BOARD OF SELECTMEN /LIGHT Minutes of the Meeting January 31, 1979 Present: Selectman Lyman C. Avery, Frank Colella, Robert M. Delong and David R. Clemmey. Town Manager William P. Metropulos. Selectman Antonino Caponigro, Jr. absent. The meeting was called to order at 7:30 p.m. A weekly warrant in the amount of $370,949.00 was read. A motion to accept this * warrant was made by Selectman Clemmey, seconded by Selectman Avery. Voted 4 -0. Minutes: The minutes of January 17, 1979 were noted. Selectman Delong had a question on page 8 under Board Reports - it was something that Selectman Caponigro had reported and since he was not present tonight a motion was made by Selectman Clemmey, seconded by Selectman Avery to accept the minutes subject * to clarification by Selectman Caponigro. Voted 4 -0. Minutes: The minutes of January 22, 1979 were noted. Selectman Delong questioned the Town Manager on some of the items that were brought up at this meeting and asked for an update. There is one correction to be made on page 3, lst paragraph which is to read that Selectman Delong feels that the resolution made up by Select- man Avery should be written right into the Board Policy and not attached. The minutes of January 22, 1979 were accepted with corrections, on a motion by * Selectman Avery, seconded by Selectman Clemmey. Voted 4 -0. The Selectmen discussed in length an issue that was discussed at both the January 22, and January 24, 1979. A Mr. DiRienzo of School St. is requesting that the $225. charge for water hook -up be abated. A motion was made at the Selectmen's meeting of January 22, to charge only for the meter and the labor to hook it up. The Town Manager explained what the state intends to do for Air. DiRienzo, they are willing to put in a catch basin which meets with Mr. DiRienzo's approval. Exactly what to charge Mr. DiRienzo was discussed, Selectman Delong noted that the cost of material and labor :should be what it cost originally and he feels that he should be charged the $225. Selectman Avery moved that the standard charge be paid. This received no second. Selectman Clemmey noted that when he votes on something he hates to change his mind. Selectman Delong noted that he wouldn't be changing his mind the question here is what would it cost the town in labor. Selectman Clemmey asked the Town Manager what our charge would be to put in a tap and the Town Manager noted around $125.00. Selectman Delong feels that the Town Manager should have some direction regarding what the charge should be. Selectman Clemmey argued that the motion said to only charge for material and cost of labor to hook -up the meter and not to charge for the tap -in . Selectman Delong noted that the Town Manager is on his own. Selectman Delong also noted that Mr. DiRienzo is conducting a business out of his home and wanted to know if it has been confirmed that he has a license to do this. The Town Manager noted that he does not know if the Town Clerk followed this up. -1- BOARD OF SELECTMEN /LIGHT COMMISSIONERS j Minutes of the Meeting January 31, 1979 Page 2 PUBLIC HEARING A public hearing was held at 8:00 p.m. for the storage of gasoline at the ARCo station on Chauncy St. The hearing was declared opened. Diggin, Jr., 945 West Street, applying for the Library Board, and Great woods Committee and SRPEDD. An application was noted from Allan M. Cox, Jr, applying for the Library Board. Drawn Steel was noted. The letter notes that N.E. Drawn Steel is not in favor of having the Airport close down. Copy of a letter from Berretta Buick -Opel, Inc. was noted from Brockton. The letter notes that they would not want to see the Airport close down and feel so strongly on _this matter, that if Mansfield should close it they would actively solicit the, business people of Brockton to lobby the City of Brockton and go after the Airport for Brockton, rather than see it closed. Clerk's Folder A request was noted from A &A Pizza, No. Main St. for a.pinball machine. A Mr. Richard Lubart of Metrovend was present and informed the Selectmen that his company has pinball- machines in a number of businesses and named a few of them. This machine Mr. Lubart noted is not for gambling, :just pure entertainment and that he feels the A &A Pizza is a well run business. Mr. Lubart noted that A &A has been assured that if there is the least problem with the machine they will remove it, there is no long term contract, just an agreement. The license was approved on a motion by Selectman Avery, seconded by Selectman * Colella. Voted 4 -0. New England Telephone Hearing Mr. Francis Brown representing the N.E. Telephone Co. was present for this hearing. Mr. Brown noted that this is two hearings, for the placement of conduits. -2- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting January 31, 1979 Page 3 One of the abutters is at 234 West Street. The telephone company wants to place a service box that is vandal proof with a lock on the door attached to the pole without having to dig up the street. The other abutter is the Town of Mansfield. The telephone company noted that there is an historical building across from the Town Hall on the corner of Rumford Ave. and they would like to remove the pole and put the cable into a nice box to clean up that corner. The Selectmen thanked Mr. Brown. Selectman Delong asked if there was anyone in the audience in opposition to these request. Hearing no opposition, the hearing was declared closed. A motion to approve these two request was made by Selectman Avery, seconded by * Selectman Colella. Voted 4 -0. A letter was noted from Joseph R. Copy of a letter was noted from SRPEDD addressed to Chad Maurer congratulating him on his effort