Larry Pigeon met with the Selectmen regarding the Airport Lease to answer questions that were asked at the hearing on December 27, 1978. Clerk Clemmey read two letters that were received regarding the Airport one for and one against the idea of a change. One letter from Mr. & Mrs. Flammia ' 640 So. Main Street are opposed to the new lease and the one from Earl Zecher, 1819 West Street favored the new lease agreement. Selectman Delong noted that there is a petition circulating for a Special Town Meeting as to whether we should continue the Airport or Iflcontingited not to let BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting January 10, 1979 Page 2 Selectman De Long noted that a petition has been presented for a Special Town Meeting with two articles - 1) to see if the Town will vote to close the Airport and 2) to see if the Town will vote to prohibit the Airport from expanding or modifying its activities beyond the levels of operation it now is. An opinion on these articles was asked of the Town Counsel as to whether this can be done and how it would be handled. Town Counsel noted that there are certain procedures that have to be followed and that Chapter 43B Section 10 of the Mass General Laws spells out what has to be done. Town Counsel was asked if there was any other way that the voters can discontinue or advise in the operation of the Airport and Town Counsel noted that this cannot be done. Under Section 5-9 of the Town Charter the Airport Commission is given the authority to exercise all the powers and duties of the Airport Commission under the General Laws and to maintain and operate the municipal airport and navigation facilities in a manner that is both profitable for and responsive to the needs of the community. The Airport also comes under the rulings of the FAA and MAC and as long as the Airport is operating within these guidelines nothing can happen. Larry Pigeon then noted that the Airport Commission checked the charter also and feels that it is their obligation to continue doing what they are doing. The Airport Commission has completed negotiations with the bidder for the lease agree - men. The new lease agreement is being typed up and will incorporate all the changes. Larry noted that regarding the meeting that was held December 30, 1978 there were no special changes discussed on that date that everything discussed was what was in the lease at the time of the bid opening. A letter was noted from Margo Jellinik claiming that changes were made in the lease agreement at this meeting. The discussion was halted for the Community Development Hearing. Clerk David Clemmey read the notice that was advertised in the paper for the Community Development Hearing. Chairman Delong declared the hearing opened at 8:00 P.M. In attendance was Chad Maurer, Town Planner who was willing to answer any questions one might have regarding this application for .funds. Selectman Avery noted that a letter was received from Margo Jellinek regarding the dam off of East Street known as Mill Street Pond. Ms. Jellinek feels that funds to rebuild this dam should be included in the grant application, however, Chad nored that this could not be included in this application and doubted that projects like this would be funded by HUD. Selectman Avery noted that it seems to him that in the past couple of months something from SRPEDD was received regarding state money being available for this type of thing which would come under "Water Quality and Watershed ''pro- tection. Chad noted that he will look into this. Selectman Colella noted that he would like the Oak Street Culvert project put into this application but it was noted by Chad that the Oak Street project would not tie into what this application was made out for which is for a Small Cities Program that will meet local needs. The application is being submitted for funding for the downtown area which serves a larger area and will help the elderly. Funding for the Mill St. Pond dam and the Oak St. Culvert would have to be separate applications. -2- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting January 10, 1979 Page 3 Selectman Caponigro wanted to know if two applications could be submitted and Chad noted that an estimate of the total amount would be needed. We have requested $310,000, Chad noted and $400,000. is the most that can be requested. Selectman Avery made a motion that the Town Manager in concert with the Town Planner investigate the possibility of state or federal monies that may be available for us in the Oak St. Culvertproject and the Mill St. Pond project. Seconded by Selectman Caponigro. Voted 5 -0. The hearing was declared closed and a motion was made by Selectman Avery that the application be submitted as made out to HUD. Seconded by Selectman Caponigro. Voted 5 -0. J. Airport discussion continued - Larry Pigeon read a letter from the Airport Commission on their feelings regarding the Aiport and the running of it. He also noted that he has the lease agreement with some of the additional changes that are being. made and copies of this was passed out to the Board. Larry was asked what would happen if an attempt was made to cl.osa the Airport and he noted that the FAA is responsible for enforcing all rules and that we have ob- ligations that we must meet and noted that he had a letter from the Federal Avia- tion Authority as to what the ramifications would be if this were to happen. One of the things noted was that the