Tfow cnii you discuss my particular situation .then you do riot even knows wlitit the scale is' What you are lookin-.it here is a soil concervati.on map and you have picked out a certain area from that ilap for your own purposes. Mr. Giardina: No, this p articulvx soil conserv.tion map is part of a larger map that is being; used by the Dept. of agriculture. Mr. Taylors I did not ask that question. As far ns the .Dept cf Agriculture Is concerned, Vrio Planning Board has the same soil map . Mr, Giardina- By the way, that is Chad Maurer's map. Mr, Taylor: Let me say this. in this particular incident, this is the point I.would like to make apparent to this Board. ,'There i has been a Board of Health permit-issued, percolation tests had been performed, and a permit was iissued ,;Uy the Bldg. In- spector. 8o, what I am here for tonite is not for a lot where I am looking for relief from, but where a mistake was made by an operator of my equipment, He received directions from me to make an exopvation and 'had stakes to work by. I slave other bperations I am operating on Martha!s Vineyard, in Norwood - other outside operations. In this particular instance at this ti me, `I did not have that much )activity here In Mansfield, so ' I gave my operator instructions to excavate and do a job. I am the one that irresponsible for the end result of something that is done wrong and something was 'done wring - this material' was pushed inadvertently, into a piece of lowland.- I am respon- sible for this, When I was.asked to stop by your Department and the Bldg, Inspector, it stopped..';The• operation ceased - there wae'no defiance - it stopped. What I am seeking tonight, i and I talked to the Dept, of 21titural Resources in Boston about ! 3 this,; is that I did have the two permits. I did inadvertently, because I take the. whole blame for this, allow my operator to move that stuff in; I-am perfectly willing to snythins that this particular commission wants me to do. Tf it vmnLs me to pull the material put of this low area, which is not ,a very -difficult thing, I'can do that. I can build a house with no problem - there was nover any problem as far as building ti.e ' house; There is absolutely no. problom in building the h6uo on this particular lot, building a sanitary system on i lot where the percolation was superlative. This is not the problem The probb m'we face here tvnight.is a simplo ,roblom *..,hero Pox i Run Village ;pushed mator i al into an area the: -•e tl:e law says they did not have any right to. Pox Run Village is perfe:otly willing to pull this material from what you consider n low area. The question Is whether it is 'a loaf area, iikietl.er it is a swamp. And If it is a swamp, whether it is subject; to seasonal. flooding. The Geodetic maps ;here dontt show any stream.. I think you all will recognize these.maps'are extremely accurate. I -r_ If you look at the maps, they don't shorn a body u- wotcr across the street:. There is a body of !cater ac :;s, the street. How did that bod. of ,water get Uero? It was man -made, because you can see on the, further e? :7 of this property somebody ;cast, or 'a machine pushed material into a pile. Fox Run will do -anything, but does ir m;/ !Hind have the privilege to construct a dwelling on that lot. I 'lave discussed this very honestly and laid this out very clear - ly for the Dept. of Natural Resources. Their opinion was that there was almost not a necessity for this ':Ind of a meeting tonight. But we do find ourselves here, and I am not fighting that.` Charles Mesaoely Are you going to build your house, would that require any ,fill or draining on that lot? This would require a Hatch Act if you did. Mr. Taylor: If you would point this out to everyone concerned, I don't know if people are aware of this or, not, 'you see the radius here this is a street that Is proposed to go in. One of the proposed right -of- ways, in the future, as far as subdivision < Is concerned, if we ever did get into this, which we are going to get into,,as far as this particular aright -of- way into the rear land. We hope that cluster zoning is going to become a reality. I talked to Chad Maurer this mornipg, and he feels regrettably that cluster zoning is not going to become a reality in the town because cluster zonin.- is f-oi.ng to favor the developer. I don't believe we will ever make use of this {right. of !.gay. Mr. Ings: It is only on your map, s1r. Yr. Taylors Let me say this. On our rro,.osed subdivision, see the radius here. Mr. Ings: Yes, I lsnow' the radius is there, but it is not on the original property.;' It is only dra,m,up by Tar. Libbey as a proposed road across t!