Stillbrook Farm Continued Public Hearing
Mr. Sullivan read a memorandum from Town Engineer Lee Azinheira regarding
drainage. Also read was a letter from abutters Stephen and Brenda Lyons of 53 Angelina
Lane regarding their concerns about the waiver requested to construct a drainage swale
within the 100 foot setback area abutting their property line.
Leonard Bradley of Commonwealth Engineering reviewed changes made to the plan as
the result of comments and concerns at the last meeting. The drainage was redesigned to
eliminate the Swale in the rear of the property and to provide infiltrators for each lot .
The swale along Fruit Street was widened by two feet to meet greater water recharge
demands, reducing the stormwater flow to less than pre - development. The new plan also
showed the waivers granted at the last meeting to decrease the roadway width to 22 feet.
Wavier requests were reviewed and it was determined that two waivers remained to be
acted upon.
Motion: To grant the waiver from Section 5.3.2.7.5 of the Subdivision Regulations to
allow an infiltration swale along the Fruit Street right -of -way within 100 feet of the
subdivision boundary line to take more run -off from Fruit Street and to give the Town an
easement to keep the right -of -way clear.

Mr. Sullivan asked about landscaping plans for the swale and developer John Weddleton
said there would be wildflowers planted, backed up with a low split rail fence. Mr.
Bradley pointed out that the fence also delineates the easement.
The board declined to take any further action on the failed waiver request from Section
5.4.2 of the Subdivision Regulations to provide sidewalk on one side of the road only.
Motion: To approve the subdivision with the following conditions, subject to the revised
drainage calculations and language requested by the Town Engineer:
• revision of the plan to show sidewalks on both sides of the street
• a note be added to the plan and into each deed regarding the property's
proximity to the Mansfield Municipal Airport
• notation that wildflower plantings will be provided on the back of the Swale
along with a split rail fence
• the builder and/or developer advise the Town Engineer 48 hours in advance of

infiltration trenches being installed on individual lots so the systems can be
inspected prior to being covered
• a maintenance program be provided for the drainage system, with annual
reports of maintenance submitted to the Town Engineer.

Mrs. Flynn asked that the board be provided with a copy of the Town Engineer's
comments on the revised drainage. Mr. Burke requested that the applicant make all
revisions to the plan and provide revised plans to the board during the 20 -day appeal
period.
Motion: To close the public hearing.

Minutes of September 9, 1998
Motion: To approve
(Dolan - Sullivan)
Mrs. Flynn asked that some of Mr. Burke's comments to the board during "Around
the Table" regarding Great Waves be removed from the minutes. Noting that she was
not present at the meeting, she stated anyone reading the comments who was not
present could misinterpret their intent. Considerable discussion followed, with the
decision to hold the minutes for approval, with revisions being made to clarify the
intent of the discussion.
ZBA Application of John and Jane Foley for a Finding per Section 3.10AB of the
Zoning By -law with regard to sideyard setback to construct an addition at 292 Central
Street in an R -2 Zone
Motion: To send a positive recommendation to the Zoning Board of Appeals
because the addition is staying within the original footprint of the structure and is not
creating any new non - conformity.
(Sullivan - Torman) 6 -0 PASSES
i ZBA Application of Elisabeth and Peter Miller for a Variance from Section 4.2.1 of
the Zoning By -law — sideyard setback- to construct an addition at 11 Riverwood
Drive in an R -1 Zone. Mr. Burke suggested a negative recommendation be sent to
the Zoning Board of Appeals, noting the addition could be made smaller and not
require a variance.
Motion: To send a negative recommendation to the ZBA because the applicant has
not met the requirements of demonstrating a financial hardship or a problem with the
topography of the lot and because a smaller addition would be possible without the
need for a Variance.
