Burke, Director of Planning and Development - , ,." c~ i .'-.) .:_.~. n: ?, I \1. Meeting called to order at 7:00 p.m. Motion: To appoint Mr. Cleary Acting Clerk (MacDonald-Ragazzo) All in favor. PASSES I 2. Correspondence 1. June 15,2010 letter from Ryan Sheehan re: field modification of the 2 Riverstone Lane building envelope for a deck expansion. Mr. Burke explained this was one of the earlier residential compounds the board permitted, with no condition relating to the building envelope on the plan or in the special permit. A portion of the existing deck is outside the building envelope; a portion of the expanded deck would also be outside the building envelope, but the entire deck would still be within the setback. Mr. Burke noted the town owns the land behind this house. Mr. MacDonald asked if the deck addition could be smaller and remain within the building envelope. Mr. Burke said that would be possible, but the deck wouldn't be square. He said in this unique situation, where the town owns land on three sides of the property and the deck would still be within the rear yard setback, he doesn't have a problem with the expansion. Mr. French said the board would have to decide if this is minor enough for a field modification, or if it requires a special permit modification. Mr. Burke said a request to change a condition in the permit would be significant; however, there is no condition regarding the building envelope in the Riverstone permit. Mr. French said the portion of the deck already outside the building envelope should not have been permitted. Mr. Burke suggested if the board chooses to allow this change, it should be clear that this is a unique situation, but is not significant enough to warrant a public hearing. He suggested adding a requirement that the decision be recorded at the Registry. Motion: To allow the field modification for the expansion of the existing 12'xI6' deck at the back ofthe house by an additional 12' x 16'. This decision is specific to this project on this property. The board finds this to be a unique situation because the property is surrounded on three sides by town-owned land and because the building envelope is approximately 80 feet from the rear lot line. Therefore, an expansion of the deck outside the building envelope will have no impact on residential abutters. This decision shall be recorded at the Bristol County Registry of Deeds and the receipt of recording shall be submitted to the Planning Department within 30 days. (Cleary-MacDonald) All in favor.
