Board of Light Commissioners :`.L]
Minutes of Meeting T, DEC 13 A; i 10: 10
November 1, 1994
PRESENT: Chairman Penney, Commissioners Ronald, Royle and Robinson.
Commissioners Pasquale was absent.
Meeting called to order at 7:05 pm
Developers Connection Fee:
The Chairman welcomed the three developers present at the meeting; Paul Folkman, Jay
Zola, Dave Kuntz. The Chairman stated that he realized this was a very controversial
subject and said he would like to take comments from the developers first and then the
electrical inspector, Dave Conley, and then have the opportunity to discuss the comments
among the Board with no interruption from the guests.
Paul Folkman stated that he had no problem with the developer's connection charge, but
he did have a problem with the way the developer's connection charge would be
administered. Mr. Folkman stated that he would like to exempt any applications for
which a signed purchase and sale agreement has been executed prior to November 1,
1994. Mr Folkman explained that for any house lots for which he has a signed purchase
and sale agreement, he can not change the purchase price of the home and therefore he
would have to absorb the cost of $1350.00 per house lot and this money is not in his
budget.
The Manager agreed that this was a good idea, but it did not address the issue of all the
applications that have been received prior to November 1, 1994. The Manager suggested
that for all applications filed prior to November 1, 1994, we stipulate that the meter must
be installed within 90 days, otherwise the application would be invalid and a new "?
application would have to be filed subject to the applicable connection charge.
A lengthy discussion followed among the Board, the developers and the Manager. Dave
Conley arrived and his input was received and also discussed.
MOTION: For purposes of implementing the connection charge policy of November
1, 1994, there are two exemptions. If an application for service is made prior to
November 1, 1994, it shall be considered valid for sixty (60) days from the date of the
application. If a permanent meter is not installed within this time period, the application
shall be deemed to have expired and a new application for service, subject to applicable
connection charge, will have to be made.
