn noted that when he starts barking she takes the dog in. Selectman Avery noted that a barking dog is a nuisance and the neighbors have a right to complaint and that she should take him in and not wait until a com- plaint is called in and the police come. Chairman Avery asked if there were any opponents - none recorded. He asked for other- proponents - none recorded. Chairman Avery declared the hearing closed. Selectman Mahana moved to dismiss * the complaint, seconded by Selectman DeLong. Voted 5 -0. * ** Bid Awards The Town Manager noted that he needed the motion awarding the bid of the new pick- up truck for the highway director amended from $5814. to $5978. The increase of $164. is due to the necessity of up- graded tires which are factory recommended for this type of vehicle. A discussion On the style of the truck was brought up by Selectman Colella who noted that he has to answer to his constituents , his phone has not stopped ringing and they want to know if the highway director is a "racing driver ". The Town Manager noted that the specifications called for a yellow truck however, the bid was submitted with a red truck. The highway director told Old Colony that the Board's policy is that all new vehicles bought for the Town had to be yellow. The only yellow truck they had on the lot was the one we took which has racing stripes on the side and rolled bars. The cost of removing the stripes would bring the cost of the vehicle up over their alloted budget,•so the truck was taken as is. A motion was made by Selectman Delong, seconded by Selectman Caponigro to approve * the amended amount of $5978.00. Voted 5 -0. -3 BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting July 11, 1979 ( Page 4 Mini -Bus Award for the Counil on Aging was noted. Only one bid was received on this from Town & Country of Rhode Island, which was a 1979, 17 passenger bus in the amount of $15,000. The Town Manager was asked if there was enough money to cover the bid and he noted there was as follows: $2000. trade4n; $3000. Grant; $7500. from Town Meeting and $500. raised from donations. A motion was made by Selectman Mahana, seconded by Selectman Caponigro to approve * the bid for the mini -bus in the amount of $15,000. Voted 4 -0 (Selectman DeLong was out of the room at the time of the vote.) Delores Benson, President of the Council who was in the audience extended an invitation to the Board and Press to a ride on the new bus next Wednesday. evening. Selectman Caponigro moved to reconsider the motion for the awarding of the mini -bus because the figures are wrong and we are still $2000. short, this * was seconded by Selectman Mahana. Voted 4 -0 (Selectman Colella out of the room at time of vote.) Selectman DeLong moved that we accept the bid for theimini -bus for the $7500. raised at the Town Meeting plus the $2000. trade -in contingent with on other monies raised which will cover the $15,000. that it cost. Seconded by Select- * man DeLong. Voted 4 -0 (Selectman Colella out of the room at this time.) DPW Materials The bid for DPW Road Materials was noted as follows: Metal Pipe, Concrete Pipe, Bituminous Concrete, Liquid Asphalt, Highway Markings Sand, and Tubes & Tires. The Town Manager noted that the highway director went over all the bids sub- mitted and both he and the Town Manager are recommending all the low bidders. The list of bidders on each item was read by the Town Manager. A motion was made by Selectman Mahana, that we accept the recommended low bidders * as outlined by the Town Manager, seconded by Selectman Caponigro. Voted 5 -0/ Cable Bid The Town Manager noted that this cable is for the Gilbert St. Sub - station and two bids were received . Both bids were reviewed by the Town Manager and Light Plant Director James Hall. Both the Town Manager and James Hall are recommending Hendricks Wire & Cable as the best and lowest bidder. This was * approved on a motion by Selectman Mahana, seconded by Selectman Caponigro. Voted 5 -0/ * * ** Diane Mangiratti, representative for Mansfield on the proposed 128 Resource Recovery Center updated the Selectmen on the last meeting that she attended. She noted that the committee is meeting opoposition from North Stoughton residents , however of all other areas being considered, Weston, Plainville, and some other place up north, Stoughton they feel is the best place. However, Diane noted that at this meeting which at times became quite loud only about 10 residents of Stoughton were present. The Board thanked Diane for JMr report and time in attending these meetings. -4 -- BOARD OF SELECTMEN /LIGHT Minutes of the Meeting July 11, 1979 Page 5 Town Manager's Report COMMISSIONERS The Town Manager noted that he discussed the water rate study with Whitman & Howard and Camp, Dresser McKee and has been assured quotations by next week. A letter has been forwarded to all the Constables regarding identification and Badge format. A letter has been forwarded to all the necessary departments to be on the lookout for junk autos. The Town Manager noted that he discussed the question brought up on taking care of the 4lest Mansfield Common with the Fire Chief. The Chief noted that the equipment the men had broke down and they have never been able to replace it. They will be very happy to take care of it if they can have the equipment replaced. The Town Manager will look into this. Regarding whether or not we use the Mass. Municipal Depository Trust, the Town Manager noted that he spoke to Joan Cutillo on this and we do. At times we have had $450,000. deposited, now it is approximately $200,000 because we drew upon it to pay bills. Joan informed him that it is used more as a checking account with interest and used in cases of emergency because of no penalties such as would be the case if we had to cash in a C.D. etc. It is not used extensively because interest rate is 1 to 2% greater thru other investments. Also fee charge is dependent upon assets of the gust divided by the number of members and fee is taken off the interest a municipality earns, thus municipality not bharged. We would also have to share in any losses incurred by the trust fund. The Town Manager submitted a set of guidelines to be used in regulating taxis in Town. Selectman DeLong had some questions on them