Selectmen Michael McCue arrived at 7:45pm
Town Manager John D' Agostino
~
The Board of Selectmen's meeting was called to order by Chairman Achille at 7:30 p.m.,
followed by the Pledge of Allegiance.
Steve MacCaffrie, 236 Mill Street
Noted that he is willing to work with the Board to serve on a Committee regarding affordable
housing. He asked if we can focus on making sure we get the legislation in place relative to
affordable housing and the housing corporation. He believes that one of the two pieces of
legislation will have to go the ballot after the Legislature approves it. Selectman Amoruso said
that we would check it out.
..--. Noted that the town has done nothing with regard to the affordable housing plan and accepting
Chapter 40B applications.
He said that Selectman McCarter was quoted in the newspaper as saying that the Town
Manager never asked for reimbursement of legal expenses for the Ethics Commission
complaint. Mr. MacCaffrie said that it was discussed while Selectman McCarter was previously
on the Board, while Mr. MacCaffrie was on the Board and during Executive Sessions.
Chairman Achille noted that it was good to see him and he appreciates his comments. He notes
that his comments about the housing and noted that the Board will take a look at the issue.
Selectman McCarter noted that he doesn't recall a formal request from the Town Manager.
Gary Babin, Director, MMED
The 2004 DTE Report from the Mansfield Municipal Electric Department is an annual
requirement whereby we file a summary of our operations to the DTE on a calendar basis. Mr.
Babin noted that he mailed it to the Light Commissioners last week and added that it has pages
upon pages of statistical data. He added that one of the requirements is that the Board must

Present: John Sullivan, Jr., PE, Town Engineer; David J. Field, Senior Engineer; and Michele F.
Grenier, Conservation & Environmental Planner
The proposed stormwater by-law is required as per the NPDED Stormwater Phase II permit.
Mr. Sullivan presented the following in the form of a PowerPoint presentation:
The proposed stormwater management by-law is broken into two parts: Part A - Illicit
discharges to the drainage system; and Part B - Stormwater Management & Land Disturbance.
The purpose of the EP A/DEP Stormwater Permit is to require the Town to develop and
implement a Stormwater Management Plan to reduce pollutant discharges to our rivers and
streams to protect water quality. The by-law is needed for several reasons: 1.) to provide
~ authority and regulations to address stormwater runoff control during and after construction;
2.) to satisfy EP A/DEP permit requirements; 3.) to clean up what presently gets discharged into
streams, rivers, ponds and wetlands through the municipal drainage system; and 4.) to prevent
additional stormwater runoff pollution from new construction.
The main elements of the stormwater plan are public education and outreach; public
involvement and participation; illicit discharge detection and elimination; construction site
runoff control; post-construction stormwater management; and pollution prevention in
municipal operations.
The need for "construction" and "post construction" runoff control is threefold: the review of
existing by-laws and regulations revealed adequate controls for design only; construction
control is limited to spot inspections and review for final acceptance or occupancy permits; and
post-construction authority or control is almost non-existent.
This proposed draft by-law was based on a Massachusetts model by-law, prepared by a cross-
section of professionals from various disciplines, including Conservation, DPW, Planning,
Consultants and the Assistant Attorney General; drafts of general by-laws prepared by the
Town of Walpole; and after discussions with Mansfield's informal committee and various
department heads. The draft by-law was presented and discussed with the Conservation
Commission and Planning Board to obtain their input and both supported the concept.
..--.
Board of Selectmen Minutes of June 22, 2005
2
,~
The main provisions of the by-law's Part A (lllicit Discharges to Drainage System) are: 1.)
prohibits the dumping or discharging of pollutants into the drainage system; 2.) prohibits the
obstruction to normal stormwater flow; 3.) criminal or non-criminal penalties of not more than
$250/day; and 4.) a lBO-day transition period. The purpose of Part A is to regulate illicit
connections and discharges to the municipal storm drain system for the protection of
Mansfield's water bodies and groundwater, and to safeguard the public health, safety, welfare,
and the natural resources of the Town. In addition, the DPW shall administer, implement and
enforce this by-law. Mr. Sullivan noted some exemptions: fire fighting, state of emergencies,
waterline flushing, foundation drains or sump pumps, irrigation, residential car washing, low
chlorine swimming pool water, discharge during street sweeping, and dye testing.
The purpose of Part B of the proposed by-law (stormwater management and land disturbance)
is to provide the authority and permitting procedures to control stormwater runoff during and
after construction, so as to not impair the town's water quality, and to comply with the town's
EP A/DEP Stormwater Permit. The Conservation Commission shall administer, implement and
enforce this by-law. Mr. Sullivan noted that projects falling under the Wetlands Protection Act
would be exempt from filing for a separate Land Disturbance Permit.
The main objectives of Part B are to protect water resources; to control the volume and rate of
stormwater runoff resulting from land disturbance; to ensure adequate long-term operation and
maintenance of stormwater systems; and to establish the legal authority to ensure compliance.
r The main provisions of Part Bare: 1.) the Conservation Commission will now review a Land
Disturbance Permit Application for projects resulting in the disturbance of an acre or more of
land; 2.) requires inspections and monthly reports during construction by the permittee; 3.)
requires a recorded Operations & Maintenance Plan with certified annual reports; and 4.)
criminal or non-criminal penalties of not more than $250/day. Exemptions to Part B include
normal maintenance and improvement of land in agricultural use; and projects subject to
jurisdiction under the Wetlands Protection Act.
Mr. Sullivan added that Rules and Regulations are authorized under the by-law, which would
be adopted by the Conservation Commission to meet the purposed of the by-law. The
Stormwater Management Regulations would cover the details of a submittal package for the
Land Disturbance Permit, similar to those developed by the Planning Board. The Stormwater
Management Regulations are not a part of the by-law.
In terms of public outreach, officials will meet with volunteer environmental groups, post draft
by-law on town's website and solicit public comments, hold an informational public meeting
and meet with By-Law Committee to discuss comments and review by-law. After these efforts
have been completed, staff will provide the revised draft to Planning Board, Conservation
Commission and Selectmen for review; submit the proposed by-law for 2006 Annual Town
Meeting warrant; present by-law at public hearing held by the Planning Board; and present the
by-law at the 2006 Annual Town Meeting.

