Copy of a letter from Town Counsel on the question of "conflict of interest"
regarding the recent appointments to the Finance Committee of Stephen H. Quinn
and Thomas M. Markt. Mr. Quinn and Mr. Markt are auxiliary police officers
and wondered if they would be able to sit in on discussion concerning the police
budget, Town Counsel notes that this would not constitute "conflict of interest ".
However, in the letter the Town Counsel notes that they are funded through the
Civil Defense Department and should not sit in on any discussion for this budget.
Selectman Avery noted however, that they do not receive any funding from this
budget either.
A letter from the Conservation Commission was noted requesting to meet with the
Board on January 23 to make an appointment to their board. Selectman Avery suggested
that this wait until the Selectmen have a full board. This was confirmed bn a

will discuss this with the police chief.
The Town Manager informed the Board that Town Accountant, John McAlice has located
an old account dating back to 1943 in which Alice I. Cobb left $5000. to be used
for any purpose deemed suitable by the Board of Selectmen. There is a balance of
$2017.50 in this account,'and it was thought that some of this could be used toward
payment of the West Mansfield Monument. A motion was then made by Selectman Caponigro
that $665.00 be used for payment on the bill from Morse and Beggs for the West
Mansfield Monument. Seconded by Selectman DeLong. Voted -0.

Minutes of the Meeting
January 16, 1980`
Page 4
The hearing was declared opened by Chairman Avery at 8:02 p.m. with notice of the
hearing that was posted in the paper read-by Acting Clerk Caponigro.
Paul Fernandes of ASM Enterprises noted that the reason he is applying for this
license is to utilize three (3) tanks that are already there for the storage of
flammables above the ground. These tanks have been there for sixteen (16) years
and have been used in-the past for the storage of flammables.
Chief Leonard noted that there is a question as to whether a license was issued
for these tanks back in the 1940 "s , it can't be found, there was a license issued
in 1976 for compressed gas.
A letter from the Fire Chief to Paul Fernandes was read listing conditions he set
for issuance of the license, there are five conditions listed and it is the
opinion of the Chief that the license not be issued until all the conditions are
satisfactorily met.
Chairman Avery then asked if there were opponents in the audience.
Richard Frazio, 575 No. Main St. questioned what the flash point would be for these
materials? A representative from Down Chemical noted that, Voranol has a flash point
of 400 degrees, Morpholine, 100 and Dowanol 105. Voranol and Dowanol have been
stored in the tanks previously, Morpholine has not been stored there before.
It was questioned regarding the flash point,if the temperature outside reaches over
100 degrees, is there a danger in the tanks exploding? The Fire Chief noted that
at 100 degrees the material will give off a vapor but the system that is there now
is a closed one. The representative from Dow Chemical noted that these materials
produce a nitrogennwhich fills the space between the liquid and the top of the tank
which is standard practice preventing vapors or gases from escaping.
Mr. Frazio questioned how up to date the tanks are. The Fire Chief replied 'that
the tanks are alright but new piping is needed.
Another gentleman from the audience questioned how the chemicals will be shipped and
was told by rail.
Nancy Coffey, 15 King St. questioned what the materials will be shipped in and was
told, in stainless steel tanks:, Ms. Coffey asked if any of these materials are
stored there now, and was told only Voranol.
An unidentified woman from the audience noted that she called the gas company last
week because of an odor and was told by the gas company that it definitely was
coming from chemicals being stored around the area.
John McNamee of 568, No. Main St. questioned if there would be safety valves in-
stalled and Paul Fernandes replied that there are shut -off valves but no',safety
valves. The representative from Dowi Chemical noted that he was not sure what
Mr. McNamee meant because this product not create pressure.
The representative from Dow Chemical also noted that he could not understand the
concern of the people in the temperature reaching 100 degrees that he has been in
this business 25 years and has yet to see a storage tank go over 90 degrees , a
storage tank of liquid does not rise and fall with the outside temperature, it takes
-4-

a long time to heat liquid.
