In discussing the application members also noted other ways to move the lot line to create the needed sideyard setback. Motion: To send a positive recommendation to the Zoning Board of Appeals with the suggestion the applicant not decrease the frontage, but rather radiate outward from the lot line at the front and swing back to the lot line at the rearyard to avoid coming under the subdivision control law. The second revision was agreed to. It was suggested the letter be brought to the Chairmen's meeting on May 14th for further discussion. Motion: To send out the letter if at the Chairmen's meeting the Board of Selectmen will agree to discard the first revision. (Sullivan- Flynn) 6 -0 PASSES • Letter from Sangermano Construction re: approval to reduce size of water and sewer easement from 20 feet to 10 feet - members noted that 20 feet is what is required and, if it's reduced to 10 feet, years from now someone will have to work in there and want to know why they only have 10 feet to work in. Minutes of May 6, 1998 Michael Trowbridge presented a Form A Plan for the Commonwealth of Massachusetts for four lots located at the intersection of Chauncy Street and Route 140. He explained that the land on the southeast corner came in as a Land Court plan for approval a few months ago, but the ANR Plan is necessary for recording at the Registry of Deeds. Motion: To sign the Form J Plan (Sullivan - Dolan) 6 -0 PASSES x Memorandum from Richard Lewis, Conservation Agent, dated May 5, 1998 x Letter from Michael Trowbridge dated May 6, 1998 x Letter from RIM Engineering dated May 6, 1998 Mr. Trowbridge noted the only item missing in the revisions is the catchbasin, which is shown as a 2 112 foot sump, has gone to 4 feet in an attempt to capture more solids. Mr. Dolan asked if the board had not also asked the applicant to demonstrate that a traditional subdivision could be built on the parcel. Mr. Trowbridge showed the plan he prepared for that purpose. Board members reviewed the plan; however, the plan showed only lots and not dimensions. In addressing the interesection offset issue, Mr. Trowbridge advised the board that a traffic report notes only two cars on average come out of Brian Lane during the peak morning hours. Mrs. Flynn noted the intersection offset would require a waiver for a traditional subdivision and, as a special permit cluster, the applicant should be required to demonstrate the benefit to the Town if the offset is allowed. Dr. Torman questioned the safety of the residents within the proposed subdivision relative to the length of the roadway with only one point of access onto Franklin Street. 2 Minutes of May 6. 1998 Mr. Burke pointed out that in reviewing this subdivision the Planning Board is holding two hearings concurrently - -one under subdivision control law and the other for the Special Permit - -and that one does not substitute for the other. Subdivision Control Law is the only way to create lots and the Special Permit is the only way to have a cluster allowed. Mrs. Flynn asked why the proposal was denied as a preliminary plan. Mr. Trowbridge said the biggest concern was it couldn't be built because it was against the lot line. Mr. Sullivan asked Mr. Trowbridge if a cut and fill analysis had been done on the site. He replied that it was done in the beginning and is pretty close to a balance. Mr. Sullivan then asked if there is a reason he proposed a 40 foot right of way instead of 50 feet. Mr. Trowbridge said it was done in an attempt to keep everything as close as possible. Mr. Sullivan noted for the record that the conventional plan should show both frontage and square footage for all lots. Mr. Burke asked if the traffic engineer has looked at the intersection offset and when the report will be ready. Mr. Trowbridge said it should be in by the end of the week. Mr. French asked if a test plan had been done to prove buildability and if the back lots had perced. Mr. Trowbridge said it had not been perced, but that by walking the site it's evident that the banks are all gravel. He also stated in response to Mr. French's question that the pervious material is of sufficient depth to meet Title V requirements. Mr. Trowbridge said he would like to schedule a site walk with the Board when the report of the traffic engineer is available. He said it would also take him a couple of weeks to put together a restoration plan for the site. Motion: To schedule a site walk for Saturday, May 16th, meeting at Town Hall at 9:00 a.m., and to continue the public hearing to June 3, 1998 at 8:00 p.m. (Dolan - Torman) 6 -0 PASSES S,tePlatt $evtew QualMrs lYI d81e ehool/JVI nsCicld Htg1u ScIt49I Mr. French noted the purpose of the Planning Board's review is to take a look at the qualitative design of the project and not to determine any code inadequacies, which is the function of the Municipal Building Committee and the professionals they hire. Kevin McBride of Keyes Associates stated they went through the site plan process three years ago and have now resubmitted, based on changes made in the design improvement. He pointed out the parking areas for both schools and the creation of a passenger drop -off area to keep traffic separate from the bus lanes. At the high school, 36 additional spaces were added in front of the school. The side parking lot was intended to remain as it, but it has deteriorated over the past three years to the point that it is now in need of re- doing. Mr. McBride reviewed all other parking areas on the plans, as well as drainage on the site. The Middle School currently has l I I parking spaces - -109 standard and 2 handicapped- - and will increase to 150- -141 standard and 9 handicapped. Mr. Dolan noted the board's Minutes of May 6. 1998 concern about parking on East Street and asked if parents would still be allowed to drop children off out front. Mr. McBride said the intent is to bring them into the drop -off area; David Young of the MBC said there will be appropriate signage to direct the traffic in. Mr. Young noted the MBC is charged with overseeing the building of the structures and solutions to the parking problems would require a collective effort of various Town departments. He noted Amos Robinson is chairing another committee to review the parking problems at the High School. There are currently 163 existing parking spaces at the High School - -157 standard and 6 handicapped - -which will increase to 277 spaces - -269 standard and 8 handicapped. Mr. Dolan asked if it is the Town or the State that is requiring the entire buildings to have a sprinkler system installed. Mr. Young said the State code requires the additions be sprinkled, but due to the size of the additions, the Town Fire Department is requiring the entire buildings be brought up to code. In further discussing parking and drainage issues, Mr. Young stated the Municipal Building Committee believes they have maximized the site and cannot provide any additional parking unless they are directed to take away recreation fields to use for parking. Mr. Burke noted the by -law establishes the number of parking spaces required for many uses, but does not identify the number required for classes in a school. It does not appear, however, that the ability exists to reasonably accommodate any more asphalt on the site. Methods to limit student parking were discussed, resulting in the agreement that it would be the School Committee's responsibility to make such policy decisions. Motion: To send a positive recommendation to the Building Inspector with the conditions that consideration be given to signage to direct cars to the student drop -off area and with the notation that it appearss the amount of parking provided on the site plan appears to be all that can reasonably be provided on site without detracting from the green space and recreation area that's left. (Sullivan- Dolan) 6 -0 PASSES The Planning Board reviewed a Form A Plan for the Scarpellinis prepared by RIM Engineering for land on Fox Street. Mr. Burke explained that the plan seeks to eliminate the former Lot 2, create Lot B as a whole area, then change the rear lot line for the existing house and push it back. The remaining lot would be a 200,000 sqare foot parcel off the end of the bubble. Mr. Sullivan commented on the board's previous review of the plan, noting that Mr. Frank's earlier concern as to whether the plan would be creating a non - conforming lot because the lot on which the existing house sits previously had frontage on Fox Street. Since the former lot lines were not indicated on the plan, the board was unable to make a determination. Motion: To deny the plan and return it to the applicant due to lack of clarity of the previous lot lines and concern that the result may be the creation of a non - conforming lot which may require a subdivision plan due to lack of frontage. 4 Minutes of May 6, 1998 (Sullivan - Torman) 6 -0 PASSES Mr. Dolan asked what regulations govern burying stumps, rocks and other debris during construction. Dr. Torman asked questions regarding roadway length.