Chairman Achille thanked Mr. Sullivan for his presentation. Mr. Sullivan noted that at the
beginning of the process, we were looking at changing various regulations, but as we were
looking at other models, we thought it would be better to create one document - it would be
easy to reference.
Selectman Dolan asked about the 1BO day transition period and Mr. Sullivan said that
residential property owners have 1BO days from the date of effect of the by-law to clean things
up. Selectman Dolan questioned the residential car wash and wanted to clarify that this doesn't
mean business owners and Mr. Sullivan agreed and said that most of the water from
commercial car washes goes into a drain - this exemption is so people can wash their cars in the
driveway.
Selectman Amoruso asked if people are grandfathered out and Mr. Sullivan said that we need
to start somewhere - it gives the town some teeth if there are problems with new developments.
Selectman Amoruso said that his concern is that if people are grandfathered out, people may
not improve their property - he would like to find a mechanism so we can work on something
with the property owners. Mr. Sullivan noted that we don't want to discourage someone from
improving their property.
Selectman McCue asked what the deadline is from DEP and Mr. Sullivan said that we are on
target and are in our third year of the 5-year plan. He added that at the end of the five years,
r' the state wanted us to have something like this in place. Selectman McCue asked if we are at
the forefront of this and Mr. Sullivan said that he isn't sure if towns have acted on their own
plans yet but added that we are at the front of the pack.
Selectman McCue asked if we are able to measure the anticipated success of this and Mr.
Sullivan replied that this gives us some control (via the annual report). Mr. Sullivan added that
this put the onus on the person filing and the hired professional. Mr. Sullivan said that the
majority of projects come under a wetlands area and that he doesn't see a huge workload added
onto the Conservation Commission/Agent.
Chairman Achille thanked John, Dave and Michele for their time and effort.
The Town Manager asked about how they came up with the $250/day fine and Mr. Field
believes that it is part of the Massachusetts General Laws. Mr. Sullivan added that we would
ask Town Counsel about this as we move forward.