Another gentleman noted that his swimming pool very rarely gets over 80 degrees
and is sure that these people know what they are doing, however, someone else noted
that when these chemicals are manufactured they are under controlled measures.
Clarence Leonard, Office Manager for Hathaway & Patterson who abut the property
in question on both sides was present tonight to speak in favor of the license
being issued.
The representative from Dow:Chemical noted that the Massachusetts codes are a little
bit stricter than most states and that they would have to meet all the codes.
The representative from Dow Chemical -:was asked what the dangers of the chemicals
are, the toxic dangers? He noted mildly corrosive and mildly toxic, just wash it
off if it gets on you and if inhaled just step outside and get some fresh air.
An unidentifed gentleman asked what standards the Town has, and the Fire Chief
noted that weefollow the state regulations which are tougher than even the federal
regulations. The Fire Chief noted that standards sot for the Town are that the
tanks has to be so many feet from a lot and that these tanks will be brought up
to standard as though these were new tanks being built today and this° is the
reason that the Chief drew up the rules and regulations for them to follow.
The tanks are owned by ASM, Dow- Chemical are their agents , so any problems "that
arrive would be the responsibility of ASM Enterprises, Inc.
Selectman Mahana arrived 'at the meeting, 8:20 p.m.
The representative from Dow Chemical noted that he is available 24 hours a day
if needed.
Paul McNamara, No. Main St, noted that he does not profess to know everything and
yet he is not stupid and he suggest that ASM Enterprises have an open house and
invite the people in the neighborhood so that they will know what is going on .
Chairman Avery then asked if there were anymore opponets - none recorded. He asked
for other proponents - none recorded.
The hearing was then declared closed.
A motion was then made by Selectman Caponigro that the license be approved based on
the conditionsset forth by the Fire Chief, seconded by Selectman DeLong. Voted 3 -0 =1
(Selectman Mahana abstained)
The Fire Chief was questioned who will monitor the operation and he replied that
as far as the initial inspection it will be done by his men., if they feel that they
are not capable they will put a call into Boston. Routine inspections will be done
two times a year. The EPA will not be involved unless there is a spill or a leak.
The representative from Dow Chemical noted that they have a policy that ally spills
are to be reported to them.

Department Head Meeting
Town Accountant - John McAlice, commented on the old account of Alice 1. Cobbs that
he found on the books,l!he also informed the board of the transfer for the pump in
the amount of $4500. that the FinCom will not approve and the fact that the contract
has to be signed by him and he refuses to sign the contract until the transfer is
approved.
A motion was then made by Selectman Delong, seconded by Selectman Mahana to ask
the FinCom to meet with them next week regarding this. Voted 4 -0.
John noted that he will be going into the hospital on February 21, that he will be
here for the meeting next week and that he and Joan Cutillo will be attending a
meeting tomorrow in Framingham on municipal accounting. He also noted that he
and the Town Manager went to Hudson last week to look over their computer operation
set up and noted that they are a little more advanced than we are and their com-
puter is in a separate part of the Town Hall. Another thing that John is concerned
with is the numbering of accounts 'to be keyed on the computer. - This will be the
next phase that John will be working on.
Chief of Police- N. Lawrence D'Afile noted that the three new police officers are
at the Fall River Training Academy for three months and the total staff for his
department is 18. A new radar unit was purchased this year which they are now
using . The Chief discussed the 2 -hr parking limit on No. Main St. and noted that
there may be a problem in the future, he feels that there should be a 2 -hr. parking
limit all along No. Main St. that this is sufficient. He also discussed the
revision of the parking ticket fee and feels that this is a good idea.
Selectman De Long questioned who gives approval for the change in the parking tickets.
The Town Manager noted that this is a by -law change and then it is submitted to the
court for notification. The cost of the tickets to be printed has to be borne by
the Town, there is also a limit on what the charge can be according to the statues.
The Chief continued and noted that there are no major problems, the boys have completed
work on some of the breaks and are working on others. The d$part'ment is going well.
