PASSES [Mr. Oreste arrived at this time] 3 Lots on Saddle Ridge Road (corner of Black Pond Road) Mr. Burke explained the Planning Board endorsed a Form A plan for this parcel on January 11, 2010. The plan has been revised to change the shape of Lot 1A. Each lot has been changed to show each lot having adequate frontage, area and lot width. Mr. Burke suggested the plan warrants endorsement. Motion: To endorse the ANR Plan (McClanahan - Cleary) All in favor. PASSES Mr. Burke told the board he attended a Mass Department of Transportation meeting today and found out there may be a way to get a project to DOT without first getting it on the TIP. He said as he understands it, a project can be submitted directly to DOT, and if it Planning Board 1 617/2012 deems it worthy, DOT will submit it to the Regional Planning Agency for inclusion on the TIP. Mr. McClanahan said there is a lot of funding available for "green" projects. Mr. Burke said one of the things that hurts Mansfield in those arenas is the town's municipal electric department, which eliminates the town from eligibility for a lot of that funding. 6._ Sub WNWu "Public Hearing continued — Liacoln Place —10 Lots off Branch Street- ,Morse Ralph Maloon, RIM Engineering, explained the changes to the plan, including a proposal to give the "remaining land" to the town. The parcel can be accessed from the bike path. Mr. Maloon explained the current plan shows the connection to the bike path going through the drainage easement rather than over a lot. Mr. French said at the last meeting, the board discussed not diverting the bike path through the subdivision. Mr. Maloon explained the changes to the drainage system, including the extension of sewer to the Nicodenms lot. Mr. French asked if the proposed roadway is wide enough for a bike lane. Mr. Maloon said it is a typical five -foot sidewalk. Mr. French said he doesn't have a problem with an access from the subdivision to the bike path, but he is not in favor of diverting the bike path through the subdivision. Mr. Maloon explained the changes to the entrance. Arthur Courtemaclhe, Branch Street, said he is concerned the proposed road lines up with and is the same width as his driveway across Branch Street. He said he is against that layout and against moving the light pole. Mr. Maloon explained he has met with department heads, who recommended the road be 90 degrees, but he said that layout would have pointed the traffic right at Mr. Nicodemus's house. However, he said when he moved the road again to a 15- degree angle, it was right across from Mr. Courtemache's house. Mr. Maloon said there is a three -foot strip on either side of the bike path. He said to keep the bike path level, the first portion of the new road would look like a driveway, with stop signs and stopping blocks. He said the portion that crosses the bike path would be asphalt. Mr. Burke suggested painting the crossing, similar to what was done at the bike path crossing on East Street. He said Mr. Maloon's design will be wide enough to accommodate most car's wheel bases and the 15- degree angle will cause a car to rock a bit, forcing drivers to slow down. Mr. Maloon said there is a 15- degree radius on the inlet on both sides, which will also slow traffic. Mr. Burke said the removable bollards will remain, but the guard rails will not be installed, as requested by public safety. Mr. Maloon said Branch Street is super- elevated, so the sidewalk will have to be raised. FIe said most of the bike path is one percent or less, so he will bring that grade from one to three percent and back again. Planning Board 2 6/7/2012 Mr. Maloon said the portion of Branch Street in front of Mr. Nicodemus's house would not be abandoned, and Mr. Nicodemus would retain his Branch Street address, with a stone wall, conifers and a fence added. Department Head Comments The clerk read memos from the Engineering, Police, Fire and Conservation Departments. Mr. Maloon explained the sewer is being extended to Mr. Nicodemus's house and questioned Mr. Alves's request to extend it farther. Mr. Nicodemus said all he has asked for is a stub to his house for a future tie -in. Mr. French said that seems reasonable. Mr. Maloon said the sewer line had to be lowered to get separation from the water line. Mr. Burke asked where the headlights will shine and where a car would go if it does not stop at the op at the stop sign with the proposed layout. Mr. Maloon said a car would go into the driveway of the house across the street. Mr. Burke asked about either adjusting the centerline of the proposed road or relocating Mr. Courtemache's driveway. Mr. Courtemache said the curve at that point of Branch Street is bad now and asked why the existing road couldn't be used, which would avoid using Branch Street. Mr. Maloon said that was his original plan. Mr. French said that seemed cumbersome and would result in difficult sight distance and turns. Mr. Courtemache said he was concerned about the proposal to remove the third pole on that corner of Branch Street. Mr. Maloon said he thinks that pole can be moved six or seven feet rather than the 30 feet currently proposed. Mr. Maloon said he will be filing a Conservation Conunission Notice of Determination for the roadway. Public Comment The clerk read letters from Aaron and Martha Nicodemus, 245 Branch Street and Dawn Lowe, 180 Branch Street. Mr. Nicodemus said he believes his concerns have been addressed, but said he would like to be reassured his address will not change. Mr. Maloon said the