2. ZBA recommendation — 11 Horseshoe Loop — Rear Yard Setback / September 11, 2013
memo from Mr. Burke suggesting a positive recommendation
Mr. French said the lot is oddly shaped with frontage on two streets. The original deck was
non - conforming and requires a variance to legitimize it.
Motion: To send the ZBA a positive recommendation because of the odd shape of the lot
and because extending the deck will not create any additional non- conformity.
(Feck - McClanahan) All in favor. PASSES

2013 memo from Mr. Burke suggesting a positive recommendation

been found in the ground. Mr. McClanahan said the proposed landscaping use would be
less detrimental than the concrete forms business. Ms. Ashman- Collins said she was
concerned about the noise from a landscaping business impacting the day care center next

likely to take good care of the property than if he was simply a tenant.

town and Keep Mansfield Beautiful will be planting the whiskey barrels this Saturday.
Mr. Penney asked about cutting back the Middle Common; Ms. Collins said the Garden Club has
cut back the shrubs. Mr. McClanahan said there is still a sight distance issue in that area.
3. ; Foi m A' (ANR) plans
Michael Trowbridge, Hutchins - Trowbridge Associates, explained the plans to raze the existing
building, the former West Mansfield Variety. Mr. Trowbridge said the site was permitted in
2005, but the permit was appealed. This plan includes a smaller building, 48'x80', 3,840 square
feet, with 21 parking spaces in the front and two handicapped spaces. The site has 35.71% open
space with a buffer along the Elm Street and residential sides of the site; the FAR is .145.
Trowbridge explained the landscaping plan includes a white, six -foot vinyl fence, inset on this
property, along the residential property lines; six -foot high evergreens between the fence and the
new building; and three -foot tall holly bushes to help prevent headlight glare.
Mr. Trowbridge said the site is on septic and has town gas, water and electricity.
Mr. Trowbridge presented a rendering of the building, which he said is in keeping in character
with the neighborhood.
Mr. Trowbridge presented the lighting plans, including specs and fixtures, night lighting, and a
photometric plan.
Department Head Comments
August 19, 2013 memo from Katelyn Merrill, Conservation and Enviromnental Planner; August
19, 2013 memo from Mr. Burke; September 10, 2013 memo from Richard Alves, Town
Engineer; September 10, 2013 memo from Mr. Burke
Mr. Trowbridge said there will be a brick walkway with a flagpole, which is not intended as a
dining area, and an eight- bicycle rack.
Mr. Trowbridge said the specs for the 2,000 gallon oil -water separator tank call for a 3" wall
with a 6" top, but at Mr., Alves' request, that will be changed to a 4" wall.
9/11/2013
Mr. Trowbridge said Mr. Alves has suggested moving the manhole to create an angle greater
than 90 degrees between the inlets and outlets of the drainage structures.
Mr. Trowbridge said Mr. Alves is concerned about sheet flow onto Coach Road. He said spot
grades have been taken and all water will flow toward the catch basin on site. Mr. Trowbridge
noted they did not do pre- and post - development drainage because the site is already paved. He
did the post - development drainage, which has been designed to keep the water on site.
Mr. Trowbridge said at the latest, construction on this site would begin in the spring. He said
hours of construction and delivery of construction materials will be 7 am to 7 pm, with no trucks
allowed to idle longer than 15 minutes. He said the retail store will not be open 24 hours.
Mr. Cleary asked where the delivery trucks would park; Mr. Trowbridge said trucks for both
businesses would park in the designated delivery area and not go around the back of the building.
Mr. LeBlanc asked about the dumpster. The board discussed requiring a side - loading dumpster
with a plastic lid.
Mr. French asked whether the plans call for white pine or arbor vitae; Mr. Trowbridge said they
will use arbor vitae. Mr. French suggested planting them six feet rather than eight feet on center.
Mr. Penney said his company conducted an enviromnental assessment on this property and he
would participate in the discussion but abstain from the vote.
Mr. Penney said this is the second application submitted under the new site plan approval
process and said he is impressed with the plans. He asked how much more work this took than
under the old site plan process; Mr. Trowbridge said it was not much more work. Mr. Penney
said the renderings are helpful.
Mr. Penney asked about pedestrian access. Mr. Trowbridge said there is no sidewalk on this
side of Elm Street, but there is one on Coach Road.
Mr. Penney asked if the abutters have been notified of the meeting. Mr. Trowbridge said this is
not a public hearing, so abutters were not notified. He said he believes the abutters had a
problem with the five -foot buffer proposed in the 2005 filing was the five -foot buffer; he said
this plan meet all the buffer requirements of the Zoning By -Law.
Mr. Trowbridge said they aren't certain what the restaurant use will be, but said it would likely
be something like pizza.
Mr. Cleary asked about snow removal; Mr. Trowbridge said there is a very small amount of
storage on site, but most of the snow will have to be removed.
Motion: To approve the site plan application for the proposed retail and restaurant building at
428 Elm Street, as shown on the plans dated May 31, 2013 and revised September 3, 2013 by

