I
EXECUTIVE SESSION
A motion was made by Mr. Butler and seconded by Mr. Daniels to go into Executive Session at
9:00 P.M.
Attorney Bob Mangiaratti set up this meeting to discuss the pending case of Great Woods and
Mr. Clemmey that is lying dormant in the Land Court.
The Selectmen feel that Mr. Mangiaratti should file an appearance with the Court and monitor it,
in order to close this matter and get it off the books. The situation is that Great Woods was
granted a variance for unpaved parking. Great Woods never filed the decision in Court, but
came back to the Board with a change in the owner on the Notice of Variance form more than
one year after the original Decision was granted. The Zoning Board made the change on the
Notice of Variance form and that was then filed with the Court. Mr. Clemmey appealed their
Decision stating that the Building Inspector should not have given them a permit for the unpaved
parking since the Decision was never filed and the Decision expired after one year. Great Woods
needed to reapply for another variance. The Zoning Board agreed with Mr. Clemmey and
overturned the decision stating that the Decision had expired.
The risk in letting this lie dormant is that other applicants for parking may use this as an example,
because Great Woods in effect are using their lots illegally.
Mr. Mangiaratti is planning on calling their attorneys and asking them to seek a new variance or
he will seek enforcement action.
A motion was made by Mr. Butler and seconded by Mr. Flynn to go out of Executive Session at
9:30 P.M..
