Avery, Robert M. DeLOnq, David R. Clemmey and Antonino Caponigro, Jr. Town Manager William P. Metropulos. The meeting was called to order at 7:45 p.m. The continuation of the hearing held last week was the first item of business. This hearing is in regards to no- parking in the following areas: Route 140 (Copeland Drive) on both the east and west sides of the street from West St. northerly to the Mansfield /Foxboro Town lines. Route 106 (Chauncy St. Extension) on the northerly side of the street from No. Main St. to a point 400 feet from the No. Main. St. intersection. Because of the businesses in these areas it was felt at last week's meeting that a letter should be sent out.to all involved. Letters were sent out to the managers of Fernandes Supermarket, Copeland Dr., D'Angelo's Sub Shop, Copeland Dr. and Kowzie's Diner, Chauncy St. Ext. advising them of this hearing. Selectman Delong declared the hearing opened and asked if there was anyone in the audience that had anything to say. Police Chief D'Afile noted that the reason he is recommending no- parking in the area of Rt. 140 (Copeland Dr.) is because of the danger with trucks parking on both sides of the street. He is recommending no- parking from West St. up to the Mansfield /Foxboro Town lines. Selectman Delong asked if there was anyone in the audience to speak regarding this area. Two gentlemen were present from D'Angelo's and one of them identified him- self as the manager. The manager noted that there is parking at D'Angelo's for their customers but that the big trucks park out on the street, he admits that it is dangerous but also feels that this may slow the traffic down, especially the cars coming off 95. However, he noted that since there are no driveways from his place up to the entrance of CC &F maybe there could be parking on this side of the road only. Selectman Delong asked him if he thought that this no- parking would adversely affect their business and he said no, that they only have 10 to 12 trucks a day. eat He went on further and noted that people pulling4from their parking lot have a hard time with the cars coming off from 95 doing 50 to 60 mph. He noted that this was confirmed because radar was set up one of the holiday weekends and people were being pulled over. The Police Chief at this time noted that the recommendation of parking on one side only would not work because this side of the road eventually goes into a two -way lane as it approaces the lights. Selectman Delong asked if there was anyone else in the audience who wanted to speak regarding this area, no one else spoke up. -1- BOARD OF SELECTMEN /LIGHT Minutes of the Meeting January 24, 1979 Page 2 The next area to be discussed was the Rt. 106 (Chauncy St. Ext.) near Kowzie's Diner. Air. & Mrs. Kowzie were present for thjs hearing. Mr. Kowzie wanted to know what brought this up and Selectman Delong noted that it was a result of the police chief's obervations. Mr. Kowzie agreed that the trucks do tend to slow traffic down, and this no- parking ban will affect his business by 50%, his cus- tomers could :.use the Globia Colombo Hall parking lot for now, but this is up for sale and its future is not certain and cannot be depended on. Mr. Kowzie also noted that the bank across the street causes a lot of the confusion. Selectman Delong asked if the bank was notified of this hearing and was told no. Selectman Clemmey noted that he feels the big problem is that the road narrows down at the lights and with the trucks parking on both sides it narrows the road more. Selectman Caponigro asked the Chief if there have been a lot of accidents in that area and the Chief said that he could not say there have been a lot of accidents right there, probably at the intersection of the lights. Mr. Kowzie noted that he could see the concern if there have been a lot of accidents but he has been there now for 12 years without any problems, and can't see any reason to change things now. Selectman Delong asked the Chief if there are any restrictions in that area when it snows and he noted , no, during the blizzard of last year certain restrictions were established, and Mr. Kowzie noted that this was a very unusual storm. Selectman Avery recommends nb- parking from the corner (No. Main St.) back to the farthest driveway, which would be the second driveway of the bank. Mr. Kowzie wanted to know if any thought was given to this because to go any further would mean involving DiMonte's store on Pratt St. Selectman Delong noted that this had been discussed and it will not be going down that far. Selectman Delong asked if there was anyone else in the audience to speak either for - or against this no- parking proposal. No response was heard. The hearing was declared closed. Selectman Caponigro