construction entrance has been relocated and will use crushed stone. Board Comment Mr. McClanahan asked Mr. Maloon to ensure all the plan sheets agree. Mr. McClanahan asked about Mr. Nicodemus's address; Mr. Burke said the Board of Assessors assign street addresses. Mr. Jodice said moving the driveway wouldn't necessarily change the street address. Mr. Burke agreed. Mr. Nicodemus said he is concerned because all the plans he has seen show his portion of Branch Street being abandoned. Mr. Maloon said he will leave that an active road. He noted he will have to get the Board of Selectmen's permission to cross the bike path, and at that time he will ask that the portion of Branch Street in front of Mr. Nicodemus's house remain an active roadway. Planning Board 3 6/7/2012 Mr. Cleary asked who owns the lot with the access and utility easement. Mr. Maloon said it would be deeded to the town with the roadway and possibly the open space. Mr. Burke said the easement should be taken with the road if it is accepted as a public way, and the open space should be taken separately. Mr. Cleary asked about the cape cod berm waiver. Mr. Jodice said the board typically does not allow the use of cape cod berm near the center of town. Mr. Cleary asked about the affordable housing component. Mr. Burke said it will have to conform to the by -law with one affordable lot, which would be put under covenant. Mr. Jodice said he is concerned about Mr. Courtemache's comments, and about the Fire and Police Chief's memos that the plan is the best that can be done. Mr. Burke noted the landowner has a right to develop his land, and the board has to look at a plan under all the applicable laws. Mr. Jodice said he is concerned about safety; Mr. Burke said every time a new intersection is created, potential safety issues are created. Mr. Courtemache said he is not opposed to the land being developed, but is concerned about the location and width of the road. Mr. Burke said when the plans are revised, he will redistribute them to the department heads, along with the minutes, and request final continents. Mr. McClanahan said he is concerned about creating a second loop for the bike path through the subdivision. Mr. Maloon said the subdivision would only have a five -foot wide sidewalk, and the path through the subdivision would be intended for the residents. He said the original plan to divert the bike path through the subdivision has been revised and that is no longer planned. Mr. Ragazzo said he agrees with Mr. Jodice's concerns. He said he is against the bike path going through the neighborhood and he would not want to see the path go through the wetland area. He said the proposed roadway is not being made wide enough for a bike path, which could be dangerous for bike riders and with people leaving their driveways. Mr. Maloon asked if the sidewalk should be brought up to the bike path. Mr. French said it should. Mr. Maloon said he would remove the "shared path" along Lincoln Road and leave the sidewalk. Mr. Oreste commended Mr. Nicodemus on the amount of research he has done. Mr. Nicodemus said he would like the fence on the lot line between his lot and Lot 10. Mr. Maloon said the new plan shows a fence, but he has not determined the height. Public Comment Ken Morse, property owner, asked about the town engineer's comments. Mr. Maloon asked the board if he should remove one sidewalk from the plan; he has asked for a waiver, but the full sidewalk is still shown on the plan. Mr. French suggested running the sidewalk from the entrance to the driveway of Lot 7. The board members agreed. Mr. French said this is a dead -end street with no through traffic, but a partial Planning Board 4 6/7/2012 sidewalk would still provide the residents with a way to walk safely on their road, as well as reduce impervious surface. Mr. Cleary asked the size of the cul -de -sac. Mr. Maloon said it has a 62 -foot radius with 24 feet of pavement, and showed the board the landscaping plan. Mr. Maloon showed the board his plan for adding the street name to the wall near the entrance. He said there will also be a regular street sign for Branch Street. The Planning Board voted on the following waiver requests. 1. Section 5.3.7.2, To allow a retention basin to be used for drainage outside of the water protection district Motion: To grant the waiver from Section 5.3.7.2 (Jodice - Ragazzo) All in favor. PASSES 7. , Public Comment Motion: To reappoint Mr. French Chairman (Jodice - McClanahan) All in favor. PASSES Motion: To reappoint Ms. Ashman- Collins Clerk (McClanahan - Cleary) All in favor. PASSES Mr. Cleary asked what the next steps are to follow up on the Strategic Plan. Mr. McClanahan suggested having a Planning Board workshop before sending out the RFP. Mr. Burke said he has sent the board a draft of the RFP asking for additional comment, after which he will ask Mike Ahern, the town's certified procurement officer, to put it in Planning Board 5 6/7/2012 the correct form. Mr. Burke said he is working on the build -out map with Xia Jin, the town's GIS manager, and the Town Manager is putting together a meeting with Dr. Mullin, the Board of Selectmen, School Committee, Planning Board and the ad hoe committee. Mr. French suggested scheduling the workshop when there is no other business. Consensus was to have a Planning Board workshop on June 27 to discuss the scope of work. Mr. Ragazzo said he had dinner at Asia Grill, and the owner told him about the positive experience he has had working with the Town of Mansfield.