-.o wanp. tor. Taylor: Right.' At this time, let me 'say truthfully that I donut, thinlS we have any .intention u "- lasing tails, clad will tell you why. It Is --trictly cconomics. In' order to put a road In through here, vr'would nave to go 250 - 3C feet wlth utilities etc. Air. ?nfs: But you fine also.sdnitting A, jt It is s!as!i. r; sTay 1 or: No, ;;hat is not the nee.: on- The reason for' a.i andoning this is something we did not realize before. The town of Mans - field!,:has planning reLail.• tions tL-,t say you c -innot de,i.l.lop a subdivision with a_dead end street beyond 500 feet- If you do bring a road In fret: another :tr, et and. make a complete horse - shoe,' and then come back out on the same street, this is per - miscible. We found this out from fine Needle i'ark. But the reason we.are abandoning this is mon-Itary. -6- Mr. Ings: You may have abandoned t1lat... Chairman Button: 'I'm sorry, but I 1111, 'have to stop.'hi2 because it has nothing to ao with the hnsr ng. Mr. Giardina: Mr. Taylor has just admitted the intention of pos- siblysfilling in more of the swamp. I, would like to Point out on this map that after Tutting in the culvert in. October of 1972 Mr. Taylor was instructed.not:to further_ alter the swamp •r'_thout having a Hatch Act Hearing. This map indicates that the edge of the foundation is within the territory indicated as swamp here. I find it hard to believe myself that Mr. Taylor could have ac- cidently filled in part of the swamp right where the edge of his foundation has to be as 'indicub:d by this map. Pur tile rmore0 if we are to believe the area that is indicated as to be filled, whether by this Hatch Act hearing or by another one, there appears to me to be insufficient area to install aseptic system and a ` leaching field. This could cause a seepage of raw sewage; into the swamp. I would think that if there were going to be any construction on that lot, more 'than just that particular area would have to be filled. I have_ some ;other evidence that bears on this, not in particular to the construction on this particular. lot, but to the swamp in general, and :because I feel that it would be necessary for Mr. Taylor to 'fill In more of the area than he Indicated,, I'would like to introduce the evidence. We feel that any filling of the swamp ,would be a detriment to the property of the abutters, . Johh< Turke and myself. It would damage the nature l drainage of.the area, and I pointed out the possibility of septic system leakage from this lot. The swamp is necess ^.r,y/ for flood control. We found this by going to the Easton ,,Iannint 'board: They are eurrer>tly;considering a subdivision proposed by Douglas King which is in the area behind my house. ;It does not show on any particular map here, althou I did draw up a rough sketch.; This is a general.locus of the ?area. The lot in question is right here* 'my house 1s.hore, and John.Turl:ets house is here. This is'a plan of the north. side of the street. Mr. King pro - posed a subdivision that :will encompass 48 acres of development, Mr. Turke: Five of those acres are In Mansfield. Mr. Giardina: In ^the Easton Planning Board there is corresponderce and other indications that consideration was _given to storm drainage and in particular, 1C -year storm flood zones which would indicate that the'develolmmt Mr. King, is proposing is going to cast an 'additional mount of vater into this area here. The map in the Easton Planning Board office indicates that this area I have outlined in orange Is going to cast a groat deal of water into this particular pond. That water, In order to not damage the property of Mr. Turke and myself, has to flow through the pond.-under the street, and has to be able to accumulate in some areas across the street on its ,way down to the Canoe River. There was a'letter in the Easton Planning Board file thciit definitely indi- cated that one of the plans Mr.' Zing was proposing would put a foot =7- of water in ;my basement, and probably a half foot of water in Mr. Turke's' basement. The Easton Planning Boa ",l is holding a public hearing on April 3 to consider the subdivision proposed by Mr. King.; we are concerned that if any of the swamp across the street is allowed to -be filled it will cut d(-:•m on the flood zone area and cause additional ,wator ' to back upor.'