The Board of Appeals held its regular meeting in the Town Hall, Mansfield, MA, at 7:30 P.M.
Present at the hearing were the following members: Donald Daniels; Leonard Flynn; Eric Butler;
Richard Devine; and Olivier Kozlowski, Associate Member.
Donald Daniels was appointed Acting Chairman for this meeting. Leonard Flynn was appointed
Acting Clerk for this meeting.
No hearings were scheduled for this meeting. A decision was to be decided on the application of
Peter and Rose Parente for a Variance from Section 4.2.1 and I.S.17a of the Zoning By -Law to
allow for the use of a single family house lot with less than the required lot frontage, area, and
width, said lot located in the R -1 Zone, adjacent to the house at 2 Grove Street, which had been
continued from May 6, 1997 meeting.
A motion was made by Mr. Butler and seconded by Mr. Flynn to grant a Motion to Mr. and Mrs.
Parente. The Board discussed that no one can give up any land to make this a conforming lot; the
lot has been in single ownership since 1967; and protection was lost with the 1989 zoning change.
Mr. Flynn stated that this is an unfortunate situation but feels that it derogates from the intent of
the Zoning By -Law, it will set a precedent, and there is no hardship on the land.
Mr. Devine stated that this is a unique situation. The owners have maintained the lot and the
intent was for a personal reason and they are not straying from the intent of the By -Law. Mr.
Devine further stated that the intent was to reduce future building in the town; not from single lot
owners who have owned these lots for years.
Vote: Yes - Devine - Butler - Daniels No -Flynn -Kozlowski ( Motion Denied )
A motion was made by Mr. Butler and seconded by Mr. Flynn to approve the Minutes of June 3,
1997. Unanimously approved.
