1. Meeting called to order at 7:30 p.m. MANSFIELD
Motion: To appoint Mr. Ragazzo Acting Clerk
(McClanahan-Jodice) All in favor. PASSES
I 2. Correspondence
1. March 7, 2011 letter from Jay Zola re: Stanley Place subdivision
Mr. Burke explained the request to amend the Stanley Place subdivision by looping
the water main back on itself rather than building it through an easement on the
abutting lot on Mary Dee Lane.
Mr. Zola explained that at the time of submission, the Water Department asked to
have the water main looped through Mary Dee Lane, which would improve the
conditions for both the existing subdivision and the new subdivision. He said he had
an easement agreement with the abutter on 16 Mary Dee Lane, and has recently
received a request for payment from that landowner for the easement. He said he
does not want to do that and would rather loop the water line back on itself within
Stanley Place. Mr. Burke said he would prefer the water be looped, but he agrees that
Mr. Zola should not have to pay to install the water line and also pay the abutter for
the easement. He said looping the main would improve the water quality for the
Mary Dee Lane residents as well as the new subdivision, but said he understands Mr.
Zola's concern about paying twice. Mr. Burke said Mr. Zola has spoken with Mr.
Gaffney, who is amenable to having the water main looped back on itself within
Stanley Place. Mr. Zola said he would send a letter to the abutter's attorney saying he
is willing to do the work under the original terms.
[Mr. Cleary arrived at this time.]
Mr. Burke explained DEP and the Water Department do not want to have dead end
lines of more than 650 feet, which was the reason for looping the main.
Motion: To allow the minor modification to the Stanley Place subdivision to allow
the developer the option to loop the water line back along Stanley Place in the event
the developer is unable to come to a mutual agreement regarding the water line
easement on 16 Mary Dee Lane with the respective homeowner.

2. Public Hearing notices - Attleboro, Norton
3. The Beacon
Mr. MacDonald said CIP has heard all of the department requests, and now the
committee will begin discussing funding options and priorities. He said the Jordan-

Jackson debt will be coming off the books soon, so that may result in some funding
possibilities. Mr. Burke said the committee has not heard a number for capital
acquisitions. He said the committee does not want to have to back into a number, but
would rather establish a capital plan. Mr. Penney said the town has a large investment in
its roadways, and there should be a plan to maintain them.
Mr. Jodice asked if the board would like to consider starting Planning Board meetings
earlier. The board discussed trying out a 7:00 p.m. start.
The board discussed the March 30 workshop topics, including possible recreation uses
for the County Street side of the Hatheway-Patterson site.
I 3. Form A (ANR) Plans
I 4. Site Plan Review - Vehicle Storage Lot - 1 Foundry Street
Bill Clemmey explained the plan for a fenced-in area that will be leased to Lance
Pontiac-Buick-GMC for the storage of vehicles. Access to the 120'xll0' area would be
off Foundry Street.
Department Head Comments
The clerk read a memo from Mr. Burke to the Planning Board indicating the ZBA
granted this entire parcel a number of variances/special permits in 2006.
The clerk read memos from Mr. Burke, Ptlm. Lawson and Chris Cox to Mr. Riccio.
Board Comment
Mr. Penney asked if this is a temporary use. Mr. Clemmey said it is not temporary, and
there will be a lease agreement with the tenant.
Mr. Penney asked about the grant of relief from the ZBA. Mr. Burke said when the ZBA
granted relief in 2006, it was for the entire parcel, so the applicant is only required to
show the location of the use.
Mr. Penney asked if the site is being used for parking now. Mr. Clemmey said it is being
used to store cars for the dealership.
Stu Abramson, Lance General Manager, explained they store cars on the site. The cars
will be driven to the site rather than be delivered by car carriers.
Mr. MacDonald asked if the hours of operation will be the same as the car dealership.
Mr. Abramson said the hours would be generally the same.
Mr. Jodice asked if a fence would have to be built. Mr. Clemmey said they would build a
fence for security.

Mr. Cleary asked how many cars could be parked there. Mr. Abramson said about 100
cars. Mr. Clemmey said the whole lot is about six acres; this area is about 10 percent of
the whole site.
Public Comment
Steve Speliewski, 42 Howe Street, showed the board pictures of the site and said he
doesn't have a problem with this proposal, but he is concerned about the tenant. He said
he has had problems with the tenant's employees obeying traffic laws during the delivery
of cars. He asked why the entrance is at the end of Howe Street and noted the crushed
stone seems to be causing drainage issues.
Mr. Clemmey said they plan to move the trench to redirect the water away from Howe
Street. He said they have to go through the town parking lot to get to their commuter lot.
He said they don't want to share uses on that parcel, so he doesn't want the entrance for
this use at the same place as the commuter parking entrance. He said they plan to do
some cleanup to ensure the water is going around Howe Street. Mr. Speliewski
suggested a curb cut at the fence on River Street so they wouldn't have to use the town
lot to access their property. Mr. Clemmey said that would be a longer way around to
access their site.
Mr. Penney asked what hours the lot is used. Mr. Abramson said the lot attendants leave
at 6:00 p.m., but there are some times the lot is used after that. He said the lot is not
constantly used, although it was used a lot in the winter to store cars while the main lot
was being plowed.
Mr. Penney asked if something could be worked out with the abutters. Mr. Clemmey
said they have redirected the runoff so it is not flowing to Howe Street.
Steve Passinisi, 30 Howe Street, said the area along Howe Street should be stabilized and
the property should be cleaned up. He said there are dead trees that need to be replanted,
and the area between the fence and Howe Street should be graded and seeded, and
perhaps some additional trees planted. Mr. French explained the board does not have the
ability to enforce something like that. Mr. Burke agreed. Mr. Clemmey said the row of
white pines were a requirement of the parking expansion, most of which are still alive.
He said they cleaned up the property when the buildings were removed, and plan to clean
the site up in the spring to make it presentable for the tenant. He said he will have
discussions with the neighbors to address their issues.
Mr. Penney asked what the long-term plans are for this property. Mr. Clemmey said they
could put in 60 apartment units if they got help from the town on FAR and access to the
train station; they could also put in a medical building or retail mall. He said they have
several designs for the property, but it is hard to start the process of development and be
handcuffed. He said they had considered mini-storage, but he said he doesn't want to do
that kind of project.