Present: ZBA candidates Dave Rapoza, 19 Paula Lane; Kevin Mackie, 10 Gale Lane; & Dan
Donovan, 97 Court Street
Chairman Achille noted that it is good to see Dan Donovan, former Selectman, again.
Chairman Achille asked why each candidate applied. Mr. Rapoza noted that he cares for the town
and is presently serving on the Recreation Committee. He applied for the ZBA because he has a
lot of common sense, can be objective and can go out and the research on issues before the ZBA.
He added that he has had conversations with ZBA member Eric Butler on the responsibilities of
being on the ZBA.
Mr. Mackie said that he has lived in Mansfield for 23 years. He has gone through the ZBA
process as a property owner and he wants people to get a fair hearing. He would like to help
residents with the process - he wants to use his judgment. Mr. Mackie noted that he is a
mechanical engineer and is well-versed at reading and analyzing regulations.
Mr. Donovan noted that the ZBA grants relief and he believes that the Board does a great job.
He noted that you need to be fair with everybody and look at the big picture.
Chairman Achille recognized Peter DeTrolio, member of the ZBA.
- Selectman McCarter asked Mr. Rapoza if he can serve on the ZBA if he is already on the Recreation
Commission. Mr. Rapoza believes that you can be appointed to more than one committee, but
you can't be elected to one and appointed to another. Selectman Amoruso noted that he likes to see
as many different people applying for various committees. Mr. Rapoza noted that he applied for one
of the associate member positions and Mr. Mackie and Mr. Donovan said that they are both
interested in serving as full members.
Selectman Dolan spoke about the differences between the full and associate members - he said that the
Chairman of the ZBA chooses the associate to fill in as needed. He noted that Mr. Mackie indicated on
his application that he wants to ensure that the applicants have the proper materials together before they
appear before the ZBA.
Mr. DeTrolio spoke about the process - if a resident wants an addition to their home, they
would first start with the Building Department and that office would advise as to whether or
not the resident would need a variance. He noted that there is plenty of help available and
there should be no reason for someone to come unprepared.
The Town Manager said that there is a problem that people do come unprepared because the
town doesn't have anyone from the ZBA office here at Town Hall on a regular basis - he
wanted someone in the building 10 hours/week to help residents and prepare them for the
meeting.

Selectman Amoruso commented to the applicants that the ZBA is not always the most popular
board and aSKed each applicant how they handle rejection and high emotions. Mr. Donovan
replied that he believes that he can handle people well. Mr. Mackie replied that he would try to
be fair and if a person was rejected, he would try to make sure that they knew they were not
being singled out. Mr. Rapoza said that he would do the due diligence and if there was a
rejection, he would let them know why instead of just saying no.
Selectman McCue commented that the ZBA grants variances and hearing comprehensive
permit applications. He asked the applicants if they are prepared to serve on a board that
would take up controversial applications, like 40Bs. He further asked if they are prepared to
have the Board of Selectmen possibly appeal one of the ZBA's decisions. He also asked them of
their opinion on the 40B process.
Mr. Donovan believes that an appeal will happen one day and he is okay with that. He thinks
that the Selectmen and the ZBA should work together. Mr. Mackie replied hat there is a lot of
opportunity for appeals on lots of issues and he wouldn't take it personally and would roll with
the punches. Mr. Rapoza said that differences of opinion are a matter of business. He added
that different points of view are good and he has no problem with the Selectmen disagreeing
with the ZBA.
Chairman Achille said that it is encouraging when people get involved with the town and
,_ thanked the applicants for coming in.

Present: Linda Sivieri, 15 Bonney Lane, #24
Chairman Achille thanked Ms. Sivieri for applying and noted that the position would expire in
200B. He asked Ms. Sivieri to explain why she applied for the Board of Health.
Ms. Sivieri informed the Board that she is a registered nurse and would like to share her
knowledge and would like to learn more about the issues facing the Board of Health. She is
also interested in helping out with the flu clinics. She noted that she was the first woman
president of the Gridiron Club in Easton and has done her share of public service.
Selectman McCarter noted that it is great to have someone apply with this much energy and
Selectman Dolan thanked Ms. Sivieri for coming forward and applying. Selectman Amoruso
asked Ms. Sivieri how she likes and handles power, because the Board of Health is a very
important board. She replied that she handles power well. Selectman McCue asked if Ms.
Sivieri plans to regularly attend Town Meeting in the future and Ms. Sivieri replied that she
would attend in the future. Selectman McCue brought up the issue of the tobacco hearing and
asked Ms. Sivieri if she is prepared to sit in judgment and revoke licenses if need be and Ms.
Sivieri replied that she would have to be fair but is looking out for the best interest of the health
of the residents.

