One was the No Main Street renovation and the other was the Upper No Main Street where electric lines are already underground and we are requesting the phone company to put their lines underground as well. Bob Rodophele discussed the various alternatives the Board can take in order to remedy the conflict with the phone company. The Board can request a change of legislation. The Board could also request another Town Meeting to try to get a positive vote from the Town or a Home Rule Bill or all of these alternatives. Mr Rodophele advised the Board that the crucial issue to determine is , "What existing rights does the phone company have?" In order to determine this Mr. Rodophele advised the Board he must have the pole location and grants. John Larch will work with Tom Dwyer to get the necessary paperwork to Mr. Rodophele. MUNICIPAL CABLEVISION: Bruce Singal advised the Board that the Town's options are very limited since they are governed by Federal Law. The Town must give notice to the present operator indicating what its deficiencies are. The renewal process requires the Town to assess financial capabilities, compliance with license and quality of service. An administrative hearing must be held and in order not to renew the license, the current operator must be remiss in one of the areas listed above. Mo Prassard advised that to date, MassCablevision has been cited with 269 violations. CREEDEN STREET LEASE: Mr. Larch advised the Board that the Electric Department's lease at Creeden Street expires 9/30/90. The Board advised the Manager to extend the lease for an additional six months, with a stipulation that both tenant and landlord will provide 90 day notice. In addition, the lease can be extended in three month increments. During this time, a cost study will be undertaken to determine the feasibility of moving the Electric Department into the old Post Office.