Board of Assessors - Al Turinese noted that everything is going along pretty good as
far as the office is concerned. On January 24, they will be attending a day long
siminar on classification. Selectman Caponigro questioned when revaluation will
begin. Ai noted that it will be three months work doing the ground work, so it
will be at least three months before they are seen in Town. Copy of the contract
has been sent to the state tax department, they want us to complete the revaluation
around 4 -5 months ahead, but the state wants the bottom line figure to them by
either April 1 or May 1, so the revaluation team will handle this and will probably
have to put more men on .
Town Treasurer- Joan Cutillo , noted that the taxes weres, slower in coming in this
year because the due date was both confusing with the people and the banks and
unfortunately a lot of people got stuck paying interest.. Joan noted that hej,depart-
ment is catching up on the excise tax bills and also that she.does not have enough
clerical help to get the work done and had a volunteer, to help with the work, so
anyone with a 1978 excise tax bill not paid has been reported and will have their
license revoked until they pay both this year and any other years that they owe.
Joan noted that if this operation is successful it may help to relieve a lot of
the backlog, on excise tax bills.

Joan mentioned that she does have one problem, a bank problem, sometime in
October, the'first two weeks of checks have beenl:lo5t, somewhere between the
bank and the computer service. So they hadcto have them photostated, 360 of them,
by the bank but Joan noted she thinks that there are still some missing, i'fit
is not resolved she will have to ball the bank for help. As a result of this
error the books for October have not been closed.
Selectman Mahana - Selectman Mahana noted that he wanted to take some time right
now to introduce a couple of young ladies who phoned him at home and are offering
to paint the railroad station, they have already gone to local businesses and
asked for donations of paint. Selectman Mahana introduced the two girls, Susan
Wade and Karen Hefferen . Selectman Caponigro noted that he will donate the paint
just let him know when and how much they will need. Selectman Mahana noted that he
will check -with the MBTA to find out when they can start the jroject and will be
in touch with them.
Water Department- Carolyn Bregnard, Office Manager noted that the most important
thing right now is getting on computer. They are about 1/3 on and stopped the
handbilling but decided that they will go back on handbilling due to the delay.
They should be all done (loaded) by February and then go on to the next phase.
Selectman Mahana then discussed with Carolyn the report in the Water Rate Study
being conducted by Whitman & Howard on unmetered homes. However, Carolyn noted
that the number quoted -557- is not correct, some are dead meters who are being
billed an average billing , and also that some homes can't be metered due to
a freezing problem and no cellars.
DPW - Director - Highway /Water - Thom Bonome noted that Monday, the department
had a power failure and Dustin Well went out. Thom noted that this is the
second time that this has happened and he is calling in a consultant engineer
who designed the pump for the Well. Thom; noted that he does not know what caused
the power outage but the Well is out of operation and: parts are not in stock.
Other than that, the water department is going along fine.
Thom noted that the treatment plant is functioning well, working to capacity
at 1.2 million ;gallons per day, and the final dischargesmeet the state requirements.
They have a full work force, and inspected by the State frequently, the State can
walk in at anytime and do at least every six months, there is also a monthly report
required to be sent in.
On the landfill, Thom noted that they are hauling all available cover material
he can find and what he has now should last him Until June, he has been offered
some from CC &F, about 40,000 cubic yards but the expense will have to be borne
by the Town to truck it, which will mean that the Town will have to hire trucks
at probably $1.00 cubic foot. Thom noted that the ground cover being offered from
CC& F is suitable not ideal that it contains a lot of rocks , the Town Engineer
and Thom will investigate this further and Thom and the Town Manager will investi-
gate how they will move it if they decided to accept it.
