JHL:jc Attachments July 3, 1985 TOWN OF MANSFIELD MUNICIPAL ELECTRIC DEPARTMENT MANSFIELD, MASSACHUSETTS 02048 MEMORANDUM 1 To: Light Commission f From: John H. Larch, Managert } Re: Street Lighting on Private Way at Clemmey, Inc. It has come to my attention that there are five street lights in the private way between West Street and the entrance to Clemmey, Inc. that are not being paid for as security lights. Mr. Clemmey claims that the Town agreed to light this private way for him in 1974. He has copies of correspondence with officials of the Town at that time indicating that the matter was discussed. I have found nothing that definitively says the Town agreed to this. It is my opinion that it is improper for the Town to put lighting on a private way now and it probably was then.. Further, it has come to my attention that Mr. Clernney has in his posession two flood lights belonging to the Mansfield Municipal Electric Department. His contention is that the Department loaned him these lights to use for lighting his property. I am requesting the Board to instruct me to remove the street lights on the private way and reclaim the flood lights belonging to the Department. I am also requesting the Board to seek a legal opinion on whether or not we can claim any restitution in this matter. I have asked Mr. Clemmey to attend the July 8, 1985 meeting to present his side of the issue.