to seek federal funding to improve our community. This is in reference to the small cities grant requesting funds to improve the downtown area. A letter from the Finance Committee was noted regarding the Governor's CAP on spending. The FinCom is asking for support from senior town officials. Select- man Delong commented on the letter and noted that he agrees'With the intent of it but feels that two things have to be kept in mind, one that it is.not up to the department heads to keep line items in line but up to the voters , the cuts should be made on the Town Meeting floor, further when cuts are to be made it has to be decided what services are going to be eliminated, also items should not be postponed that have to b144lone this yea*ntil the next -year. Selectman Avery asked Ed Benson, Chairman of the FinCom if the FinCom is suggest- ing that the budget total be limited to 5% and to do this decrease the personnel? Ed noted that what they are suggesting is not to replace or hire more . * * * * -3- BOARD OF SELECTMEN /LIGHT Minutes of the Meeting January 31, 1979 Page 4 Selectman Delong noted that at last week's meeting the manager of Jack's cafe was asked via letter to meet with the Board, and tonight Mr. Spezio from Jack's was present. Selectman Delong noted that this meeting is not meant to discourage Jack's from calling the police if they have a disturbance and not to feel that if they call the police we will have to go before the Board. Selectman Delong continued that the concern is people being served after they have become intoxicated. Twenty calls were made to the police last year and three so far this year. Mr. Spezio noted that the; police tell the kids they have to get off the street, so where do they go, where their friends go, to Jack's. As far as,.problems, there have only been 2 in- cidents in Jack's most of the trouble is outside. Mr. Spezio continued that most of the troublemakers are from out of town and he has been trying to weed them out. what happens he noted is that they are smoking marijuana before they come, not in Jack's, and there high . Mr. Spezio noted that a lot of the problems happen around last call and when you have 110 people in the place it is impossible to get to them all for last call, so instead of offering last call to anyone he just announces at closing time, "every- one out" and he puts a call into the police station prior to these in case there are problems. Mr. Spezio feels that Jack's is getting unfair publicity in the paper and what is being printed is not true. He feels that he does the best he can to run a clean efficient business, serving the best quality in food. Selectman Avery asked Mr. Spezio if he felt that over the past 3 or 4 years the dif= ficulty of running a tavern has increased and Mr. Spezio noted "yes" due to the 18 year old's drinking. Selectman asked Mr. Spezio if he thought raising the drinking age to 21 would reduce the disturbances and Mr. Spezio feels this would help. Selectman Avery noted that he also wanted to make it clear that our concern.'.is the number of calls placed to the police and not what is being printed in the paper. Mr. Spezio also presented to the Board members copy of a letter from bartender Clifton H. Day who feels that Jack's has a good batting average and he certainly in- tends to do his best to make it better. Mr. Day noted that Jack's has been in bus- iness under the same owner for 34 years and hopefully it will be for another 34 years. Selectmen noted that they hope this will not make Jack's hesitant to call the police when needed. Selectman Delong noted that he can only'urge him to keep on trying. * * * * Corresponsence A permit from D.R. Betts, Inc. No. Attleboro was noted requesting permission to move a house from School St. to Jewell St. Permission was granted on a motion by Selectman Clemmey, seconded by Selectman Avery. subject to approval from all departments. Voted * 4 -0. The weekly report from the police department was noted and there were no disturbance calls for the week. On a request from the Board last week to have the police submit a report on the number of disturbance calls for the Depot a report read noting there were 20 calls made. The Board decided to wait on this for now before calling anyone in. SC BOARD OF SELECTMEN /LIGHT Minutes of the Meeting January 31, 1979 Page 5 Mr. & Mrs. Scarpellini of Village Road, met with the Board to discuss the very bad flooding problem that they are having. Mr. Scarpellini noted last year for the first time if was really bad after the thaw, the water come under the banks with 4 feet of water around their house. It is so bad that they have to evacuate and get their cars out quickly. Strangely enough there is no water in the cellar, the house is a split level, built up. Mr. Scarpellini noted that he lost about a week of work because he cannot leave his family, even the Fire Chief was at the house and was frightened. What he is asking tonight is to just get into the problem he knows it can't be fixed overnight . The Scarpellini's were told that an article is being submitted on the town warrant to build up the culvert the question is though how far back do they own and how much the Conservation Commission owns. Mrs. Scarpellinin noted that Paul Boyden, said that he would grant any permission that the town comes up with. The Civil Defense did provide them with sandbags. The question:,of dredging came up and Selectman Delong noted that the whole section is just a holding area for water and dredging won't do any good. Discussion on what could be done to remedy the problem continued between the Town Manager and the Board . Selectman Delong noted that this is his 4th year on