Highway - Thom noted that street improvements have been completed, 75% received
from the State for funding. The Back Bay Brook is 40% complete, the work has been
stopped due to the weather. The Oak, St. Culvert is complete and working fine,
rip rap work has been done along Hodges Brook but Selectman Mahana and Avery noted
OVA

that they would like to see some well placed stones , however, Thom noted that
these stones are not easy to move and would necessitate bring, ingi,in heavy equip-
ment. The next issue discussed was "stream cleaning" and Thom noted that before
they are al•lowddr,to do this they first must get permission from the Conservation
Commission and noted that 5 or 6 years ago he wanted to clean Robinson Brook and
couldn't because they did not go through the Hatch Act.
Selectman Caponigro asked Thom -i-f the new pump bid includes a trade-in, Thom
noted that they are keeping the old pump as a back -up . Both the Police Chief and
Fire Chief noted that when it rains the underpass on 106 is not passable and causes
problems for both these departments. The FinCom will be asked to meet with the
Selectmen next week to discuss the transfer for the pump.
Town Clerk - Arthur Remillard noted that the office is running as usual, the census
has been finished and he is no,a getting ready for the elections and town meeting.
Arthur also asked that he be replaced on the Computer Advisory Committee by the
Town Accountant. The population of Mansfield may reach 14,000 noted Arthur.
Fire Chief - Chief Leonard noted that the ambulance has been re= li..censed for two
years through the State DEpt. of Pbblic Health and is also waiting for a $5000.
grant from the Governor's Highway Safety Program toward the purchase of an ambulance.
Thom noted that the month of December the fire department ran a contest with the
school department on fire prevention, the program was a huge success and hopefully
will help to prevent fires. A surprise training drill was held by the training
officers of his department at the Airport which consisted of a small singlen engine
plane crash and four casualties. Thom reported that the drill went off very well.
Eight (8) new call -men have been put on and will be on probation for one (1) year.
The Open Burning season will run until May 1, permits are required and each permit
is being checked (one-day permits) this year they are being very selective.
Library - Peg Bradner, Head Librarian noted that she has added about the same
number of books as last year with about 500 less gifts due to the fact that they
don't have the typing time to do the gifts. Tax forms of all kinds are now avail-
able at the Library. Peg noted that over 7000 people have registered at the Library
since 1976. Peg passed out samples of cards showing the number of times that books
are taken out, necessitating the need for replacement of certain books.
Selectman Avery asked Peg if the MBC has contacted the Council On Aging regarding
the possibility of their being housed in the Library. Peg noted that the MBC
is planning on meeting with them sometime this week.
Veterans Agent- Glady Cross noted that she has seventeen ,(17) active cases, 7 of
which are elderly, 6 disabled veterans and 4 veterans that are unemployed. This
is a decrease from last year of 4 cases. Glady's noted that she accepted 52
applications for Self -Help for the fuel assistance program,;and to date only ten
have received the funds, they ran out of money but things could be worse if the
weather were not as good. G.I.'s are going to school before the money runs out and
some are applying for homes, the interest rate now stands at 111%.
Town Planner - Chad Maurer, noted that he wanted to update the Board on the diff-
erent programs. The k4ITP's preliminary estimate is 20 million, of which 2 million
will be paid by the Town (bohd issue) Chad noted that he will be meeting with a
representative from the bank and bond council next week to draft the correct word-
ing.
BOARD OF SELECTMEN /LIGHT COMMISSIONERS
Minutes of the Meeting
January 16, 1980
( Page 9
A meeting with CDM has been scheduled with the Selectmen for Wednesday, February
20, to give a formal presentation to the Board of what they will present at the
town meeting. This will include the total cost, and the cost of goerations and
maintenance , this is what Chad has asked CDM to give. CDM also this week will be
sending out questionnaires to sewer users in the area trying to find out the
best route to run the sewer line which will be funded by the EPA.
Chad noted that he has asked Whitman & Howard to come before the Board on February,
27, to make a presentation on the Water Master Plan , and also suggest that the
FinCom and other interested parties be told of this meeting. An article is being
submitted for the town meeting to petition the Mass. General Court to transfer
certain properties under the control of the ConCom to the Board of Selectmen for
the purpose of constructing two wells (2). Whitman & Howard have sent in an
application to the Farmer's Home Administration to borrow 3.9 million for this
purpose, other private land will also have to be purchased which is outside of
the 3.9 million.
