Mr. Vultaggio was appointed voting member in place of Mr. Secher for this hearing. Mr. Kozlowski was appointed voting member in place of Mr. Daniels for this hearing. The application was labeled as Exhibit "A'; a newspaper advertisement as Exhibit "B'; and a Zoning Board Plan for Clinton Street dated January 3, 1997 prepared by Hutchins- Trowbridge Associates, Inc., Mansfield, MA, was labeled as Exhibit "C ". Mr. Flynn read a letter from the Planning Board into the record. "With five (5) members present, they voted unanimously to send a negative recommendation on the application." Mr. Butler asked the applicant to present his case. Attorney James Thrasher stated that he is representing the applicants, John Scarpellini and Barbara Carney. The applicants are owners of a vacant parcel of land on Clinton Street and an abutting parcel at 31 Clinton Street, by virtue of a deed from their mother, Mary Scarpellini. The vacant parcel of land contains 13,600 square feet of land where the minimum is 20,000 square feet. Minutes of March 18, 1997 Page 3 of 3 The parcel of land was bought by the petitioner's father, Gino Scarpellini, a lifetime resident of Mansfield, in the 1960's, and there was a general store on the property. Gino closed the store, had the building demolished and had the land prepared as a suitable building lot. Up until his death, and the death of his wife, they expressed to their children that this was a buildable lot for a home to be built, and they believed this to be true because there were separate deeds on both parcels of land, and that taxes have been paid on this lot since the 1960's. The applicants feel that this lot is larger than many of the developed parcels of land in this neighborhood. Also, this lot has been well maintained as if it were a park for many years. An abutter, Mr. James Hindman of 78 Brook Street, was in full support of this variance request. Abutters, Scott Sachs of 100 Pleasant Street, and Sarah Forbes, 1 Clinton Street, were against the variance. The hearing closed at 8:30 P.M. A motion was made by Mr. Butler and seconded by Mr. Kozlowski to approve the special permit for the Country Store. Unanimously granted. A motion was made by Mr. Vultaggio and seconded by Mr. Flynn to grant a variance to Mr. Scarpel ini. Those in favor - Butler. Those opposed - Flynn, Devine, Vultaggio, Kozlowski. Motion denied. Reasons - No demonstrated hardship. A motion was made by Mr. Devine and seconded by Mr. Kozlowski to approve the Minutes of March 4, 1997, with amendments. Minutes Approved with (1) abstention - Mr. Butler. 9:45 P.M.
