4. Letter from Ralph Maloon re: Variance request of Stan Feck for Tremont and
West Streets — Mr. Feck presented the document, suitable for recording at the
Registry of Deeds and requested by the Board, limiting the lot to only one
house. He explained to the Board that at the Zoning Board hearing he was
asking for variances for lot width, for the driveway oft Tremont Street instead
of West Street, and for frontage. At the hearing he was asked by the ZBA if
he would be willing to have the variance conditioned by limiting the parcel to
a single dwelling. He stated lie was "surprised" by the question and said he

was not sure he was willing to agree to that. He has since decided he would
i be willing to accept that restriction as a condition of the granting of the
variance and believes that it is a significant enough change in the request to
allow the Planning Board to find that the Zoning Board of Appeals may re-
hear the petition within the two -year timeframe. Discussion regarding the
process and procedure was reviewed, with uncertainty arising as to the
interpretation of the statute. Questions were also raised as to the reason for
the Zoning Board of Appeals' denial because it was not stated in the decision.
Motion: To table the request until the Zoning Board of Appeals presents the
Planning Board with evidence of specific material changes in the application.

Site Plan Review — Indoor Skating Facility on Reservoir Street
William Buckley, Jr., of Bay Colony Engineering presented the site plan for an
indoor skating facility proposed by Andres Gazzolo on a site he currently owns on
the north side of Reservoir Street which is currently occupied by the Masonic
Lodge. Mr. Buckley explained that the 230 ft. by 110 ft. skating facility will be
added onto the end of the Masonic facility and made a part of it. He also
reviewed the area to be paved and pointed out there will be 202 parking spaces,
where 196 are required. The site consists of two parcels totaling 10.2 acres.
Drainage was discussed, with Mr. Buckley noting they have already gone before
the Conservation Commission and received a negative determination of
applicability.
Correspondence was read from the following:
Steve Bishop, Acting Water Department Superintendent
Lt. Joseph Sarro, Mansfield Fire Department
Scott Leite, Health Agent
Letter to Andres Gazzolo from Bertram Cook
Memorandum from Ptlm. Lance Lawson of the Police Department
Other issues raised for discussion were:
if the building is alarmed;
if there is a street light at the driveway;
traffic pattern in the corner of the parking lot being unsafe;
ensuring the facility is used only for in -line hockey and not open skating;
how occupancy load will be determined;
existing trees to be added to site plan and to remain on the site;
erosion control barriers;
number of video games allowed in each facility without triggering the need
for a license;
if there are plans for a public address system or loud speakers outside the
building;

Around the Table
The following dates were set for summer meetings:
July 14 "', July 28°', August 11`h, and August 25h
Mr. McShane complimented Mr. French on the good job he did at Town Meeting.
He also asked Mr. Burke to get a copy of the approved site plan for Bombolini's
for the next Planning Board meeting.
Mrs. Flynn asked:
What the difference in parking requirements are between a restaurant and
office building: office requires fewer — 1:4 for restaurant; 1:200 sq.ft. for
office building;
if we've received an engineering report on the peat at 47 Chauncy Street yet:
no;
status of the Ridgeview suit: notice of appearance filed; have heard nothing
further;
Jackson Senior Housing project: State denied the application for housing for
the elderly. It was then sent to the MHFA and it was denied. They reapplied
for `all ages ".
Mr. Dolan commented on the Town Meeting article for funds to appeal Great
Waves. It was noted that the funds are not for an appeal, but rather technical
review to assist Board's during the process.
Mr. French suggested the issue of the driveway and compactor at CVS be
revisited at some point.