Town Manager said that we don't believe we will need a meeting on the 29th, but we reserve the
right just in case. He added that this is the last year of the enabling legislation.
Selectman Amoruso noted that he understands about the higher flows and the need for a
WWTP transfer but questioned the $16,000 for non-vehicular supply. The Town Manager noted
that the money is coming from non-vehicular supply and office supply and is going to the
~ electricity line item. Selectman Amoruso noted that the $20,000 for electricity is a lot that we
missed by. The Town Manager noted that we increased electricity and chemicals for next year.
Selectman Amoruso would like to get more information about why this happened and how we
can handle it next year.

denial of the Route 140 Right-In/Right-Out access.
. Memo from Town Manager John D'Agostino dated June 9th regarding Chapter 1B -
mandatory recycling.
Selectman McCarter noted that we do have a by-law that mandates recycling. He noted that
there is a fine provision. The Town Manager said that it is an issue of enforcement - we would
generate a sufficient amount of revenue at first, following the trucks, issuing tickets.
r'
Chairman Achille doesn't necessarily want to have more workshops - he would like motions on
action, preferably some policies that place the onus on the residents. Selectman McCue agrees
with Chairman Achille. The Town Manager said that the staff will have a proposed policy for
the Board - would we want to have a public hearing for residents ... it is a 3-year contract, so
we need to make a decision carefully.
Board of Selectmen Minutes of June 22, 2005

r'
Chairman Achille said that we could put policies into effect to make it easier for residents to
recycle. He mentioned the idea of stickers for recycling that would be recognized by Waste
Management. Selectman Amoruso said that we can do some things (restrict people to certain
number of barrels, we will not collect trash unless there is a recycling barrel, etc.) ,but we need
to have a public hearing in the fall.
Selectman Dolan wants to find out if we can get stickers for recycling barrels - he would like to
get something going. He thinks he has received enough information from staff about this issue.
Chairman Achille noted that he thinks it is important that residents recycle on their own - why
don't we use stickers for a couple of months now and see what happens. Chairman Achille
noted that the larger barrels can be used for recycling. Chairman Achille wants to look into
creating stickers for large barrels.
The Town Manager met with staff on this issue to discuss increasing recycling and decreasing
tonnage. The issue of reducing tonnage has been achieved in other communities by a modified
pay-as-you-throw - it is hard to get people to do things on their own. We have had this
experiment with the smaller barrels -let's try it with the larger barrels. We have hired a
consultant with the recycling grant to work with us.
r
Motion: To get stickers for large barrels
(Dolan - McCue)
Selectman McCue doesn't believe it would be much of a modification - we would need to notify
Waste Management, etc. The Town Manager said that the contract with Waste Management is
that they produce informational materials per the town's request. Selectman Amoruso asked
about putting the information about this in "Live Wire."
The Town Manager said that he thinks that staff would be providing the Board with more
comprehensive action than just stickers.
Vote: 5-0 Passes
Selectman McCarter doesn't believe that this will make the non-recyclers to begin recycling. He
asked if we are still going to have DPW Director Lee Azinheira come in on the 20th? The Town
Manager said that yes, this sticker campaign is just the first step. Selectman Amoruso noted
that the people said "no cash for trash" during his re-election campaign.
. Letter from MassHighway received June 14th concerning a report of missing posting signs

response to the Board's letter of June 9th asking for clarification on the second stage
performance at the Summer Jam Concert on June Bth.
. Letter from the Town Manager to Mr. George Dentino dated June 21st regarding several
questions regarding the State Building Code.
The Town Manager met with Superintendent Moretti, Assistant Superintendent Linc Lynch and
Dave Young regarding the concept for a community school which have community benefit uses
beyond the traditional classroom uses for the community. We will work together on various
concepts along these lines and will ask the consultants to incorporate ideas as well. The Town
Manager noted that at the initial discussion at the last meeting, he indicated that Dave Young
did not support the community school concept, which is not correct. He apologized for the
misunderstanding.
r' The EACC meeting on Medline is scheduled for 10:00am on Tuesday, June 2Bth in Boston at 1
Ashburton Place on the 20th floor. The Town Manager said that he will be attending.
On June 27th at 10:00am, Chief Bellavance and the Town Manager are meeting with Mike
Shelley from ISO regarding the initial fire rating the Town received, reducing our rating from 4
to 5 out of a possible 10-point rating scale. We have provided additional clarification to ISO.
This rating, if implemented, could adversely affect homeowners policies. He will report back to
the Board on this matter. Selectman Dolan cannot see how many communities could be a 7 or an 8-
maybe if they have a volunteer Fire Department. He also noted that Mansfield has been designated a
'Heart Safe Community.' The Town Manager said that he looked at comparable communities and
noted that we are understaffed with respect to Police and Fire, but we can get by with what we
have. He added that as the population increases, so does our need for public safety.
We have submitted a Bristol Count grant for $30,000 for Alzheimer's bracelets as well as a CD
projector for the Movies on the Common. Selectman Dolan noted that former Selectman Steve
MacCaffrie was pushing for the bracelets and the Town Manager added that he has informed
Steve about the grant.
-
The Town Manager indicated that the Board will need to take a vote relative to his salary
increase for FY06. He received his performance review in December, on his approximate
anniversary date of employment. The budget was fashioned and approved by the Board of
Selectmen, Finance Committee and Town Meeting with the 5% salary I increase. He believes that