noted that he would like to think about4 that there are two businesses involved here. A motion was made by Selectman Clemmey that the no- parking on Rte. 140 from West St. to Copeland DRive on the Mansfield /Foxboro town lines be approved, seconded by Select- * man Avery. Voted 5 -0 Selectman Caponigro noted that he would like to make a motion to take under advisement for two weeks the no- parking proposal for 106 (Chauncy St. Ext.). Selectman Avery noted that he would second this motion if the police chief would investigate the accident log other than the accidents at the lights. The Chief noted that he could not say there have been that many accidents there. Selectman Delong wanted it made clear that the reason they are restricting parking is not because of the number of accidents. Selctman Caponigro noted that the main reason is to widen the roads. Selectman Caponigro withdrew his motion. -2- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting January 24, 1979 Page 3 Selectman Caponigro noted that he went by the diner this morning with trucks and it wasn't that bad and we have a man here who is in the process of losing 50a of his business. Selectman Caponigro made a motion that we leave the parking regulations on 106 as they are. This received no second. Selectman Avery moved that we restrict parking on the north side from the traffic lights back to the farthest driveway going east. This would be the second drive- * way from the lights. Seconded by Selectman Clemmey. Voted 4 -1 (Selectman Caponigro opposed) Selectman Caponigro then asked the Chief if the cars waiting to get into the bank will be in violation and the chief noted they wouldn't. * * * * Selectman Clemmey moved that the warrant in the amount of $407,679.20 be ap- proved, seconded by Selectman Caponigro. Voted 5 -0. Selectman Clemmey moved that the Revenue Sharing warrant for street improvements * in the amount of $55.20 be approved, seconded by Selectman Caponigro. Voted 5F0. Selectman Avery moved that the minutes of January 10, 1979 be approved as read, * seconded by Selectman Clemmey. Voted 5 -0. * * * * PUBLIC HEARING A Public Hearing for Cuneo's, Rumford Ave. was held at 8:00 p.m. Chairman Delong declared the hearing opened, Selectman Clemmey read the notice that was posted in the paper. The hearing is for the transfer of a liquor license due to the business being sold. No opposition to the transfer was declared. The hearing was declared closed. Selectman Clemmey moved that the transfer be granted, seconded by Selectman * Caponigro. Voted 5 -0. Correspondence A report was noted from the police department that there were three disturbances in liquor establishments during the week. Selectman Delong asked the Chief if he felt that any of the liquor establishments have excessive calls and noted that Jack's Cafe had 20 calls during the year. The Chief noted that he feels 20 calls is excessive, that it takes a lot of men and time, the men could be used elsewhere, also in some cases out of town assistance is needed to stand by just in case. The Chief feels that the management is not ( doing their job, however, it is the police job to provide assistance. The Chief noted that there are two establishments in town, the Depot and Jack's that have excessive calls. The Chief wanted it pointed out that in all cases management has called to keep the peace. Selectman Delong said that this is the -3- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting January 24, 1979 Page 4 one thing that he has always urged and not have someone else calling the police but if we ask them to reduce the calls it may cause more problems. The Chief noted that years ago there were seven taverns in that area and this was his beat and he never had these problems, he feels that the problem is the younger ones drinking and not able to handle it. Selectman Delong asked the Chief if it is true that it is up to managment not to sell to anyone who is intoxicated and the Chief noted that this is true/ Selectman Clemmey noted that he would rather have management call even if the trouble is outside. The Chief noted that one of the ;,problems is that public intoxication is not a criminal offense. - Selectman Caponigro asked the Chief if he thought that a police officer on duty would help and the chief said that he did not l.think so. Selectman Avery noted that he remembers when he first came on the Board that they had Mike Delfino from the Depot in to talk to and from that time on which was around last March, the problems have been cut way down and he suggest that we have the owner of Jack's in to meet with the Board. Selectman Avery does agree that managment should call, The Chief noted that they have no problem with management but it could be whoever is working