Airport could be taken over by the FAA and they would find someone to operate it the same as the Town under a Deed without Warranty. The Airport could be sold and the Federal Government file suit for all the funds . to the Airport in excess of $100,000. Larry noted that the meeting of December 30, 1978 voted to execute the lease agree- ment on the 1st of February. Also the Commissioners have hired an Airport Manager at $2.90 per hour for 9 hours a day, seven days a week. This will be a fee basis with no benefits. This was approved on a motioniby;Selectman Caponigro, seconded by Selectman C.lemmey. Voted 5-0. Selectman Delong noted that he wants to make sure that there are standards in the lease for the leasee to follow. Selectman Colella noted that he wanted to hold another public hearing on the Airport but Selectman Delong noted that we already had one and the reason for the public hearing is to hear what people have to say, and then gather all this information before finalizing the plan. There really is no need for another hearing. Select- man Colella made a motion to hold a public hearing next week for the Airport. This received no second. Motion failed. Selectman Delong called for a motion to go into Executive Session for interviews of the Town Accountant's position. Roll call votes were taken, Avery, yes; Colella, yes; Delong, yes; Clemmey, yes and Caponigro, yes. The reason for the Executive Session was to discuss the reputation and character, physical conditionoor mental health rather than the professional competence of an individual, and for the further reason that the Executive Session was requested by the candidates where it may af- fect the professional standard of the individual adversely should Sh not be held. -3- t ,1 I BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting January 10 , 1979 Page 4 The Board returned to Open Session at 10:06 p.m. Selectman Avery at this time left the meeting to go home. Correspondence A report from the Police Department noted that there was one disburbance during the week at Jack's Cafe. A letter from SRPEDD was received with ammendments to the draft on "Air Quality Control ". A letter from the Board of Health was noted that James Dunn has been hired as a temporary replacement for the Town Engineer. Copy of a letter from DATEL Systems was noted regarding the intersection of Rt. 140 and Forbes and a recent accident that happened there by one of their employees. Copy of a letter from a Sally Simmons, Stoughton Mass. regarding the accident that she was involved in at the intersection of 140 /Forbes. A request for a transfer for the Council on Aging for gas for the mini bus was noted , although the monies for the gas and repairs to the mini bus has been spent the account does not have a "0" balance there the request is denied. Selectman Delong noted a memo should be sent to the FinCom to alert them that this account is getting short. An application was noted from Steve Conroy, 9 Atwood Street, applying for the Board of Assessors. An application was noted from John Riccio, Willis Street, applying for the Board of Appeals. Town Manager's Report Town Manager notes that a letter has been sent to the EPA on the landfill test well material requesting their review and evaluation. The letter was sent out December 28, 1978. On costs to take rubbish /garbage out of town it would cost another $18,000 over current contract price plus $10.50 per ton. We take in 160 ton a week. This cost along would be $87,360. Also with people not allowed to go to the land- fill them selves would increase the pickups. Representative Leo Lombard has scheduled a meeting on GATRA /MBTA for January 17, 1979 at 3 :30 p.m. at the State House in Boston. The Town Manager and Select- man Caponigro are planning on going to this meeting. MMWEC is having a meeting January 30 at Boxboro, Mass. Still have not received new cruisers due to various factory delays. -4- BOARD OF SELECTMEN /LIGHT COMMISSIONERS Minutes of the Meeting January 10, 1979 Page 5 A tentative meeting has been scheduled with Foxboro for January 22 to discuss a Health Agent for the two towns. The typewriter for the Treasuer's office has been received and the old one has gone to the Library. The Breathlizer will have to be added to the budget before state approval for reimbursement. The money must first be appropriated and pay $1000. before we are reimbursed. This was changed after we had been informed that the state would pay the vendor directly. The Town Manager noted that he has scheduled a meeting with a representative of the Institute of Preventive Medicine on Physical Fitness. The Town Manager is to meet with him tomorrow to discuss physical fitness programs for stress related jobs such as the Police Dept., Fire Dept. and high tension work. Board Reports Selectman Colella noted that he received a call from a Lorraine Smith, 29 Warren Ave. regarding a water problem that he would like the Town Manager to look into. Another problems that Selectman Colella discussed was a problem that Mr. McKillop of Lakeview Drive was having because of the Oak. St. culvert. The Town Manager explained to him that the cost for the pipe is $13,000 plus having to acquire the land which brings the cost up to around $40,000. The Town Planner is working on the project now for an approximate figure. The only thing bhat can be done now is to keep the streams cleaned. Their being no further business the meeting adjourned at 10:55 P.M. -5-