Lighting; and the undated "Rendering," (Sheet Al) by Jodice & Sons, with the following
conditions:
1. All department head comments (attached) must be completely addressed. Specifically,
the Town Engineer's September 10, 2013 comments must be fully and satisfactorily
addressed;
2. The site should have a side- loading dumpster with a plastic lid;
3. The arbor vitae along the residential property lines should be planted six feet (6') on
center.
(McClanahan- Collins) Six in favor. Penney abstained. PASSES
James DeVellis, DeVellis - Zrein, introduced property owner Sam Patel; Ed Tartufo, Jack Conway
Associates; and Jeff Salmeri, Dynamic Dental
Mr. DeVellis explained the plan changes following staff and Planning Board comment. The
board's requests at last meeting included pedestrian access from Chauncy Sheet to the building,
bike racks and detail about the easements. Mr. DeVellis presented architectural renderings.
The plan shows a sidewalk from Chauncy Street to a curb cut at the building, six bike racks and
the proposed access and utility easement. Three existing curb cuts will be closed up and one
shared curb cut for the new building and the existing office condominium building at 272
Chauncy Street will be added.
Mr. French asked if a MassHighway permit will be necessary for work on Route 106 (Chauncy
Street). Mr. DeVellis said it will be, but must be submitted by the town. He said he is with Mr.
Alves on that permit.
Mr. DeVellis explained the architectural and building plans for the building. Mr. Salmeri
explained they designed the dentist's office so the examination chairs all face windows. I-Ie saic
they are planning to add a charging station for electric vehicles in the parking lot. Mr. DeVellis
explained the plans for the retail tenant, Advanced Auto. Mr. McClanahan asked if the colors
shown on the renderings are the colors that will be used on the building. Mr. DeVellis said they
will be.
Mr. Patel explained he did not want the building to be bright. He said his architect visited the
site and designed the building with the understanding this site is at an entrance to the town. Mr.
McClanahan said the proposed building will fit in with the existing buildings in the
neighborhood. Mr. Patel said he did not want a retail building with a flat roof, so the architect
included some architectural details.
Mr. DeVellis said they would be happy to return to the board with a complete signage package
when it is worked out. Mr. Penney asked if the 16- square foot sign requirement would be
difficult; Mr. DeVellis said it was, but they may be able to work with it. He said if they cannot,
they would investigate a variance.

19, 2013 memo from Mr. Burke; September 10, 2013 memo from Mr. Burke; September 11,
2013 memo from Richard Alves, Town Engineer
Mr. French asked if any work within Route 106 would be necessary; Mr. DeVellis said a small
amount of work would be needed for the curb cuts and new water and gas lines. He said
construction will likely begin around the time the curb cut moratorium ends.
Mr. DeVellis said he is confident he will be able to address Mr. Alves' remaining concerns.
Mr. Penney thanked the applicant for addressing the board's concerns so quickly. He said the
sidewalk from Chauncy Street and the bike racks are nice additions. Mr. DeVellis showed the
board specs for the bike racks, which are shaped like teeth and cars. Consensus of the board was
that the members like the unique bike racks.
Mr. Penney asked about the access easements; Mr. DeVellis said the condo association will be
meeting soon to go over the easement agreement. Mr. Penney asked what the options would be
if the easements do not work out. Mr. Salineri said they would have to use one of the existing
curb cuts. Mr. French noted this plan provides additional parking spaces for the existing office
building. Mr. Penney said removing the existing curb cuts and sharing one is a good idea.
Mr. Penney asked about the Town Engineer's comments. Mr. DeVellis said they will be
addressed.
Ms. Collins said she likes the renderings and the unique bike racks.
