He said he met with Nick Riccio, Building Inspector and Zoning Enforcement Officer, to try to find any pre- existing permits for the sign from the original construction. Mr. Clark said no permits were found but that Mr. Riccio felt a permit would not have been required at that time. Mr. Clark said the existing structure consists of a steel frame with T111 plywood siding with individual sign panels. He said the existing sign is in extreme disrepair. The proposal is to leave the steel support structure in place and reface the sign with a new cedar lattice background with high- density urethane (sign foam) panel signs. Mr. Clark said the proposed changes will not be more adverse than the existing condition. He said the placement, height and size of the structure and landscaping would not change. Mr. Clark explained this is the primary entrance sign for Mansfield Meadow Apartments, as well as the communities of Edgewood Condominiums, Village II Condominiums and the Mansfield Woods Condominiums. 1 Mr. Clark said the management company has changed, requiring changes to the information currently on the existing sign. Mr. Mackie asked when the management company changed. Mr. Young said his company took over the management of the property a year ago. Mr. Vultaggio said he would like to see the differences between the existing and proposed signs; the applicant only provided the dimensions of the proposed sign. He said the board needs to know if there is an increase in the non - conformity and if the proposed changes will be more detrimental. Mr. Clark said there is no increase from the existing structure. Mr. Vultaggio asked Mr. Clark to provide dimensions for the existing and proposed sign and a certified plot plan signed by a land surveyor or engineer showing the location of the existing sign. Mr. Mackie made the motion that the change to the sign is an increase to a non - conforming, pre- existing structure in a Residential 1 Zone. Ms. Garber - Miller seconded the motion. Motion passed 4 -0 -0. Mr. Mackie made the motion that the increase to the pre- existing, non - conformity is no more detrimental than the existing conditions. Ms. Garber - Miller seconded the motion. Motion passed 4 -0 -0. Discussion: Mr. Mackie asked if there would be any additions or changes to the existing lighting. Mr. Clark explained there are two ground lights, one on each side of the existing sign and this will not change. Mr. Vultaggio asked that the lighting information be included on the plot plan. Mr. Luca, a resident of the community, said the sign is in very bad shape and can't be seen clearly from the road. Mr. McKenna said the sign is hard to see from the road and the proposed sign will be an improvement. Ms. Garber - Miller asked if there would be internal illumination for the proposed sign and if the colors of the sign would be as depicted in the photos submitted. Mr. Clark said the two ground lights would be the only lighting. He said the lattice work for the sign will be stained and the panels will be red and green. Hearing ended at 8:00 pm. 3. Peter and Julie Smith, 60 Old Stable Drive, Map 41, Parcel 371. The application is for a Variance from Section 4.2.1, front yard setback, of the Zoning By -law to construct an in- ground swimming pool at 60 Old Stable Drive, a corner lot where a 40 -foot setback on both sides of the lot having street frontage, in the Residential 1 (111) Zone. Homeowner Julie Smith and John Boulanger of Ferrari Pools and Patios were present. Mr. Boulanger explained this is a single - family home on a corner lot. Because the corner lot requires a 40 -foot front yard set back on both sides of the lot having street frontage, and the unique shape of the lot, the area available for the pool is limited. The 29'x 43' pool with spa will be 30.3 feet from the lot line as per the plan. Mr. Mackie asked if the pool measurements include the apron around the pool. Mr. Boulanger said there will be a patio around the pool and spa. Dina Platsidakis of 59 Old Stable Drive said she supports the addition of the in- ground pool. Ms. Smith said she has spoken to other neighbors and they also support the pool addition. Mr. Luca made the motion to approve the request for a Variance for relief from the 40 foot front yard setback requirement for 60 Old Stable Drive for the installation of an in- ground swimming pool and spa with a 30.3 - foot setback as shown on the plan dated March 27, 2012. Ms. Garber - Miller seconded the motion. Motion passed 5 -0 -0. Discussion: Mr. Mackie said because it is an unusually shaped corner lot, not much can be done as far as placing the pool on the lot. Ms. Garber - Miller said there is no other place to put the pool. Mr. Luca said this is a cul -de -sac with only one other house and it is not a through way. Mr. McKenna said the pool will not be visible from the roadway. Hearing ended at 8:05 pm. 4. JAB Construction LLC, 47 High Street, Map 21, Parcel 139.