and the Tosco Manager told him that-he will have the Town Counsel look it over and come back to the Board again for approval. Attorney Americo Day, Town Counsel Charles Mulcahy and trustees of the Gloria Columbo Lodge met with the Selectmen. The Lodge is in the process of being sold and there appears to be a cloud in the.title and Attorney Day noted that he has been informed that Town Meeting action will be necessary to complete.this trans- action. The problem seems to be from a Twin Meeting vote back in 1955 when this parcel of land was deeded to the Town of Mansfield with conditions. The following paragraph from the Town Meeting of 1955 "If such buildings and appurtenances are not constructed by the above named lodges by January 1, 1958, the land shall be offered back to the Town of Mansfield for the price for which it was purchased." The question is trying to define just what the language meant, can the land be used for other purposed other than a lodge. Another cloud is the result of an article in 1956 to sell just the men's lodge but the actual deed says both lodges, men and women's. Selectman DeLong questioned if any of the Selectmen at the time this was being handled are still living in Town and feels that it would be appropriate for the Board to meet with these men to their intent at that time before this goes to Town Meeting. Selectman DeLong feels that there is a reason for the restriction in the deed. However,Selectman DeLong noted that he would be willing to vote to submit this -5- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting July 11, 1979 ( Page 6 as an article for the Special Town Meeting on August. 13, 1979. This was * seconded by Selectman Caponigro. Voted 5 -0. It was agreed that a letter be written to the Selectmen active during this period and who are still living in Town and request them to meet with the Board next week to discuss this. * * ** The Town Manager noted that a meeting has been schedule for Friday regarding the police department and the results from the factfinder. The Town Manager is also requesting an Executive Session for Wednesday, July 18 to go over what is discussed. Regarding Rt. 140 and Forbes traffic signals, it seems that the plans were for- warded to the State but have been lost at the state level. New plans have been submitted but they are also requesting a traffic count. A bill was presented to the Board of Water Commissioners for abatement due to only a certain amount being awarded by the court. The bill in the amount of $54.25 was noted. The court only awarded $25.00 for payment. A motion was made by Selectman Mahana, seconded by Selectman Caponigro to abate $29.25. * Voted 5 -0. A letter was noted from Delta Projects, Inc. an organization to help the mentally ill in the age group of 13 to 21 on a short term basis. The organization is looking at two sites in Mansfield, 625 No. Main and 267 Central Street. Selectman Avery noted that he would like to have them come before the Board to discuss this. Select- man DeLong suggested that they also make contact with the neighbors in those areas.. A letter will be written requesting that a representative meet with the Board. Board Reports Selectman Delong questioned hydrant testing and would like the Town Manager to get a report on how the Fire department is scheduling this in keeping with the "energey conservation" program, also a list of what hydrants are not working. Selectman Caponigro reported on the meeting that he had with the builder on the Town Hall roof and noted that the architect is on vacation and will wait until he returns before any decision as to what to do is made. A motion was made by Selectman Caponigro, seconded by Selectman Mahana to send * a letter to the gentleman putting up the West Mansfield Monument. Voted 5 -0. Selectman Mahana noted that he is disillusioned and disgusted but is determined to continue to do something about the sign on Rt. 140 at the Mansfield and Foxboro Town lines until it is removed. A motion was then made to send a letter to the Foxboro Selectmen making them aware of the situation by Selectman Mahana, seconded * by Selectman Caponigro. Voted 5 -0. Selectman Mahana also noted that he is noticing more and more signs "yard sales" around the Town on weekends and would like something done about it, he also noted that he would like a letter sent out to Mr. DiRienzo of School St. notifiying him that he has no right cluttering up the Town with signs. -6- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting July 11, 1979 Page 7 l Selectman Mahana noted that he would like to insert an Article in the Special for August 13, 1979 for $1000. to cover expenses for the Asst. Electrical Inspector and Asst. Plumbing Inspector, also an amount knot yet determined) for the third police cruiser that we failed to budget. Motion by Selectman * Mahana, seconded by Selectman Caponigro. Voted 5 -0. Selectman Mahana updated the Selectman on the "commuter rail parking "and referred to a letter from the MBTA on a recent meeting the "commuter rail committee" had with Mr. Eugene Skoropowski of the Commuter Rail Department. The letter outlines eight conditions they would like followed and one of them is that the MBTA will lease the three MBTA owned parcels to the Town of Mansfield for $1.00 per year, however all maintenance, improvements and lighting will have to be carried out by the Tom of Mansfield. Selectman Mahana had a map of the area and pointed out areas that could be utilized for commuter parking. There is a parcel of land near the Bay State Tap & Die that is questionable as to who owns it, the Town or Bay State. Selectman Mahana noted that this parcel is very important to the whole project. GATRA will also have to play an important part in this in getting funding for the project. Also discussed was charging a parking fee possibly 50¢ a day . The project has taken longer than Selectman Mahana had hoped and a lot more work has to be done. Selectman Delong noted that Selectman Mahana deserves a lot of credit and he takes his hat off to him. Selectman Avery moves that the Warrant for the Special Town Meeting on August 13, 1979 be closed, seconded by Selectman Caponigro Voted 5 -0. Their being no further business, the meeting was adjourned at 10:00 p.m. -7-
