If A aS ?i; iUSLT 1 S February 16, 1993 The Board of Appeals held its regular meeting in the Town Hall, Mansfield, MA, at 7:35 P.M. Present at the hearing were the following members: George Wojtkiewicz, Chairman, Leonard Flynn; Karl Clemmey; Eric Butler; Richard Secher, Associate Member; and Peter DeTrolio, Associate Member. Leonard Flynn was appointed Acting Clerk in place of Mary-Lou Cotton. The hearing on the application of Paul Schulz, Jr. for a variance from Section 4, Schedule 4.2.1 of the Zoning By -Laws to allow the construction of a single family residence on a lot with less than the required minimum lot frontage at 172 Balcom Street in the R -1 Zone. The proposed lot will have zero feet frontage where 150 feet is required. The hearing began at 7:35 P.M. The application was labeled Exhibit "A "; newspaper advertisement as Exhibit "B "; and a Plan of Land dated January 5, 1993 prepared by Hutchins- Trowbridge Associates, Inc., as Exhibit "C ". Mr. Flynn read a letter from the Planning Board into the record. With seven (7) members present they voted unanimously to send a negative recommendation on the above referenced application. The applicant should explore other alternatives to a variance such as the residential compound by -law, which would address adequate access to the lot for fire and other emergency apparatus and would alleviate address problems. Mr. DeTrolio was appointed voting member in place of Mrs. Cotton. Mr. Wojtkiewicz asked Mr. Schulz to explain his hardship. Mr. Schulz explained that his parents would like to give all of their children one house lot, have them build homes and create a compound residence. The only child ready to build a home now is Paul Schulz. Mr. Schulz does not want to subdivide the land up now, put a road in (because they would have to pay taxes and he would have to pay for the road being put). He cannot afford to do this now. Mr. Schulz further explained that he has been advised by Mike Trowbridge who told Mr. Schulz that he couldn't subdivide now for two lots and resubdivide later. Mr. Flynn explained that he could draw up a paper subdivision of six lots and only build and improve one lot. What Mr. Schulz is requesting is to put two houses on one lot. Mr. DeTrolio stated that if Mr. Schulz establishes the subdivisions he has to put the entire road in. Mr. Flynn stated that Mr. Schulz should discuss this matter with the Town Planner, Shawn Burke, not Mike Trowbridge. Mr. Wojtkiewicz explained that Mr. Schulz has two different options. (1) A residential compound for brothers and sisters; or (2) a subdivision. Mr. Wojtkiewicz asked Mr. Schulz if he wants to continue this hearing until he can talk to Shawn Burke and get the facts and find out all of his options. Mr. Schulz stated that he would like to continue the hearing and speak with Mr. Burke. A motion was made by Mr. Clemmey and seconded by Mr. DeTrolio to continue the hearing until March 16, 1993. The hearing closed at 7:50 P.M. The Minutes of February 2, 1993 were unanimously granted with one (1) abstention from Mr. Clemmey. A motion was made by Mr. Butler and seconded by Mr. DeTrolio to go into Executive Session. The meeting closed at 9:00 P.M. Acting