An article to acquire some small properties off of Mill St. for cover material will
also be included in the warrant for the town meeting, the land is now being ap-
praised. An article to see if the Town will vote to establish a Downtown Develop-
ment Fund with the monies received from the sale of the Fairfield Optical Property,
said funds to be expended by the Board of Selectmen and upon the recommendation of
the Downtown Advisory Committee.
A hearing is to be held on February 4, to discuss the downtown one -way traffic
pattern and a Hearing will be held on February 6, to discuss the plans for crea-
tion of a Mansfield Downtown Revitalization and Development District.
Ad Hoc Committee - The Ad Hoc Committee is in the process of making a recommendation
to get funds for a design for a facility at Memorial Park. They are in the process
of sending out letters to design engineers requesting that they submit a plan for
the property and then will select one engineer; who will be asked to make the pre-
sentation at town meeting. This willij8one contingent on the fact that hb will do
the work if the town is able to raise the money, if not it will be a good learning
process for him.
Selectman Mahana questioned Chad about the cost of the WWTP. ,, 'and where'it,'will end.
Chad replied that in this day with the economy the way it is, it will continue to go
up until the final bid is awarded.
Town Engineer - Tony Stanzione discussed the Back Bay Brook, the Oak St. Culvert
and a drainage problem on Ware Street. Tony noted that he works with the Town Manager
and Thom Bonome, also the Board of Health reviewing septic system plans and doing
perk test. He has done 30 perk test in the past two weeks and has another 70 to do.
Also discussed was the Jackson property, a drainage case that has been pending with
the Town and a settlement reached in December 1979. Thb settlement being that the
Town complete the digging of a ditch by March 15th. Tony noted that this will be
done and will take a couple of days of work to complete, trees have to be removed and
the property lines have to be established.
Selectman DeLong questioned Tony about Garden St. and whether or not the Back Bay
Brook work they are doing will solve the problem. Tony noted that a large part of
the problem will be corrected and if not at least the arm will be there and can be
added onto. Selectman DeLong noted that we could probably submit an article in the
town meeting contingent on the fact that the work will be done in early spring.

The Department Head meeting ended and Selectman Caponigro noted that he would Just
like to say that about two to three weeks after he was elected Peppy Albertini said
one t -ime: "politicians come and politicians go, but us old town employees stay on "
and mentioned by name some of the town employees here when he came:and are still
here , good dedicated employees working for the town who could have gone out into
private industry and made more money and wants them all to know that it has been a
pleasure working with them.
Town Manager's Report - continued
The Town Manager noted that he checked into the off- peak;meters and this is not
available to customers anymore. The Town 146nager noted that he met with the
police yesterday in negotiations and another meeting is scheduled for Monday.
On the annual town report, he has decided that they will go out for bid again,
and will be going for one book, both the report and warrant under one cover.
A one color cover, and 50# paper instead of 60, with no pictures.
A motion was made by Selectman Caponigro, seconded by Selectman Mahana to rebid
the annual town report. Voted 4 -0.
Selectman Caponigro noted that he would like to leave the option in for a couple
of pictures.
Board Reports
Selectman DeLong noted that he thinks that it would be a good idea to have a
permanent Audit Committee and proposed that the Selectmen do this and it
consist of the Chairman of the FinCom, Board of Selectmen and the Town Manager.
The Committee will be responsible in following up the recommendations of the
audit report and recommend to the Board of Selectmen how often we should have an
audit done. He noted that it looks like we will have one every other year and
he thinks that it is a function that should be set up and followed , feels that
it is an important function.
Selectman Mahana questioned if any of the steps have been taken that were recommended
by the auditors, the Town Manager noted that some have, not all of them.
Selectman DeLong feels that one of the first things that should be done is the
separation of responsibilities as indicated by the auditors such as the collection