the Board and this area has always been a problem. A Mr. Zaharias of Village Road suggested that we contact the Corp. of Army Engineers ( and ask them to take a look at the problem and possible we could save some money. Mr. Zaharias noted that his concern is that he has a child with medical problems and has to take 'him to the hospital, he is afraid that he won't be able to got his car out. The Town Manager noted that he will check with the State and Corp. of Army Engineers, there may be some money available if this area was declared a disaster area. Selectman Colella wanted to know where we can get funds, this is an emergency. Selectman Delong ;noted that the Reserve Fund is very low. The cost of this project is estimated at,$40,000. Discussion among the Board members, Town Manager and the ScarpellinV s continued with the result being that the Town Manager will contact the Corp. of Army Engineers. * * * * Downtown Advisory Committee - Bob Mangiaratti noted that at the last Annual Town Meeting , the Town Meeting authorized the DAC to comp up with a proposal for the Fairfield optical Building. Bob noted that his committee has met with many boards to try and determine a good use for the building and found out that there is a shortage in housing. The Committee is of the opinion that the best way to develop this site is to select a private developer that would prepare the required plans in accordance with specifications approved by the Town. The Committee is basing development of this Fairfield Site on the fact that there is a shortage of housing for the elderly. The Committee has prepared an article asking the Town Meeting to authorize the Selectmen to sell the property rights for parking. Bob noted that his committee has spoken to the private property owners abutting the building and they indicated they would keep an open mind as far as selling if approached. Selectman Clemmey moved that the article be submitted for the Annual Town Meeting, * seconded by Selectman Avery. Selectman DeLong noted that he would vote for the reappointment and feels that the gentleman has served the Town well and if we offered this to him with no strings attached he cannot be at fault, but to do this at the time of reappointments is not fair and because of this he will not vote for anyone else and if Selectman Avery feels the same way we will have a stalemate and have to wait for Selectman Caponigro to come back. Selectman Colella noted that he agrees with what Selectman Clemmey says, that he was not aware of this and could not vote for this reappointment. Selectman Clemmey noted that he speaks for himself that he brought this up before to the Board but they did not want to act on it. This reappointment is being postponed until next week. They have decided to set up some meetings and write to the local officials and treasurers advising them of a pending meeting. The Town Manager noted that surprisingly enough they had two or three other calls regarding this same thing that day. The unmarked car has been delivered and the marked vehicles should be in this week. The Town Manager gave a report on the sewer problem on Union St. Extension, he noted that he and Selectman Clemmey went out there today to look it over. The Town Manager spoke to Paul Dalton on an issue that Selectman Belong brought up at last week's meeting. The mix up was that Chris Clancy had not been informed by Paul Dalton of their conversation. The situation has been cleared up. Firehydrants- When found to be faulty they are referred to the water dept. The routine inspection and flushing of hydrants has been curtailed during the winter months. A replacement program of 10 to 15 hydrants per year is planned. -7- BOARD OF SELECTMEN /LIGHT Minutes of the Meeting January 31, 1979 Page 8 Selectman Delong wanted to know if this was sufficient enough to keep up with the replacement program, we have 650 hydrants and doing only 20 a year will take time, the problem is that if we don't provide the money now for them who will provide for them. Ten years from now when they all break down we will really be in trouble. Selectman Avery wanted to know just how many should be replaced each year. The Town Meeting sbodld have a chance to vote on this. The Town Manager noted that he would just as soon do as many as we can and would like to separate it as it's own line item account. Approval of the Airport Boiler has been given as far as the work to overhaul it. This will be satisfactory until the summer when we will determine amore ef- ficient unit to be installed. Carl & Dean Oil Co. will be doing the work. Selectman Delong noted that hopefully we won't have to do. anything, the new leasee can do the work. The Town Manager reported that there was a power outage on January 25 of about 3,000 hours. This has been reported to the Dept, of Public Utilities. * * * * Selectman Delong noted that he would like to meet with Clifford Pearl of the Housing Authority to go over the audit he received. Selectman Delong noted that he met with Ralph Cutillo, President of Air Charter Service to go over questions he had on the lease agreement. After this meeting he was satisfied that Mr.CUtillo is a successful business man and does not see why he would not be a success in running the airport, Also that there is no change in the 5 -year maintenance plan. Selectman Delong questioned the Town Manager on the status of the water rates from Ron. The Town Manager noted that he will have these by next week. The Special'. Town Meeting will be held Monday, February 5, 1979 and the Board noted that they will give their position at the beginning of the town meeting. * * * * Constables Reappointed for a 1 -year term N.
