Town Manager's Report
Reported that Arthur Terenzi states there is no easement shown on his deed, therefore,
the pipes were installed without the benefit of an easement. There is a possibility
of having an agreement between him and the town whereby if there is a problem caused
by pipes at that location, the town will make repairs. Town Manager recommends
that the Board of Selectmen stand by the initial letter from Town Manager to Mr.
Terenzi that town should not make any repairs at this time. Selectman DeLong noted
that he had spoke with Mr. Terenzi and was told he would like a decision one way
or the other.
Selectman May feels we should give Mr. Terenzi some type of satisfaction in knowing
that town will repair damage if pipe collapses in the future, since he has allowed
town the use of property over the years. Selectman Avery noted that it was not
the town's responsibility to put pipe in in the first place and if we get involved
in this piece of property, we may have a similar problem with other properties in
that area. Selectman Avery supports Town Manager's recommendation. Selectman
DeLong feels that Board cannot make a commitment at this time.
Selectman Avery feels Board should write to Mr. Terenzi that if it can be proven
sometime in the future that damage was caused by collapse of pipes, he can come
to Board of Selectman for repairs at that time. Selectman DeLong would agree and
requests that we specify it is driveway that will be repaired and not any buildings
that might be present at the time. Also Mr. Terenzi should be told he would have
to make claim against the town. Town Manager is to check with Town Counsel to
see if this type of agreement would be appropriate for a specific number of years.
By request of Town Clerk, the Board is asked to reconsider the vote to increase fees
for license of lodging house and auctioneer since these are State set.
MOTION: To reconsider vote to raise fees for lodging house and auctioneer license.
Avery /Levine, 5 -0.
MOTION: To set fees for license for Lodging House at $20, and for Auctioneer's
at $15 per day. Avery /Levine, 5 -0.
Town Manager reported the Maple Park well should be on, line Wednesday. Some of
the electrical work could not be done because of the weather, and the transformer
from North Dakota was defective. North Attleboro Light Department loaned us one
on Friday, and pump was put in today. We have to wait for results of last test.
Board Reports
Selectman DeLong commented that Sturdy Memorial Hospital has to apply to the State
in order to establish a satelite health care center. They are planning a facility
at the intersection of the old and new Rte.140. Part of the process is community
support and need. He asked the Board of Selectmen to write a letter indicating
there is a need for this service in the community. He noted this will not be in
competition with the present facility.
MOTION: That Board of Selectmen send a letter of support to Sturdy Hospital for
introduction of health center in Mansfield. DeLong /May, 5 -0.

Selectman DeLong commented that he had received a call from Jean Nordbeck of
School Street regarding street light removal. Town Manager replied that there is
no house in the area from which the lights were removed. There is a light in
front of the Nordbeck and McVicor's house. They seem to have ample light on their
property. The purpose of the street light is to provide light for the street, not
for private property. Town Manager also noted that we will be looking at a budget
proposal to eliminate more street lights, therefore, people will have to use
security lights for private property. Selectman Avery suggested Mrs. Nordbeck be
notified that we will not be replacing lights, but suggest that she have security
light installed. The Board all concur.
Chairman Mahana reported that in a letter received from Representative Leon
Lombardi, he was informed that employment interviews can be excluded from the
Open Meeting Law. Only final candidates will be interview in public.
Chairman Mahana also requests support of the Board in writing a letter to
Congresswoman Heckler asking for her support in contacting Amtrak to see if they
would stop in town both coming and going to Boston.
Chairman Mahana asked if there was any reply to question regarding the investment
( of town funds. Town Manager reported treasurer has invested approximately $2,000
with Mass. Municipal Depository Trust, but they pay only 13% interest. Others
we have are about 17 %. One of the advantages of the Depository Trust is that it
is treated like a checking account and we can take money out at any time. Town
Manager had contacted them about a Recreation Revolving Fund but they did not want
it. The treasurer goes after the best deal town can get. Chairman Mahana would
like to see a past track record for one year.
Chairman Mahana explained to four boy scouts that were present that the Board
of Selectmen and Finance Committee would now discuss the Town Manager's budget
recommendations for FY81 -82.
Town Manager then made his budget presentation to the Boards. He explained that
the Boards and Committees had difficulty understanding that Chapter 580 setting
spending limits(Prop. 22) is now law. Therefore, Board of Selectmen and FinCom
will be hearing reasons why various Boards and Committees cannot live within the
limits set in budget. However, Town Manager is confident that town can live
within Chapter 580 and the budget that has been prepared. He then thanked Town
Accountant and those involved with budget preparation.
Town Manager would like agreement between Board of Selectmen, FinCom, and himself
on how to present Articles for town meeting. FinCom will be meeting Monday &
Thursday nights, Town Manager would like to be notified of their meetings with
Department heads. The Board of Selectmen & FinCom will meet jointly to review
budget. Selectman DeLong suggested that the final recommendation from both
Boards on Capital Improvements should go back to Capital Improvement committee.
Chairman Mahana suggested that after next meeting a time be set aside to discuss
Capital Improvements.
There being no further business, the meeting was adjourned.
