EXECUTIVE SESSION
Mr. DeTrolio stated that approximately 3 weeks ago, Mr. Rapoza got in touch with Mr.
DeTrolio and asked what happened with the Cell Tower on Gilbert Street. Mr. Rapoza
had heard that this matter had gone to court and the Town lost the case in court because
the Town decided not to defend the Decision of the ZBA. The Federal Judge ruled in this
matter and the cell tower will now be built in West Mansfield on the Doranco site.
The circumstances were that the applicant appealed and Town Counsel, Bob Mangiaratti
failed to respond within the 21-day appeal period. Town Counsel stated that he never
received the Appeal, but the Town Clerk's office mailed them a copy, which is their
procedure when an appeal is filed. Mr. DeTrolio obtained a copy of the Appeal that was
dated stamped by his office showing that they had received it.
Mr. DeTrolio was very upset that the Board of Selectmen, Town Manager and the
Planning Board met in Executive Session and discussed this matter without involving the
Zoning Board.
The Board went out of Executive Session at 8:15 p.m.
