Zoning Workshop
The Planning Board reviewed various proposed amendments to the Zoning By-
Law as follows:
1. To see if the Town will vote to amend the Zoning Map to the extent necessary
to rezone a 21.11 acre area of land along Branch Street and abutting the
( former Old Colony Railroad right -of -way from its current designation of 1 -2 to
a proposed designation of R -1; or take any action in relation thereto.
Support: 5 -1 with Mr. French opposed
2. To see if the Town will vote to amend the Zoning Map to the extent necessary
to rezone a parcel of land consisting of approximately 54.8 acres on the east
and west sides of Gilbert Street from its current designation of I -2 to a
proposed designation of R -1; or take any action in relation thereto.
Support: 5 -1 -1 with Mrs. Flynn opposed and Mr. French abstaining
(Mr. French did not participate in discussion of the amendment)
The issue with both of these amendments was that isolated parcels zoned
"industrial" are in the middle of "residential" areas. The Board discussed the
importance of having continuity in an area. The downside of amending the
zoning is that it may put additional residential homes on the market more
quickly, creating a short -term negative impact. Board members felt that long-
term it makes sense not to increase the size of industrial areas surrounded by
residential areas.
3. To see if the Town will vote to amend the Zoning By -Law to the extent
necessary to amend Section 4.2.2 Density and Dimensional Regulations —
Business and Industrial Districts, Footnote (3) which currently reads:
Meeting of October 27, 1999
"In the I and I2 districts, side and rear setbacks shall be 75 feet when
businesses abut residential. Said setbacks shall be waived when abutting a
railroad easement in the 11, I2 and I3 districts."
to read as follows:
"(3) In the Il and 12 districts, side and rear setbacks shall be 75 feet when
business or industrial uses are within 75 feet of the property line of a
residential use or a residential zone line. Said setbacks shall be waived when
abutting a railroad easement in the I1, I2 and I3 districts."
Mr. Burke advised the Board that this article was drafted to prevent one foot
Form A lots such as the Board saw earlier this year. Mr. Frank suggested
further changes, noting the 75 foot on the side where it directly abuts the
residential property, but not if the residential property is on the other side of
the street. He said he is in support of the concept, but believes there are a
couple of vagaries to address in the spring.

4. To see if the Town will vote to amend the Zoning By -Law to the extent necessary to
amend Section 3.0 Principle Use Regulations, Table 3.1 .1 Schedule of Principle Use
Regulations to read as follows: It is the intent of this proposed amendment to
require Special Permits for retail and other similar uses and prohibit six other uses in
the Industrial 1 Zone (1 -2)

original tract of land upon which the Residential Compound is proposed shall
be counted toward the maximum density (6 dwellings) allowed by this by -law.
To read:

be counted toward the maximum density (6 dwellings) allowed by this by -law.
"shall" changed to "Wrap "; establishment of a time period suggested (i.e. 5

6. To see if the Town will vote to amend the Zoning By -Law to the extent
necessary to amend Section 4.4 Off - Street Parking and Loading and Section
4.4.4 Design and Special Conditions, paragraph 4.4.4.3 Location by adding
the following sentence:

common driveways or walkways, for other than single or two - family

paved surface other than access driveways, common driveways or
walkways, for other than single or two - family residential uses, shall be
located between the principal public street or way and the principal
structure.
4.4.4.3 Location
Required parking spaces and loading spaces shall be on the same
lot as the principal use(s) served; or if not reasonably possible, on
other property in the same zoning district within 200 feet of the
principal building. This 200 feet shall be measured along a public
way. Such off - premise parking shall be in possession, by deed or
lease, of the owners of the use served.
No parking space or other paved surface other than access
driveways, common driveways or walkways, for other than
single or two - family residential uses, shall be located between
the principal public street or way and the principal structure.
Scott Frank suggested the amendment "kills" highway retail. Also discussed was
the opinion that it would work in the Downtown area, or B -1 and B -2. Board
members could not reach consensus.
(Tonnan — opposed; McShane —would rather see something done with
landscaping; Cook — let's take a look at it later; Flynn — in favor; Frank — okay in
Downtown, B -1, B -2)
