With this approval Mr. Sietins went ahead and started work on the three lots and received notification from the Board of Health regarding wells and septic systems which they went ahead and began work on. Now they have been informed that they can't do anymore work because of the road. The Town Planner noted that, two years ago standards for building on unaccepted streets was adopted because of past problems and m assure that the'Town would not be held responsible if in the future these streets are to be developed, to put the burden on the developer and not the town. Chad noted that there is no question that he can develop the lots but access has to be provided for fire and emergency vehicles to the lots and the road should be done by the developer. The Board of Selectmen can insist on the minimum standards. There is also the problem that the other side of Bird Rd. is owned by someone else and it will need their approval, however, if it is an ancient way they will still have to meet the minimum standards and provide access for emergency vehicles. Mr. Sietins Attorney was concerned that the cost of developing the road would make the cost of the lots excessive and not sure that this area could stand the price of the lots. Selectman DeLong noted that he persona, lly does not think that the cost of the lot would be excessive and would not agree to anything less than the minimum standards. Selectman Avery questioned if a road could be cut through there and would personally stay with the minimum standards. Selectman Caponigro then discussed with the developer and Board what the cost would be to pave a road through there and noted that it would still be with the minimum standards 1/3 the cost of a subdivision. After further discussion, a motion was made by Selectman DeLong, seconded by Selectman Caponigro that if allowed to put a road through, the Board would want them to meet the minimum standards as required by the Zoning-By -Laws. The Town Engineer explained that they had 3000 feet of drainage to do and only so much money to do it and estimates that about another $5000. will be needed to correct this. Discussion on this continued as to just where Delores thinks the water is coming from and why,.she thinks that the water is coming from Crocker Street. A motion was then made by Selectman DeLong, seconded by Selectman Caponigro that we spend up to $5000. from the drainage account to pick up the water from Garden Street to Chilson Ave. Voted 3 -0 (Selectman Mahana was out of the room.
