Dolan; Marydee Flynn; Thomas P. McShane; and Kenneth H. Tor,'m' W; "Also! pr6serlthias Shaun P. Burke, Director of Planning and Development. Meeting called to order at 7:30 p.m. Mr. Dolan was acting chairman until the arrival of Mr. French at 7:50 p.m. Minutes of August 12, 1998 Motion: To approve. (Torman- Sullivan) 4 -0 with French and McShane not present. PASSES ZBA Applications 1. Application of Village at Willow Crossings for a freestanding, two -sided sign at 132 South Main Street larger than the size allowed in an R -2 Zone. Motion: To send a negative recommendation to the Zoning Board of Appeals because the size of the proposed sign is overwhelming in a residential neighborhood and other businesses in the area have been limited to signs of smaller size. (Torman- Flynn) 3 -0 -1 with Dolan abstaining and French and McShane not present. PASSES 2. Application of Robert and Carol Luchette and Folkman and Zola Builders for a variance for less than the required parking at 47 Chauncy Street in a B -2 Zone. Motion: To send a negative recommendation to the Zoning Board of Appeals because twenty -four tandem parking spaces is inappropriate for the use shown on the lot and with the reduction in the number of spaces, no significant improvement in landscaping, open space, or other addition benefit to the Town is shown. It is also the understanding of the Planning Board, as represented at our public hearing, that this is to be twelve -unit rooming house —not a one bedroom multi- family dwelling. (Sullivan- Flynn) 6 -0 PASSES r Letter from Perry DiMascio re: use of site at the intersection of Oakland Street and Mansfield Avenue as an auto body shop – Mr. DiMascio spoke on behalf of the proposed tenant, explaining that he would like to operate an auto repair business on the site, previously approved as a contractor's yard, but never occupied. He asked the board for an informal opinion as to whether the applicant should apply for a Special Permit. Mr. Burke noted it would be good to see the building occupied after sitting vacant for Minutes of August 26, 1998 so long. He stated it is located in an I -3 zone, which is an appropriate location of a small scale shop such as is being proposed. Mr. McShane asked if any fumes would be released into the neighborhood. The applicant stated he would only be using paint, and that it would be vented out the back of the building toward the railroad tracks. Mr. Sullivan asked if all work would be done inside the building and the applicant explained that he would be buying cars at the auto auction to fix up and sell and that he would only be keeping three to four vehicles on the property at any time, with all being kept inside at night. Board members suggested it would be a Special Permit use and suggested that application be made. Stillbrook Farm Continued Public Hearing I Lynn Harper of Commonwealth Engineering was present to review revisions to the plan and to address department head comments read at the last meeting. Steve Lyons of 53 Angelina Lane and Tom Buckley of 60 Angelina Lane were also present at the hearing and asked questions regarding the proposed drainage, wetlands, and existing stonewall. Mr. Sullivan read a request from Commonwealth Engineering for a total of six waivers that were acted upon by the board as follows: 1. Section 5.2.2 of the Subdivision Regulations — requesting a reduction from the ( required pavement width of 24 feet to 22 feet to decrease the amount of impervious surface area and amount of stormwater runoff and overall impact of development. Motion: To grant the waiver because the roadway is only 560 feet long and it will reduce the amount of runoff. (Dolan - Sullivan) 6 -0 PASSES 2. Section 5.4.2 of the Subdivision Regulations — requesting waiver to provide sidewalk on one side of the road only to reduce the amount of impervious surface and future maintenance requirements of the town. Motion: To grant the waiver, provided the one sidewalk goes on the side servicing the most lots (Lots 2 through 6 and most of 7) and goes around the cul- de -sac to its furthest point because it will prevent additional impervious surface. (Dolan - French) 3 -3 with Flynn, McShane and Sullivan opposed. FAILS 3. Section 5.5.1 of the Subdivision Regulations — requesting waiver to substitute cape cod berm for the granite curbing required in order to better blend in with the existing conditions of Fruit Street which has no curbing. M Ail otion: To deny the waiver for cape cod berm to replace sloped granite curb. (Dolan- Flynn) 6 -0 PASSES 4. Section 5.3.2.7.5 of the Subdivision Regulations — requesting a waiver to place infiltration swales within 100 feet of the subdivision boundary line. 2 Minutes of August 26, 1998 v Motion: To deny the waiver to place infiltration swales within 100 feet of the subdivision boundary line in the rear of the property, but to grant the waiver for the front portion of the property along the Fruit Street right -of -way (Sullivan - Flynn) 3 -3 with Torman, Dolan and McShane opposed FAILS 5. Waiver from Section 5.3.2.7.10 of the Subdivision Regulations requiring a minimum cover of three feet over the drain lines. v Motion: To grant the waiver to reduce the minimum cover over the drain lines from three feet to one foot. (Dolan- McShane) 6 -0 PASSES ➢ Letter from Mansfield Housing Authority re: parking area at Park Court Elderly Housing and memo from Lance Lawson regarding the request — Mr. Burke explained that the request is the result of more of the elderly now owning vehicles and that they are proposing to go north to Old Colony Way and add twenty -four spaces. They now share parking with an adjacent condo complex. Motion: To send a letter to the Board of Selectmen, with a copy to the Housing Authority and Lance Lawson, noting that the Planning Board is not opposed to the request, but recommends that no decision be made regarding the matter until a plan is received and reviewed for both the proposed parking lot and the current parking lot for Fairfield, and to further suggest that any such design should include handicapped parking spaces near the entrance and that all spaces be lined and marked with apartment numbers. (Sullivan- Tonnan) 6 -0 PASSES ZBA Application of Richard and Claudia Rys for a variance to construct an addition to a single- family home at 1 Cherry Street with less than the required setbacks in an R -I Zone — Mr. Burke suggested the board send a negative recommendation. Motion: To send a negative recommendation because the addition further encroaches upon the setbacks and makes an existing non - conforming situation worse and there are other options which should be considered, such as building in the direction of the existing above- ground pool. (McShane- Torman) 4 -2 with French and Sullivan opposed. PASSES 4 Minutes of August 26, 1998 Mr. French noted the lot goes back at an odd angle, which is a hardship, and the applicant is attempting to use an existing concrete pad rather than having to put in a new foundation. Around the Table Mr. McShane asked if there is any update on the changes recommended by the Charter Review Commission. He was advised they are now recommending leaving the Planning Board at seven members.