there, a shakedown in personnel is probably needed. Selectman Delong noted that he would like a report on the disturbance calls logged for the Depot during the past year. The Town Manager noted that in going over the report on disturbance calls of them happen on the weekends . The Board requested that a letter be sent to the manager of Jack's and ask that he meet with the Board next week. PUBLIC HEARING A public hearing on the Mansfield General Store, East Street, for the transfer of a liquor license was held. The hearing was declared opened and the clerk read the notice that was posted in the paper. Chairman Delong asked if there was anyone in the audience who was either in favor or opposed to this transfer. Hearing no response the hearing was declared closed. A motion by Selectman Avery was made to grant the transfer of this license, seconded * by Selectman Caponigro. Voted 5-0. Clerk's Folder A motion was made by Selectman Clemmey, seconded by Selectman Caponigro to postpone granting of the license for a ipinball machine for A &A Pizza, No. Main St. until next week. -4- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting January 24, 1979 Page 5 Correspondence continued- Selectman Clemmey commented on a memo from the Town Manager regarding the retire- ment fund and what he asked him to find out was what the county is paying out. An article to rezone: -:West St. to So. Walnut St. from Resident A to agriculture was submitted for the Annual Town Meeting. A letter was noted from SRPEDD with a copy of their report to be submitted for the annual report. A copy of a letter was noted from an Attorney Frederick T. Iddings, Jr. who represents Walter I. Main who is holder of certain security interest in property of Carlton - Whitney Aero Service, Inc. former lessee :, of the Airpott. Mr..Main is claiming that Carlton - Whitney Aero Service has been locked out of the airport buildings without benefit of any notice to vacate the premises. Mr. Main still has interest in certain equipment at the airport and is concerned because he was on the premises the other day and found the door to the maintenance shop opened and the building unattended. Mr. Main will hold the town strictly ac- countable for any losses that occur. The Town Manager commented that he, the building inspector and fire chief were down at the airport today for 2 hours and inspected the buildings, all the doors have been secured and that the people who worked there prior have come to work on their planes at least eleven times. After they left the doors were locked, so what is being claimed in this letter could not be confirmed. The airport manager is now trying to determine what belongs to the prior lessee and the Town. Security checks are made both morning and evening, all docks have been changed and the prior lessee must check with the airport manager before being let in. Selectman Delong wants the Town Manager to check nand see if they were notified by letter that the lease had expired. The Town Manager gave the Board an update on the boiler and was told that it can be repaired for the time being but in the long run we will have to look into a new heating system . Selectman Delong want to know why it =was thought that it could not be repaired and the Town Manager noted that he, the building inspector and fire chief spent about one hour today trying to find out who decided that the furnace was unsafe. There are a few people he is going to speak to. Selectman Delong noted that when things go wrong at the airport the commission de- pends on the airport manager to handle it and this was not being done in the past. A letter was noted from the Comnonwealth of 7.Mass. Office of Environmental Affairs notifying the town of its financial liability in the suppression of insect control and for Dutch elm disease. The Town Manager noted that he has budgeted - $2500. for pest control and $1700. for Dutch elm disease. A letter was noted from SRPEDD, asking for the name of our representative to the JPTG. Selectman Caponigro moved that Elwyn Atherton be appointed, seconded by * Selectman Avery. Voted 5 -0. Town Manager's Repott -5- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting January 24, 1979 Page 6 The Town Manager noted that calls have been coming in concerning flooding and we have been telling the residents that we have been trying to check and clean all culverts especially those flood prone areas The Town Manager noted that he met with the Foxboro Board of Selectmen and Board of Health regarding a health agent and sanitarian for both towns. A mutual interest was advanced and the Town Manager will pursue the possibility It was further expressed that the position be limited to the towns of Mansfield and Foxboro. Cost figures will be developed