At this time a ten minute recess was called for a discussion with Torn Counsel.
When the meeting resumed, Town Counsel rendered the opinion that Executive Session
was not in order in reference to Allen Willis and Bob Chavaree's request.
Mr. Willis expressed concern as a taxpayer that the Conservation Commission.was
not following legal procedure in adhering-to posted meeting regulations. He
has attended every ConCom meeting since filing a notice of intent six weeks
ago in reference to Cabot's Pond restoration. He contends that meetingsare
being held between the ones posted with action being taken. Also Mr. Willis
questioned the procedure of approving funds for the Commission to hire a
consultant for another study of the pond which was going to cost $700 when
he and Mr. Chavaree had spent several thousands of dollars for the study done
by Dr. Carr. Orders of Conditions have not been discussed at any Conservation
meetings thus far. Mr. Willis's intent was to inform the Board of the problems
and possible illegal actions of the ConCom before the scheduled hearing of
April 23. Selectman DeLong directed that Torn Counsel should contact the
Chairman of the Conservation Commission to question the propriety of their actions.
On a motion by Selectman Levine, seconded by Selectman May, the meeting was
* adjourned at 8:20. VOTED 5 -0.