r
the Board needs to vote the actual salary increase. The amount yearly is $6,359, bringing his
base salary from $117,176 to $123,535.8B. He added that this amount does not include the
$10,000 stipend for his position as Light Department Manager, so his total salary with the 5%
increase will be $133,535.88
Chairman Achille said that it is the intention of the Board to provide the Town Manager with a
raise and would discuss the exact percentage at the next meeting.
Motion: To provide the Town Manager with a raise
(McCue - McCarter) 5-0 Passes
Motion: To make the raise retro-active to July 1, 2005
(McCue - Amoruso) 5-0 Passes
The Town Manager said that it would be his intention to seek a new contract when it is up.
Selectman McCarter said that he would like to see what the percentage increase is for other
town employees - to make sure it is consistent with other town employees. Selectman Amoruso
asked if the Board could we get a copy of your contract so that they may refer to dates (meeting
contractual deadlines). The Town Manager said that the average increase for town employees is
4.5%. Selectman McCarter said that he remembers a smaller percentage.

Selectman McCue:
.:. Old: The conversation continues as to whether or not the state will reimburse the town
for snow-ice removal. The MMA is not looking for the full $93 million, but we may still

.:. New: He was successful in his re-election to the MPO for another 2 years.
Lenny Flynn was present to discuss the Route 140 access to Mansfield Crossing - he talked to
the JTPG and the TranspoJ;tation Group at SRPEDD and they indicated that they would be
interested in working with the town - getting documents from the town and (traffic study, ENF
report). The Town Manager noted that we set a letter to EOTC Secretary John Cogliano and the

.:. Because of some of the things going on near the train station, we have drawn up a
rationale as to why we want to regulate commuter parking. We are looking to define
and evaluate new town commuter parking opportunities.
Selectman Amoruso noted that we have had considerable problems along the Route 106 stretch
near the Train Station. He is looking for the Board to adopt a moratorium on any additional
commuter parking spaces until January 1, 2006.
Selectman Amoruso noted that in light of: the high number of motor vehicle accidents and in
around the vicinity of the commuter rail station and its attendant public and private parking
lots; the high number of street intersections that experience levels of service "F" during peak
commuting hours of the day in and around the vicinity of the commuter rail station and its
attendant public and private parking lots; the extensive amount of vacant, undeveloped and/or
underutilized land in the vicinity of the commuter rail station; that the Town has recently been
awarded a $50,000 planning grant to conduct a comprehensive planning process in the vicinity
of the commuter rail station, a process that should be completed in late fall 2005; adding any
additional commuter parking spaces through the creation of any new commuter parking areas
or the expansion of existing commuter parking areas will further exacerbate existing problems.

Motion: To place a moratorium on any additional commuter parking spaces until Jan. 1, 2006
(Amoruso -McCue) for discussion
Selectman McCue doesn't want to decrease the number of spaces in the future. He noted that
the people of town meeting weren't supportive of piecemeal zoning changes. He is in favor of
this - he would like to provide additional parking for Mansfield residents but wants additional
parking to be in conjunction with the planning process for the development of land around the
Train Station.
Selectman McCarter said that we are the licensing authority for commuter parking, so people
would need to come to us. The Town Manager said that this will enhance Phase 2 of the train
station parking situation. Selectman Amoruso noted that he would like to look into the issue of
covering the costs of the police details.

noted that it is another example of the town stepping up. Selectman Amoruso noted
that a lot of businesses and individuals have donated money.