and all parties will be appraised also the duties, responsibilites and scheduling will be formalized. Meetings will be arranged to work out details. More information is coming from the State with a list of registered sanitarians. The salary range is thought to be between $9,000 and $15,000. The Town Manager noted that he also talked to the administra- tor of Easton and he is interested but he is not sure.that the Easton Board of Selectmen would want this. Foxboro feels that with the 28,000 population for the two towns it should be limited to just the two towns. Funds are available on a decreasing basis , 75% the first year, 60 %, the second, 40% the third and 20% the fourth year. After the four years we have to decide if we want to continue and then we would have to fund the whole program ourself. Selectman Delong asked the Town Manager what the story on the landfill is. The Town Manager noted that he did speak to Karl Clemmey, Chairman of the Board of Health and he has promised something on this.. The unmarked cruiser is in. Car #41 needed brakes today and we needed this vehicle so the Town Manager approved the repairing of the brakes. Regarding the memo on the DiRienzo property, the Town'i'Manager notes that this whole project comes under the 495 contract and Article 9 of the Town Meeting which voted to raise and appropriate the sum of $55,935 for water betterments. Selectman Caponigro noted that he would like to see the original plans of the state to see if the tap -in's were made. The Town Manager noted that Ron Dubuc is doing this. Selectman Caponigro feels that we have a highway department and a water department who are being paid for doing 8 hours work a day anyway. Discussion continued on the cost of hooking up a meter and Selectman Caponigro feels that the charge of $25.00 is excessive. Selectman Delong noted that we are trying to make the water department self- sufficient. Selectman Avery noted that he would buy Tony's argument but Mr. DiRienzo is running a business from there, 2 businesses at that. This will be discussed again next week. The Town Manager noted that he did speak to Ron about bringing the water -& sewer departments to self - sustaining levels and is waiting for a report on water rates. The Oak Street Culverrwas discussed again, Selectman Caponigro noted that he was speak&ng to an old engineer who noted that most of these streams have built up a lot of silt over the years and should be dredged. Selectman Caponigro feels that we have the personnel who work for the town to do this work. Selectman Caponigro would like the Town Manager to check with Thom Bonome and get figures to see how muo-h it would cost to have town forces do the work. The Town Manager commented on the Oak Street Culvert and said that it would cost about $40.000. to remedy the problem. Selectman Avery wants the Town Manager to look into waterways bills to see if there is anything available in the way of funding. QS BOARD OE SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting January 24, 1979 Page 7 Selectman Caponigro again commented on the letter from Governor King's office regarding putting a cap on spending. He wants to know why we can't say that we are going to have a "0" cost budget :other than raises. Selectman Delong feels that you have to be realistic when you set a budget and then decide what to cut, you have to look and see if and what items are really needed also to cut is only postponing things that have to be done. It was decided by the Board to combine meeting with the FinCom to go over budget requests with departments instead of setting up separate meetings. Selectman Caponigro noted that he would not be here next week for the annual appointments and in looking over the list there is only one vote that he would have ,where there may be a disagreement, he did not mention who. Selectman Delong asked the Town Manager to get in contact with Paul Dalton that there seems to be a misunderstanding. Selectman Delong noted that he was talking with Chris Clancy tonight and he understood that Paul Dalton is waiting to hear from the Town Manager. The Town Manager noted that he just spoke to Paul Dalton a couple of days ago, but will check this out. Selectman Delong went over the pending items . The Town Manager noted that he met with the following departments today : Fire, Police, DPW, Light, water in setting up routes to follow in case of an emergency. Town maps were mapped out utilizing the main roads in and out of town. Selectman Delong also wants the Town Manager to find out from Ron Dubuc if money being budgeted for hydrants each year is sufficient, are we keeping ahead or falling behind . A motion to adjourn was made by Selectman Avery, seconded by Selectman Caponigro. * Voted 5 -0. -7-
