The Board of Appeals held its regular meeting in the Town Hall, Mansfield, MA, at 7:30 P.M.
Present at the hearing were the following members: Donald Daniels, Acting Chairman; Eric
Butler, Acting Clerk; Leonard Flynn; and Duane Frederick, Associate Member.
Mr. Frederick was appointed voting member in place of Mr. Secher for this hearing.
The hearing on the application of Donald and Joanne Brais for a Variance from Section 4.2.1 of
the Zoning By -Law, to allow for a garage and mud -room addition, located at 5 Coach Road in
the R -1 Zone, with less than the required sideyard setback began at 7:35.
The application was labeled Exhibit "A "; newspaper advertisement as Exhibit "B "; and a Proposed
Building Addition to Lot 5 House No. 5 Coach Road dated July 25, 1996 prepared by Rim
Engineering Co., Inc., Mansfield, MA, was labeled as Exhibit "C ".
It was explained to the applicant that only four (4) members are present and the granting of the
variance will require 4 unanimous votes. Applicant decided to wait a few minutes to see if any
other members arrive.
The hearing began at 7:45 after the applicant Donald Brais decided to proceed with the four
members present.
Mr. Daniels asked the applicant to present the case.
The applicant explained that the project involves the addition of a breezeway and a garage. Mr.
Brais stated that since the existing house is set on an angle to the street, this makes it very difficult
to place any garage addition without needing a variance. The garage will fit into the character of
the neighborhood. No abutters were present but the direct abutter to the east of the Brais'
property, the Shiffer's, sent a written letter which was attached to the application, indicating that
they do not object to the proposed addition.
The hearing closed at 7:55 P.M.
Minutes of August 20, 1996
A motion was made by Mr. Butler and seconded by Mr. Flynn to grant the variance based on the
fact that the location and placement of the existing house creates a unique situation and that
granting the does not involve substantial detriment to the public good and does not substantially
derogate from the intent of the Zoning By -Law, especially since the area used to have a 15 -foot
side yard setback. Voted 4 -0. Variance granted.
A motion was made by Mr. Butler and seconded by Mr. Flynn to adjourn the meeting at 8:05
P.M.
Respectfully submitted
Eric Butler, Acting Clerk
