Letter from Ralph Maloon re: Variance request of Stan Feck for a parcel of land at Tremont and West Streets — Mr. Burke explained that the request before the Board is due to the fact that Mr. Feck was denied a Variance on this parcel a year ago. He therefore requires a 617 affirmative ruling of the Planning Board that this application is substantially different than his prior request in order to bring it back before the Zoning Board of Appeals within two years of his initial application. Board members suggested the apparent difference is that his request is now for one house only; however, they decided they would like to discuss the matter with Mr. Maloon and/or Mr. Feck before ruling on the request. Motion: To have Mr. Maloon and/or Mr. Feck come in for discussion and to present something in writing that his request will be for only one lot. Also, to request the applicant to provide a document suitable for recording at the Registry of Deeds for the Board's review. (Dolan -Cook) 6 -0 PASSES 3. Letter from Thomas A. Letter from Michael Trowbridge re: Sherman Jackson Funeral Home Zoning By -Law Amendment Continued Public Hearing - Recreation Nancy LeClair of the Mansfield Youth Soccer League was present to discuss the Zoning Amendment sponsored by Mansfield Youth Soccer on the Special Town Meeting Warrant. She outlined the need for additional fields and the non -profit organization's inability to purchase land and their difficulty in developing playing fields under the Special Permit requirements of the Zoning By -Law. Board members expressed their concern about recreation being allowed as a use by right in residential districts without the benefit of a public hearing. They cited past experiences when recreation fields have been suggested as a possible use for open space land received in exchange for Special Permit subdivisions. In those instances, abutting residents have been in strong opposition. Members assured Ms. LeClair that they are very supportive of youth activities and do everything within their power to assist in the Special Permit process; however, they are charged with representing the Town as a whole and have to give consideration to neighborhood opposition. Discussion continued, with alternatives being suggested. Consideration was given to leaving the recreation by -law in its current state and working on an alternative for a Fall Town Meeting, as well as the possibility of coming up with an amendment for the upcoming Special Town Meeting that would be acceptable to the Town Moderator and to the Soccer League. The hearing closed without reaching consensus on the matter. illotion: To close the public hearing.