.o the proper - ties on myself and Mr. Turke, and into the house. As I have In- dicated before, this map, is the official town map for the soil . conservation service, and indicates 'clearly that t1-ere is water on both sides of the street, and itclenrly indicates that it is swamp, and is part of the Canoe River water shed. I have already explained the problems in constructidi prr,o:;ed here. In conclu- sion, I would like to prctone that this Coinisslon along with U Planning Board have a joint meeting with the Ba -ton Planning Bd. to consider both the -dev'ol opment of Mr. 'Ling'o land and 1.1r. T ayl oc t s .land to determine hat: the f1c. -)d zones are moLectcl. We are of. the opinion that contrary to allowing any filling of the swamp. across the street we would propose that the prese2L culvert under East Street be en arged, or a second `.'culve `L b_- placed next to it. Thank you, Mr. Frank Ings: I would like o give you so ns LTI this rn:a;• I have lived in the area cince 1951. The ho .y of i•r,ter exists t because of a spring, a -ioar -round running spr ng ir< Easton wfhlch was Bart ofia farm in the old days whore they waterod their stock. It flows down through the hills between these two persons' houses, f under, the road, then it 'groes.in this swamp, and than goes out through the :culvert that he has replaced into another general swamp, passes onto my land where the hills rise on either side and becomes a brook. The base of that brook is possibly '15 feet wide at this point, indicating heavy flows of water. At the pre- sent,',the brook itself flows in an area 4 feet apart. Some of ', { the water originates from a spring on my property tha t runs d own Into that area, but most of it 'comes from his swamp. Since I have been there, there has been heavy water flow off and on thru that area, sIn a serious drought, it tends to decrease to a trickle. I was up there last Sunday to inspect what the Hatch Act hearing would have in its 'content* and 'I don't believe this map is to scale although there are measurements on it The ,house = founda- tion itself , if he.is buildingthe same type of foundation that he has built on all his others, is possibly 42 feet long: It doesn't show that there,; although it does shoe ti.zit he. is 15 feet from the border of the property. This would put nearly all of that wall in the swamp, and based on win t lie la s put under there, whioh. he says. is tie stumpage and clearirg s off the land, he would not have any place to ,)ut that wall without going down into the swamp . Mr. ,Taylor: Regarding ,this 1),irt'-ciliar situation, as ;`.r. The relief that Fox Run is.loolcing.for Is that it is willing to remove this mater - ial. 'Fox Run can ;construct a dwelling without touching the low area. Stuart Sweet: Do you have .a definitive plan of that lot shoring the exact location of the house? Mr. Taylor: When you get dmrn to an exrict location, this is not the way you build. Mr. Sweet: You have to show an exact location for the septic tank, do you not? Mr. Taylor: This is a subsequent, thing that the Board of Health re- quires, the As -built Plan. If I dig a hole with my bacichoe, and I drop a tank in there, common 'nonse ;tells me it z impossible to locate it perfectly on the. plan. This is £ir nished to the Board of Health. Mr. Sweet;, After it is -done., I -am curious where your septic tank is going to be ?relative to .the edge of the swamp.- Pete Mason: where will the swmrp be in, relation to foundation of the building? By initially installing the small culvert, he created a run -off that is much largerjhan what had previously existed. Also there is a small gathering pool next to the run -off to take the water out, on his .proposal for a'subdivision, he shows a long frontage on East Street on the southerly side, which_ Is the swamp. The proposed road that he snows on his sketch is'definitely a proposed road. 'A 'could be exercised should the swamp be filled in According to the Assessor in the ,Town of Wortont he is definitely 'concerned about any filling done in Mansfield which would alter the - flow %of the Canoe River. We Seel that before any determination is !made, the town of Easton should also be consulted.: Mr. Giardina: I would life to`make.a final request. Mr. Taylor's map does point out that there is swamp on the northerly side of Mast Street. Secondly, I would request M= 'Taylor to remove the spill where he has already put it, , and I would request the Commission be very ;explicit in those instructions to Mr. 'Taylor.'
